CALL TO ORDER
Chairperson Matthew Criswell called the Regular Meeting of Tuesday,
January 26, 2021 of the Code Enforcement Board to Order at 5:30 p.m., in
the Commission Chambers of the Municipal Building (City Hall, 1126 East
State Road 434, Winter Springs, Florida 32708.

Chairperson Criswell invited Commissioner Rob Elliott to speak briefly.
Commissioner Elliott introduced himself and discussed his idea for a
Winter Springs Work Day.
City Clerk Christian Gowan swore in all those offering testimony – Code
Officer Terri Guerra and Respondents.

continuing in the role.

The Respondent was present.
Code Officer Terri Guerra introduced the case and testified, “The date of
the complaint was February 19, 2020. The date I verified the complaint
was the same day, February 19. I sent a Notice of Code Violation (NCV),
the letter came back in the mail. On March 19, 2020 I posted the NCV on
the property. I had several conversations with Mrs. Callaghan regarding
getting the house under control. She has had many issues with her
husband having medical problems. We also reached out – Officer Tracey
Fugate attempted to assist her with getting the roof corrected and she
refused at that time. On January 5, 2021 I sent the owners a certified and

first class letter regarding Code Board. I also posted the property and City
Hall. I have not had any other contact at this time.”
Code Officer Guerra showed photographs from her presentation.
“As of this hearing, I ask that you find the homeowner in violation of
ordinances that I've given testimony to, and would extend no more than
30 days (February 19, 2021) to come into compliance. If no compliance is
met after that additional time, I ask that a fine of $250.00 per day.”
Brief discussion followed on photographs and the time this violation has
existed.
Mrs. Sally Ann Callaghan, 41 S. Edgemon Avenue, Winter Springs, Florida
testified, “At the beginning of last year my husband, in February he was
in the hospital for 3 days, and in March he was in the hospital for three (3)
days and they found he had lymphoplasmacytic lymphoma – last year
was dedicated to making sure he was alright and they also found he was
hypoglycemic. Last year that was my focus on everything. His numbers
are coming down so he is doing well with that. Before Christmas I was
working on getting stuff cleaned up but I re-pulled muscles in my back
and twisted my knee and I took time off and I didn’t get started soon
enough in January. My husband and I have been working on it and we’ve
done everything but we do have one large future, but were going to have
our neighbors help us with that. My daughter wants to see two things I
have there on marketplace and the other is two chairs and she wants to
see what she can do for those… the reason I turned down help last year
was because I was told basically that we can get a big dumpster and
throw all your stuff in it – that is why I turned her down. Trying to care for
my husband. Most of his family has Alzheimer’s and he is starting to show
early signs of it…front entrance we got that completely covered. The
growth was vines, we got all that taken care of. The tarp on the roof being
held by brick, a neighbor got up and put screws in like it is supposed to
be. I don’t have a problem with February 19th.”
Discussion followed on the respondent’s ability to comply by the
recommended date, proper placement of outside furniture, and keeping
in contact with Code Officers.
Code Officer Guerra noted that she had seen improvement in a drive-by
today.

Further discussion followed on the roof and the need to repair rather
than secure a tarp.
Discussion followed on an appropriate compliance date given the work
needed for the roof.
Responding to a question about potentially setting different compliance
dates, Senior Attorney Nix noted that all violations were brought as one
case and therefore one compliance date should be applied.
City Clerk Gowan swore in an additional respondent.
Ms. Tina Callaghan, 32108 Chipola Trail, Sorrento, Florida asked “If they do
go through the insurance company if we come back with a quote or
paperwork could we extend it at that time, just for that portion.” that be
brought back to
Senior City Attorney Nix noted the City’s lien reduction program for
possible consideration down the line.
Further discussion followed on the possibility of reducing the fine if the
Board deemed it appropriate at a Non-Compliance Hearing.
“I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
AND ORDER THAT RESPONDENT BE GIVEN UNTIL MARCH 19, 2021 TO
CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT FAILS TO
COMPLY BY THIS DATE A FINE IN THE AMOUNT OF TWO HUNDRED AND
FIFTY DOLLARS ($250.00) SHALL BE IMPOSED FOR EACH DAY THE
VIOLATION CONTINUES THEREAFTER.”

Municipal Code Code Text
WS City Ord. 6-195 All fences and walls and accessories thereto shall be maintained in good order and in
a condition equal to that which was originally approved by the building official at the
time a permit was issued. If for any reason the fence or wall was erected without a
permit, said wall or fence shall be maintained in accordance with the conditions and
requirements necessary for obtaining a fence or wall permit from the building official
under this article. Within thirty(30) days receipt of written notice by the city that a
wall or fence does not comply with the requirements of this section, a property owner
shall bring such fence or wall in compliance with this section within thirty(30) days
of receipt of such notice. The thirty-day period may be extended an additional thirty-
day period by the city manager or the city manager's designee for good cause shown.
WS City Ord. 13-2(b) t shall be unlawful for any person to cause or permit junk, scrap metal, scrap lumber,
wastepaper products, discarded building materials, or any unused abandoned vehicle,
or abandoned parts, machinery or machinery parts, garbage,trash or other waste
materials to be in or upon any yard, garden, lawn, outbuildings or premises owned,
rented, leased or otherwise occupied by him/her in the city unless in connection with
a business enterprise lawfully situated and licensed for the same.

other dead, or living plant life; or stagnant water, rubbish, garbage, refuse, debris,
trash, including but not limited to household furnishings, and all other objectionable,

lumber, wastepaper products, discarded building materials, or any unused
abandoned vehicle, or abandoned parts, machinery or machinery parts, garbage,
trash or other waste materials to be in or upon any yard, garden, lawn, outbuildings
or premises owned, rented, leased or otherwise occupied by him/her in the city
unless in connection with a business enterprise lawfully situated and licensed for the
same.
WS City Ord. 13-2(c) The existence of excessive accumulation or untended growth of weeds,
undergrowth or other dead, or living plant life; or stagnant water, rubbish, garbage,
refuse, debris, trash, including but not limited to household furnishings, and all other
objectionable, unsightly or unsanitary matter upon any lot, tract or parcel of land
within this city be it uncovered or under open shelter, to the extent and in the

manner that such lot, tract or parcel of land is or may reasonably become infested
or inhabited by rodents, vermin or wild animals, or may furnish a breeding place for
mosquitoes, or threatens or endangers the public health, safety, or welfare, or may

adjacent property, or any other objectionable, unsightly substance or material
tending by its existence and/or accumulation to endanger or adversely affect of

IPMC 302.1 All exterior property and premises shall be maintained in a clean,safe and sanitary condition. The
occupant shall keep that part of the exterior property which such occupant occupies or controls in a
clean and sanitary condition.
IPMC 304.2 All exterior surfaces,including but not limited to,doors, door and window frames,cornices,
porches,trim,balconies,decks and fences shall be maintained in good condition.Exterior wood
surfaces,other than decay resistant woods, shall be protected from the elements and decay by
painting or other protective covering or treatment.Peeling, flaking and chipped paint shall be
eliminated and surfaces repainted. All siding and masonry joints as well as those between the
building envelope and the perimeter of windows,doors,and skylights shall be maintained weather
resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit
such rust and corrosion and all surfaces with rust or corrosion shall be stabilized and coated to
inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces
designed for stabilization by oxidation are exempt from this requirement.

trash, including but not limited to household furnishings, and all other objectionable,

unsightly or unsanitary matter upon any lot, tract or parcel of land within this city be
it uncovered or under open shelter,to the extent and in the manner that such lot,tract
or parcel of land is or may reasonably become infested or inhabited by rodents,
vermin or wild animals, or may furnish a breeding place for mosquitoes, or threatens
or endangers the public health, safety, or welfare, or may reasonably cause disease, or
adversely affects and impairs the economic welfare of adjacent property, or any other
objectionable, unsightly substance or material tending by its existence and/or
accumulation to endanger or adversely affect of health, safety, lives, and/or welfare of
the citizens of the city, is hereby prohibited and declared to be a public nuisance and
unlawful.
IPMC 304.2 All exterior surfaces, including but not limited to,doors,door and window frames, cornices,
porches,trim,balconies,decks and fences shall be maintained in good condition. Exterior
wood surfaces,other than decay resistant woods, shall be protected from the elements and
decay by painting or other protective covering or treatment. Peeling, flaking and chipped
paint shall be eliminated and surfaces repainted.All siding and masonry joints as well as
those between the building envelope and the perimeter of windows, doors,and skylights
shall be maintained weather resistant and water tight. All metal surfaces subject to rust or
corrosion shall be coated to inhibit such rust and corrosion and all surfaces with rust or
corrosion shall be stabilized and coated to inhibit future rust and corrosion.Oxidation stains
shall be removed from exterior surfaces. Surfaces designed for stabilization by oxidation are
exempt from this requirement.
WS City Ord. 13-2(b) It shall be unlawful for any person to cause or permit junk, scrap metal, scrap lumber,
wastepaper products, discarded building materials, or any unused abandoned vehicle,
or abandoned parts, machinery or machinery parts, garbage,trash or other waste
materials to be in or upon any yard, garden, lawn, outbuildings or premises owned,
rented, leased or otherwise occupied by him/her in the city unless in connection with
a business enterprise lawfully situated and licensed for the same.
IPMC 304.8 All cornices,belt courses,corbels,terra cotta trim,wall facings and similar decorative
features shall be maintained in good repair with proper anchorage and in a safe condition.
IPMC 304.7 The roof and flashing shall be sound,tight and not have defects that admit rain. Roof
drainage shall be adequate to prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains,gutters and downspouts shall be maintained in good
repair and free from obstructions. Roof water shall not be discharged in a manner that
creates a public nuisance.
WS City Ord. 17-1 It shall be unlawful for any person to place or deposit, or cause or allow to be placed
or deposited, on any street, avenue, alley or sidewalk, park or other public space
within the limits of the city, any building material whatsoever, or any articles or
things which may obstruct or hinder the traffic thereon, without a special permit from
the city commission or official who has been designated by the city commission to
issue such permit. Such permit shall state clearly what space may be used and what
materials may be placed thereon,the length of time the permit shall remain in force,
and the terms and conditions upon which the authorization for placing materials on
public property is granted. When, in the discretion of the city commission or an
official who has been designated by the city commission, it becomes necessary for the
protection of motorists or pedestrians, the person issued the permit shall provide
adequate protective devices to include, but not limited to, sheds, walls, and guardrails
to protect persons in the area. Such protective devices shall be constructed in
accordance with plans approved by the city commission, or an official who has been
designated by the city commission, and shall be maintained thereafter during the
construction or repair, but under no conditions shall the streets or sidewalks be
obstructed to such an extent to not allow passage of pedestrian and vehicular traffic.
IPMC 304.14 During the period from[DATE]to [DATE],every door,window and other outside opening
required for ventilation of habitable rooms, food preparation areas,food service areas or any
areas where products to be included or utilized in food for human consumption are
processed,manufactured,packaged or stored shall be supplied with approved tightly fitting

Timeline of Events
On August 25, 2020 I presented this case to the
board. The resident was found to be in
violation, and a corrective action date of
October 09, 2020 was afforded. If not
corrected, a fine of 250.00 per day would be
assessed.
During my re-inspection, the resident was still
in violation. January 28, 2021 I posted the
property and City Hall with non-compliance
notice of hearing. I also sent the notice
certified and first class to the owner.
February 10, 2021 the USPS website showed the
notice was delivered.

screens.There is also a taped patch on one of the screens that
needs to be repaired.

of residence needs to be cleaned off. If any paint should chip off

IPMC 304.9 OVERHANG EXTENSIONS Vent on left side of residence is loose and needs to be corrected
before it falls out.
WS CITY ORD.6-195 FENCES The fence door is falling apart. Slats needs to be replaced if
broken and door needs to be able to be opened properly. If
repair costs over 100.00 a permit will be needed from Winter
Springs City Hall 407-327-1800.
Failure to correct the violation(s)and to notify the Winter Springs Code Enforcement Division of the corrections will result in
charges being brought against you before the City of Winter Springs Code Enforcement Board which has the power to levy
fines up to$250.00 per day for first offenses or up to$500.00 for repeat offenses per day that the violation remains.

structurally sound and in good repair.
IPMC 302.1 All exterior property and premises shall be maintained in a clean, safe and sanitary
condition. The occupant shall keep that part of the exterior property which such occupant
occupies or controls in a clean and sanitary condition

WS City Ord. 13-2(b) It shall be unlawful for any person to cause or permit junk, scrap metal, scrap lumber,
wastepaper products, discarded building materials, or any unused abandoned vehicle,
or abandoned parts, machinery or machinery parts, garbage,trash or other waste
materials to be in or upon any yard, garden, lawn, outbuildings or premises owned,
rented, leased or otherwise occupied by him/her in the city unless in connection with
a business enterprise lawfully situated and licensed for the same.
IPMC 304.9 All overhang extensions including,but not limited to canopies,marquees, signs,metal
awnings, fire escapes,standpipes and exhaust ducts shall be maintained in good repair and
be properly anchored so as to be kept in a sound condition. When required,all exposed
surfaces of metal or wood shall be protected from the elements and against decay or rust by
periodic application of weather-coating materials, such as paint or similar surface treatment.
WS City Ord. 6-195 All fences and walls and accessories thereto shall be maintained in good order and in
a condition equal to that which was originally approved by the building official at the
time a permit was issued. If for any reason the fence or wall was erected without a
permit, said wall or fence shall be maintained in accordance with the conditions and
requirements necessary for obtaining a fence or wall permit from the building official
under this article. Within thirty (30) days receipt of written notice by the city that a
wall or fence does not comply with the requirements of this section, a property owner
shall bring such fence or wall in compliance with this section within thirty(30)days
of receipt of such notice. The thirty-day period may be extended an additional thirty-
day period by the city manager or the city manager's designee for good cause shown.
