Anthony,
I will be glad to make sure this is always done this way from this point forward; however, I was not told
this before. Ordinances here have typically been "filed" as noted under 171.044 (3) which states "...shall
be filed with the clerk of the circuit court and the chief administrative officer of the county and Sec of
State etc.... - it does not say, "record with the Circuit Court and file with the administrative officer and
the Sec of State"... etc. Some of our Ordinances have been recorded and some have not. Should I go
ahead and get them all recorded? How far back do I go? Is this for any kind of Annexation?

Subject: Annexation Ordinances
Andrea, I want to make sure everyone is on the same page regarding the recording of annexation ordinances.
Recording is important because it effects the taxation of the annexed area and therefore, the revenues that the
City will receive for ad valorum taxes, communication taxes, etc. Each ordinance has instructions to the City
Clerk which require that annexation ordinance, upon adoption, to be filed with the secretary of state, sent to the
County manager, and filed with the clerk of court. Filing with the clerk of court means that you record the
annexation ordinance like you would a deed or development agreement including paying filing fees. Although I
have taken responsibility for recording development agreements, I have not done so with annexation ordinances
because your office arranges for signature and sealing of original ordinances, as well as maintaining them in an
ordinance book per Florida Statutes.
