At that meeting, Commissioner Blake asked whether there was a statute of limitations that applies under the Bert Harris Property Rights Act. I have reviewed the Bert Harris Property Rights Act and there is a statute of limitations. Pursuant to Section 70.001, Florida Statutes, a cause of action may not be commenced under the Bert Harris Property Rights Act if the claim is presented more than one year after a law or regulation is first applied by the governmental entity to the pronerty at issue. Moreover, no cause of action exists under the Bert Harris Property Rights Act as to the application of any law that was enacted on or before May 11, 1995. *W The Honorable Paul P.
