Second Reading Of Ordinance 2020-04 Amending Chapter 20 of the City Code authorizing the operation of "mobile food dispensing vehicles" as a temporary accessory use in certain limited zoning districts in furtherance of section 509.102(2), Florida Statutes and at Special Events authorized by the City; providing general standards for operating mobile food dispensing vehicles; providing for the repeal of prior inconsistent ordinances and resolutions; incorporation into the code; severability; and an effective date. City Attorney Anthony A. Garganese read Ordinance 2020-04 by title only. Mayor Lacey opened the Public Hearing for Item 400. Mr. James Evans, 277Almaden Court, Winter Springs, Florida spoke about concerns related to the permitted zoning districts for food trucks and asked if staff had looked at allowing more than the currently stated zoning districts. Mr. Jeff Brown, 227 Nandina Terrace, Winter Springs, Florida asked that the Ordinance be further reviewed citing concerns about restrictions regarding permitted zoning districts food trucks can operate in. Ms. Jennifer Martin, 200 East State Road 434, Winter Springs, Florida spoke about food trucks as competition for the restaurant which she operates and asked the Commission to think about brick and mortar establishments when making a decision. Ms. Gina Shafer, Winter Springs Village, Winter Springs, Florida asked if food trucks would be allowed to operate at special events and/or parks and thanked the Commission for addressing this issue. Ms. Howard introduced the agenda item and discussed the concept of the area, including location, landscaping, and other design elements. Discussion followed on criteria for eligible honorees and impacts on any current events. Commissioner Kendrick noted the ownership of twenty -plus (20+) acres of land east of the Town Center and discussed a concept of the City putting a boardwalk through to create a passive park. (Winter Springs Tree City Trail). It was agreed that this would be brought for discussion at a future meeting. 501. The Commission agreed to Monday, September 21, 2020 as the date of the first meeting. Mayor Lacey opened Public Input for the subject of appointments to the Diversity Boa rd. No one spoke. Seat Three Commissioner/Deputy Mayor Ted Johnson • Noted his attendance at the City's drive-in movie and said it was a great success. • Mentioned the upcoming Fish Winter Springs event being held August 15, 2020. • Thanked Ms. Lena Rivera, Director, Public Works and Utilities Department for her assistance and dedication. • Thanked Chief Chris Deisler for his and his department's work patrolling Winter Springs. 605. Seat Four Commissioner TiAnna Hale • Inquired about grants to support local small businesses. • Thanked Mr. Christopher Schmidt, Director, Community Development Department for his hard work. 606. Seat Five Commissioner Geoff Kendrick • Praised recent events the City has been holding. • Noted the "Free Little Library" in Torcaso Park and thanked former Commissioner Joann Krebs for the donation. • Mentioned issues at Oak Forest Lake and other properties to be looked at by the Community Development Department. o Discussion followed on nitrates, fertilizers, and runoff,. 608. PUBLIC INPUT Mayor Lacey opened "Public Input". Mr. Matthew Benton, 474 Cedarwood Court, Winter Springs, Florida spoke about the quality of audio streaming and recommended improvements be made. Ms. Gina Shafer, Winter Springs Village, Winter Springs, Florida spoke favorably of the Employee and Leadership Garden and encouraged showcasing the history of the City. Encouraged education about the stormwater/retention ponds. Continuing, she asked if closed captioning services could be provided through a sponsor to take on the costs. Thank you. History: Previous Community Development Director renewed Special Event permits since 2017. When the Community Development Office received a renewal late in 2019, I met with Legal and City Manager to confirm that this use, was unfortunately not permitted and was permitted incorrectly for several years. The item went before the City Commission and a Temporarily Land Use Permit was issued for 90 days with a 90 days extension, starting on February 13, 2020. Florida Smokehouse requested the extension and the permit will terminate on August 10, 2020. The Commission also instructed staff to work with Florida Smokehouse in regards to a possible new location while staff began drafting the new Food Truck (mobile food dispensing vehicle) Ordinance. During the 202o Florida Legislative session, the Florida House and Senate each passed bills, HB 1193 and SB 474, which generally was an omnibus kind of legislation pertaining to the deregulation of many kinds of professions and occupations. More specifically related to the proposed Ordinance, the new law addressed the regulation and definition of a mobile food dispensing vehicles (MFDV). The bill was executed by the Governor and took effect on July 1, 2020. See Chapter 202o-16o, Laws of Florida. The law preempts municipalities from outright prohibiting mobile food dispensing vehicles in the "entirety" of the jurisdictional limits of the City, and provides a limited preemption pertaining to licensing, registration, or permits and related fees other than what is required by Section 509.251, Florida Statutes. However, the law does allow for municipalities to regulate the operation and location of mobile food dispensing vehicles. Currently the City Code does not expressly allow or regulate the operation of mobile food dispensing vehicles and staff was instructed to research and propose an ordinance addressing the effects of the new law described in HB 1193 and SB 474• The proposed Ordinance was prepared at the City Commission's direction while keeping in -line with the Florida Statue. Timeline: 2020/01/27 — During the City Commission Meeting, a Food Truck discussion was held as a Regular Agenda item. Staff was directed to ,,Arork with Mr. Brown to issue a Temporary Use Permit for 90 days with an extension of an additional 90 days along with drafting a new Ordinance addressing Food Trucks. 2020/01 — 2020/02 — Worked with Mr. Brown to issue the Temporary Land Use Permit 2020/02/13 — Temporary Land Use Permit Issued for Florida Smokehouse 2020/05/01— Temporary Land Use Permit extended 2020/o6/o8 — First Reading of Ordinance at the City Commission (Public Hearing), Mr. Brown was in attendance and spoke for the record.
