I am in receipt of your October 10, 2000 letter to me and Pat Gleason, General Counsel of
the Attorney General's Office.
First, your statement that my October 5, 2000 letter suggests that the City and the Attorney
General's Office "have something to hide" is grossly in error. You will be permitted to inspect
and/or copy all the public records that you have requested from the City of Winter Springs.
My October 5, 2000 letter was for your benefit and was intended to seek clarification and to
be informative. Further, you were asked whether you agree to pay any statutory fees required for you
to inspect and/or copy the public records that you are requesting, if any. Your October 10, 2000
letter does not state any objection to paying such fees. Therefore, I take from your letter that you
will pay all such fees, if any. If you disagree, please advise me immediately upon receipt of this
letter because we will have to discuss this issue.

for actions taken by them on behalf of the City of Winter Springs. If my understanding is incorrect,
please advise me immediately upon receipt of this letter because your request will have to be further
clarified.
If I do not hear from you regarding the statutory fees and the extent of your request, the City
will proceed based on the understanding stated in this letter. As such, I will be requesting delivery
of the public records that you are requesting from the Florida League of Cities. I will also be
informing them that you have agreed to pay the statutory fees, if any.
For your information, as City Attorney, I do not have in my possession all litigation files
related to the City of Winter Springs which were compiled prior to my appointment last year.
However, my law firm, Brown, Ward, Salzman & Weiss, P.A., represented Mayor Partyka in the
recent lawsuit with Mr. Mikes, prior to my joining the firm. We will be happy to make that file
available for your inspection. The file will be at the City Clerk's office in the very near future for
your inspection. Please make arrangements with the City Clerk at your earliest convenience to view
the file. My firm will not be assessing any statutory fees, however, the City will assess fees for any
copying of public records that you request, in accordance with the City's Public Records Policy.
Lastly, there were many statements, suggestions, and opinions in your October 10, 2000 letter
in which I completely disagree. For brevity's sake, there is no conspiracy to keep public records
from you. It would suffice to say that the City has every intention of satisfying your request and
complying with the law.
You will be contacted by the City as the requested public records become available at City
Hall for your inspection and/or copying. _
