Chairperson Matthew Criswell called the Regular Meeting of Tuesday,
August 25, 2020 of the Code Enforcement Board to Order at 5:30 p.m.,
in the Commission Chambers of the Municipal Building (City Hall, 1126
East State Road 434, Winter Springs, Florida 32708.

The Respondent was present.
Code Officer Guerra introduced the case and testified, "On April 23, 2020
1 observed the decorative feature on the front of the residence rotting
and falling off the house. There was old yard waste in the yard and old
flower pots behind the shed. I noticed exposed wood on the soffit area. I
sent a notice of code violation to the owner. On May 9, 2020, Kristin
Visavachaipan signed for the notice of code violation. On August 11,2020
1 posted the property and City Hall with the Notice of Code Board. I also
sent certified and first class letter to the owner. On August 13,2020 notice
was left by the United States Postal Service there was no authorized
recipient available. There has been no contact from the owner."

In conclusion, Code Officer Guerra testified, "I am recommending the
Board find the property in violation and impose a fine of$100.00 a day if
found in non-compliance. The owner should be given until September
15, 2020 to comply."
Attorney Nix noted that only Winter Springs City Ordinance 13-2(b) Junk
and Debris would be considered.
Ms. Christine Visavachaipan, 707 Candlewick Road, Altamonte Springs,
Florida 32774 testified, "Picky Cooper was my father who passed. Entered
photos into record.This was my father's home that passed. I am trying to
get in to shape to sell or rent." Discussion followed on the need for
protective treatment.
"I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
AND ORDER THAT RESPONDENT BE GIVEN UNTIL SEPTEMBER 15,
2020 TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT
FAILS TO COMPLY BY THAT DATE A FINE IN THE AMOUNT OF ONE
HUNDRED DOLLARS ($100.00) PER DAY SHALL BE IMPOSED FOR

The Respondent was present.
Code Officer Guerra introduced the case and testified, "On June 25, 2020
1 received a complaint regarding this resident having a large amount of
junk and debris in the driveway, also that there was a large truck parked
and the grass was high on the property. When I did go to the residence
to check for the violation Mr. Grannan came out to my truck to speak to
me. I told him that we received another complaint and this is an ongoing
thing. We get a complaint, we notice him, he cleans it up, and then it
goes right back to the way it was. Mr. Grannan advised he would clean it
up. He needed some more time and he and his wife were going through
some hardships financially at this time. He has done better in the past. A
few years ago he had another location for his items. Now he is going
backwards and everything is being stored at the house again. On June
26, 2020 1 sent Notice of Code Violation to the owners of the property. On
July 9, 2020 the Notice of Code Violation was received. On August 10,
2020 1 checked the property. The truck has been removed and the grass
has been cut in the back. The junk and debris violation still
persists. August 11, 2020 1 posted the property and City Hall with the
notice of Code Board. I also sent certified and first class letter to the
owner of the property."
Code Officer Guerra showed photos from "Related Case Information."
Code Officer Guerra then testified, "I am recommending the Board find
the property in violation and impose a fine of $250.00 a day if found in
non-compliance.The owner should be given until September 15, 2020 to
comply."
Mr. Donald Grannan, 629 Sailfish Rd, Winter Springs, Florida
32708 testified, "The house has an in-law suite, the back house is rented.
We have a tenant back there so this is not really a single-family residence.
There is a fence now on the side...I am putting a gate on the edge of that
fence to match the fence." Mr. Grannan went on to note that the fence

and gate would be eight feet tall and discussion followed on commercial
vehicles, measures taken, and how best to avoid potential issues in the
future.
Attorney Nix noted the Code Enforcement Board was only dealing with
a violation of Winter Springs City Ordinance 13-2(b) for this hearing.
Mrs. Barbara Grannan, 629 Sailfish Road, Winter Springs, Florida
32708 testified, "I know in the report it said this has been going on for a
while. My husband rented a [storage] unit but the rent got too high...that
is the reason why he is doing what he is doing."
"I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
AND ORDER THAT REPSPONDENT BE GIVEN UNTIL SEPTEMBER 15,
2020 TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT

Code Officer Guerra testified, "On March 26, 2020 1 observed black
growth all over the front of this residence. On April 3, 2020 the Notice of
Code Violation was delivered. On August 11, 2020 1 posted the property
and City Hall with the Notice of Code Board and I also sent a certified and
first class letter to the owner."

Continuing, Code Officer Guerra testified, "There has been no contact
from the owner at this point. I am recommending the Board find the
property in violation and impose a fine of 100.00 a day if found in non-
compliance. The owner should be given until September 15, 2020 to
comply."
Referring to Unit B, originally Item 504, Code Officer Guerra testified, "On
March 26, 2020 1 observed black growth all over the front of this

going to go ahead and suggest we just do $100 for both if that is ok with
the Board."

AMOUNT OF TWO HUNDRED DOLLARS ($200.00) SHALL BE IMPOSED
FOR EACH DAY THE VIOLATION CONTINUES THEREAFTER." MOTION

Code Officer Guerra testified, "On June 11, 2020 1 received a complaint
regarding this residence and the high grass. I went to the residence and
noticed the grass was extremely high. The trees and weeds were
covering the sidewalk. Weeds are growing up the side of the residence
to the roof.Weeds are growing up into the gutters.The gutters are falling
off. The paint is chipping off the house and porch area. Wood beams on
the side of the house are rotting. There was a walker and several other
items on the back porch. The screen has fallen off of the front window
and there was trash all over the yard. Tree limbs were resting on the
roof. It appears no one is living at the residence. There are old flyers at
the door and the weeds are covering most of the front walk way. I sent
Notice of Code Violation to the owner of the property. On June 15, 2020
the Notice of Code Violation was delivered to an agent.

On July 30,2020 1 received a call from the daughter of the owner advising
that she is in an assisted living facility. She also advised the property was
part of a reverse mortgage and they are supposed to take over the
property. Her mother has been out eft e house since August. She gave
me the number and I attempted to call the They advised they could
not tell me anything about the property. I did advise them ofthe
situation and that there would be fines on the residence if taken to Code
Board. On July 10, 2020 we remedied the grass and tree limbs growing
onto the sidewalk with our contracted landscaping company. I sent the
bill tot e owner. On August 11, 2020 1 posted the residence and City Hall
regarding Code Board and I also sent it certified and first class tothe
owner."

Code Officer Guerra testified, "On July 1, 2020 1 received a complaint
regarding the fence at 627 Alton Rd. I asked neighbor at 629 if I could go
on to his property to see the violation. While there, I noticed a tear in the
pool enclosure.Also the fence at 629 was falling as well.Also the vent was
falling out of overhang extension. I sent Notice of Code Violation to the
owner. On July 8, 2020 the notice was delivered to the owner. August 11,
2020 1 posted Code Board Notice at the property and City Hall. I also sent
notice certified and first class to the owner. On August 13,2020 the notice
was delivered. There has been no contact from the owner."

the property in violation and impose a fine of $150.00 a day if found in
non-compliance.The owner should be given until September 15, 2020 to
comply."

23, 2020 Code Enforcement Board Regular Meeting and then testified,
"The Code Board ordered owners have violations corrected by July 13,
2020 and if violations were not corrected a fine of 50.00 a day would be
imposed. On August 11, 2020 a Notice of Non-Compliance Hearing was
sent to the owner on record and posted at City Hall and the property. On
August 13, 2020 the United States Postal Service website advised it was
going to be returned to sender."
