The City of Winter Springs and Seminole County agreed today to
have an expedited final trial regarding the City of Winter Springs'
challenge to Seminole County's proposed "Rural Area" Charter
Amendment.
The final trial will be held before the Honorable Judge Alley on
November 16, 2004.
As a result, the City of Winter Springs cancelled the temporary
injunction hearing which was scheduled for Friday, October 22, 2004.
The City of Winter Springs is challenging the proposed "Rural Area"
Charter Amendment because the City believes the proposed amendment
is unlawful and unconstitutional. Further, the ballot summary will mislead
the voters.
If the voters pass the Charter Amendment on November 2, 2004,
the City of Winter Springs believes the Charter Amendment would
adversely affect the home rule authority of each city in Seminole County to
govern their own local affairs.
Further, as a result of the expedited final hearing being scheduled,
the City has also agreed to dismiss the Seminole County Supervisor of
Elections from the lawsuit. The City dismissed the Supervisor and
cancelled the temporary injunction hearing to avoid having the City's
lawsuit impact the Supervisor of Election's responsibilities during this
year's presidential election.
