Dear Members of the Seminole County Land Planning Agency:
The undersigned is the City Attorney for the City of Winter Springs. On behalf of the
City of Winter Springs, the City objects to Seminole County proceeding with a
Comprehensive Plan Amendment to implement the Home Rule Charter Amendment that
was declared invalid by Judge Alley on December 6, 2004. Although Seminole County has
appealed Judge Alley's Order, the City of 'Winter Springs believes that it is totally
inappropriate for Seminole County to implement the Charter Amendment under the
circumstances. Since the Agenda Item presented to the Seminole County Land Planning
Agency ("LPA") does not mention the fact that Judge Alley declared the Charter
Amendment invalid, the City is providing the LPA with a courtesy copy of Judge Alley's
Order. We ask that this letter and a copy of Judge Alley's Order be included in the record
involving this proposed Comprehensive Plan Amendment.

Therefore, the City of Winter Springs respectfully requests that the LPA recommend
denial of an Ordinance that includes any attempt by Seminole County to implement the
Home Rule Charter Amendment.
