Ron and Glenn, while I do not have all the facts, it appears that if the excessive accumulation of "rubbish,
garbage, refuse, and trash" is coming from the shopping center and encroaching into the neighborhood and
rights -of -ways, at the very least code enforcement should declare the shopping center a public nuisance and cite
the shopping center owner under Section 13-2(c), Winter Springs Code. Glenn, you should note the special
nature of 13-2. There are special notice requirements that require posting the property with specific information.
If the property owner does not abate the public nuisance within 15 days, by taking steps acceptable to the City,
the City can take immediate action to remedy the nuisance and record a PRIORITY lien on the shopping center
property for all the costs incurred by the City to abate the nuisance. If the property owner appeals the code
enforcement officer's decision, the matter goes directly to the City Commission, unlike a standard code
enforcement case. The City Commission then will have the final say over the declaration of the public nuisance
and the remedy that is required to abate it. Not only should the property owner clean up the debris, but one other
remedy that comes to mind is the expeditious construction of a temporary black construction screen until the wall
is built. Such screens are frequently used to keep wind blown debris from leaving construction sites; it may work
to keep any papers from encroaching into the neighborhood.
Ron and Glenn, there are a lot of other special details in section 13-2 that I can talk to you about. This email,
however, describes the general nature of the possible action.

To Whom It May Concern:
Our Family has lived in Winter Springs since 1996 when we purchased our first home and have seen
many changes and a lot of improvements to the City that make us very proud to live here. We live at
346 San Miguel Street in the Indian Ridge Subdivision behind the shopping center where the Drivers
License Branch is located.
As I'm sure many of you are aware that this shopping center has changed owners several times. I have
had several conversations with Detective Tolleson regarding the wooden fence issue that remained
broken and in very poor shape for at least a year or more. We were very excited to learn that the City of
Winter Springs required and/or asked the new owners of the center to take down the wooden fence and
replace it with a block mason wall. Between the week of Christmas and New Years, the wooden fence
was removed. I personally contacted the Code Enforcement office, Permitting Office and the
Leasing Office of the center around 2 weeks ago to find out when the new wall would be started.
The only person who returned a call to me was Detective Tolleson and he thought it would be about

another month before it was done, but he said he thought the footers had already bee n dug for the wall.
Now we are another 2 weeks later and we have seen NO progress with the wall going up. I decided to
contact the leasing office for the center today and see if they would have any update. I did not get the
gentlemens' name that I spoke with. I asked him if there was any update on the wall and he said he
would have to check with the owners of the center. I then said that as a resident we are very frustrated
with the amount of trash that is blowing in our yards and the amount of people that are now using our
yards as a cut through to get to the center. I asked him if they could get someone to please take care of
the amount of trash blowing in are yards and he responded "If I wanted a fence put up that I should put
one up myself!" I was furious that he would say such a thing. In return I will admit I told him it was not
my job and yes I used some language that I wasn't too proud to say but the time frame is becoming
unacceptable.
When I came home from work today, my husband and I walked back to where the fence was removed to
actually see if the footers had been dug. I have worked in the Construction Industry for many years and
it was very obvious that there has been NO progress made since the wooden fence was removed. I have
attached some photos that I took this afternoon with my digital camera. After you view these pictures
I'm sure you will agree you wouldn't want this in your backyard!
I realize Indian Ridge is not a "Winding Hollow" or "Park Stone" community and I could almost
guarantee if this took place by either of these two subdivisions the block wall would already have been
put in place. We do own our home and are very respectful residents of the community. We are very big
supporters of our local government officials and recently voted for all of you that hold an elected
position with the City of Winter Springs because we believe you do a great job for our City.
We are hoping to sell our house soon and look to purchase another home in Winter Springs but as you
can see with these pictures, I'm sure we would have a difficult time to try and get someone to buy with a
view like that! I hope that I can expect to receive a response from someone soon with a resolution to this
problem. I assure you I am not the only concerned resident.
