Code enforcement is responsible for prosecuting all code enforcement cases. Therefore, code enforcement is responsible for preparing all the necessary paperwork in prosecuting code cases, including preparing and recording orders imposing liens. Code enforcement should also be creating and maintaining separate files for each code enforcement case. This file should contain ALL documents related to that case including the notice of violation, notices, liens, correspondences, code board agenda, code board orders, evidence, and other documents. These files should be indexed and kept in a central location (PD Department?) for future reference, 2. Once a code board lien is filed against a property, the lien belongs to the City Commission. Per the City Code, the City Manager can execute a satisfaction of code lien if the lien is paid in full. Any amount less than full payment must be brought to the code board for a recommendation to the City Commission. The City Commission has final decision making authority to satisfy code liens for less than the full amount. I don't know who is responsible for preparing and recording the satisfaction of liens. When brought to my attention, I have done so for both the city manager and city commission. Once the lien satisfaction is prepared and recorded, the original should eventually be filed in the relevant code enforcement case file for safekeeping. 3/21 /2005 Page 2 of 2 The bottom line, in my humble opinion, code enforcement is all about prosecuting cases. All documents should be maintained in specific case files which are centrally filed somewhere so they can be retrieved for future reference. It does not make sense, and will cause confusion, if case documents are filed in more than one location. Hence, again, my recommendation is that code enforcement documents be filed in specific case files at a central location. Further, in today's day, there must be a way to scan these documents into the computer, by case number, so the police department and the city clerk's office can access them. Please advise regarding how this works out. 3/21 /2005
