I received your voicemail message of this morning seeking information regarding the City's permitting of political
signs. The most recent revisions to the City's sign code removed any specific regulation of political signs. In
short, this was done because regulations related strictly to political signs and not to other signs has been
interpreted by courts as a "content -based" regulation (regulation based on the message of the sign) and violative
of the First Amendment.
Thus, under the City Code, political signs should be regulated just like any other temporary sign. "Temporary
sign" is defined as "a sign displayed before, during or after an event or occurrence scheduled at a specific time
and place, inclusive for example, for rent signs, for sale, construction signs, real estate signs, management
signs." Sec. 16-51, City Code.
Section 16-55(6) exempts temporary signs from permitting as long as they do not exceed six (6) square feet, and
as long as the signs meet the requirements of sections 16-59 and 16-60.
Finally, please note that there is no time restriction as to how early temporary signs may be erected; however
section 16-60(a) requires that temporary signs be removed within 3 days after the date upon which the sign has
fulfilled its purpose (i.e. the date of the election for election -related temporary signs).
