On April 24, 2000, the Governor approved C.S.H.B. No. 331. This new law is
relevant to collecting code enforcement liens.
Beginning with all code enforcement liens levied after October 7, 2000, the code
enforcement board may authorize the city attorney to sue to recover a money judgment for the
amount of any code enforcement liens plus interest. Prior to this change, the City's stile
remedy was to foreclosure on the lien. Similar to foreclosures, the money judgment
provisions do not apply to real or personal property which is covered under Sect it,I1 .t(A)-
Art.X of the Florida Constitution (Homestead). Further, if the City prevails in t)}1I:tt11111),
money judgment, it will be entitled to recover all costs, including attorneys fees.
