At the June 8, 1988 City Commission Meeting a discussion ensued concerning advisory board
appointments, and who among the Mayor, any Commissioner, and a particular Commissioner is
responsible under the City Code for making a nomination to fill a particular seat on a specified board.
The City Clerk's memorandum appeared generally correct under the Code and apparently also
reflected who historically had made the "prior" appointment to an office, which was now vacant or
fixed term expiration.
No code irregularities appear to exist.
The purpose of this memorandum is to follow up on the consensus request for a review of the
City Code requirements for the Board Appointments discussed last meeting.
To clarify this issue, I present below a synopsis of the City Code provisions relating to the
mode of appointment and attach the applicable City Code provision(s).
BEAUTIFICATION BOARD
City Code Section 2-77 deals with the size (7 members) and appointment (five (5)
members appointed by the City Commissioner and two (2) members appointed by
the Mayor). Terms of appointment are three (3) years.
Conclusion:
Commissioners appoint five (5) members; Mayor appoints two (2) members.
2. BOARD OF ADJUSTMENT
Ci Code Section(s) 20-77 and 20-78 deal with composition (five (5) member) and
appointment ("....... and each appointment by the representative Commission member
occupying the corresponding numbered sent......"). Term of service on Board of
Adjustment is two (2) years per Section 20-78, attached.
Conclusion:
Each Commission gets one appointment to Board of Adjustment per City Code.
BOARD OF TRUSTEES - PENSION PLAN
City Code Section 14-52 provides for appointment by resolution of the five (5)
member Board of Trustees. Each Commissioner shall have one appointment to the
Board. The term of the Board member is three (3) years and a member may be
removed at any time by a majority vote of the City Commissioner.
Conclusion:
Each Commissioner shall have one appointment to the Board.
4. CODE ENFORCEMENT BOARD
Ci1y Code Section 2-57(a) provides for a seven (7) member Board "to be appointed
by the City Commission". Section 2-57(b) provides for a three (3) year term.
Conclusion:
Appointments are to be by the City Commission but are not allocated to any
Commission seat.

5. PLANNING AND ZONING BOARD
Section 20-52 06 of the City Code provides for a five (5) member Board "having
designated seats one (1) through five (5) with such members corresponding with the
Commission seat". Term of office for Planning and Zoning Board member shall be
two (2) years per Section 20-53.
Conclusion:
Vacancies on the Board may be filled by the Commission member whose seat number
corresponds with the. vacant planning and zoning board seat subject to Commission
ratification..
6. COMMERCE AND INDUSTRY DEVELOPMENT BOARD
Section 2-71 of the CiCode provides for a seven (7) member Board with five (5)
members appointed by the City commission, with the Mayor and City Manager serving
as ex -official members. The term of Board membership is three (3) years.
Conclusion:
Seven (7) member Board with five (5) members appointed by City Commission, with
Mayor and City Manager also serving.
