Task No. 20-1 Central Winds Park Roadway Imporvement - Final Design and Permitting- 2008 09 10 TASK No. 20®1 (Amendment to Task 20: Central Winds Park Roadway Improvements Conceptual Analysis) TO CIVIL ENGINEERING CONTINUING SERVICES CONTRACT DATED SEPTEBER 10, 200 FOR THE CENTRAL WINDS PARK ROADWAY IMPROVEMENTS FINAL DESIGN AND PERMITTING BETWEEN THE CITY OF WINTERSPRING AN CPH, INC. This Task dated September 15, 2014, by and between the City of Winter Springs(hereinafter called the OWNER) and CPH, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Task to the Agreement dated September 10, 2008, between the parties, herein setting forth the scope, terms and conditions of the services herein authorized. The appropriate provisions of the Agreement apply as fully as if repeated herein. SECTION 1 GENERAL 1.1 The purpose of this Task is to provide Engineering Services, more specifically itemized herein, in the preparation of the Final Engineering Plans based on the approved conceptual roadway improvements prepared during Task 20: Central Winds Park Roadway Improvements Conceptual Analysis. SECTION 2 BASIC SERVICES OF THE ENGINEER 2A GENERAL 2.1 A The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. Z 1.2 The ENGINEER will serve as the OWNER'S professional engineering representative in those phases of the project to which this Task applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and City Engineer and will submit interim plans and or reports to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the plans and specification for the roadway improvements to Central Winds Parkway and Orange Ave 3.1.1 Stormwater The proposed roadway will be an urban section with a closed drainage system. The ENGINEER will design the stormwater conveyance system to ensure proper inlet spacing and pipe sizing to adequately convey the stormwater to the appropriate pond. The ENGINEER will modify existing ponds to accommodate the additional stormwater treatment and attenuation as required by St Johns River Water Management District (SJRWMD) in order to obtain the SJRWMD Environmental Resource Permit. Ponds proposed to be modified include the two dry ponds located immediately west of the Central Winds Park parking area and the Jessup Landing ponds adjacent to Orange Avenue. 3.1.3 Right of Way For purposes of this proposal, the proposed roadways will remain within existing right- of-way or City owned land, therefore no acquisition of new right-of-way will be required and no easements will be required, 3.1.4 Traffic Study/Engineering No traffic studies or engineering is anticipated for this project. 3.1.5 Survey The ENGINEER will perform a Topographic Survey as per Rule Chapter 5J-17 of the Florida Administrative Code in compliance with the minimum technical standards of surveying and mapping of the State of Florida. Topographic grid at 50 foot cross-sections within the proposed roadway area (Central Winds Pkwy extension and Orange Ave.) 50 foot topographic grid of the project areas east and west of the proposed roadway to obtain ponds, parking, and other topographic data to support the design. Location of existing visible above ground improvements & visible utilities within project area. Locate trees within the scope with a 3" diameter at breast height (dbh) and above within project area. ® Set site benchmarks. • Signed and sealed survey. Optional Service: The ENGINEER will perform research to identify the Right-of-Way along Orange Ave. The ENGINEER will review Seminole County Right-of-Way Department records and review official plats in Clerks office for Right-of-Way modifications for additional and vacated Right-of-Way documents. 3.1.6 Soils The ENGINEER will utilize a subconsultant (Terracon) to perform the recommended soils investigation and pond permeability to support the roadway and stormwater design. Please refer to the proposal prepared by Terracon attached. 3.1.7 Landscape Architecture Landscape Architecture will assist with the preparation of landscape, irrigation, and hardscape features for the project. Landscape/Hardscape features to be designed along Central Winds Parkway extension and within the proposed traffic circle. 3.2 DATA COLLECTION AND ANALYSIS ® Obtain and review previous stormwater permits for Central Winds Park, Jessup Landing, Orange Ave, and other adjacent projects. • Record drawings from the OWNER for Central Winds Park • Record drawings from the OWNER for any utility improvements within the project limits • Record drawings from the OWNER of any improvements within this roadway area for private development. • Field visit after receipt of all drawings to clarify any questions. 3.2 DESIGN CPH will use the available data and record drawings available, the proposed concept plans, and the previously designed Orange Ave plans as the basis of the new design. CPH will perform the following Tasks related to the design requested by the City: Task 1 — Obtain topographic survey and geotechnical data as described above. Task 2—Prepare final engineering plans(11"x17") at I"=40'scale with plan and profile view sheets, Plans will include: Cover sheet General Notes Typical Sections Plan and Profile Sheets Roadway Cross Sections Traffic Circle Detail Sheets Pedestrian Crossing Details Signing and Striping Plan Stormwater Pond Detail Sheets Site Plan Sheet (Parks Dept Portable Bldg) Miscellaneous Detail Sheets (as needed) Landscape/Hardscape Plans Landscape/Hardscape Details Task 3—Submit 60% for review and comment. Meet to discuss comments and make changes requested. Task 4— Prepare application to and submit to SJRWMD for Environmental Resource Permit(Respond to RAls as necessary) Task 5— Prepare specifications for review by the OWNER. Task 6—Prepare and submit an opinion of probable construction cost at the 60%, 90% and Final design phases. Task 7 — Submit final plans and specifications to OWNER for review and approval. Meet to discuss comments and make changes requested. Task 8 - After design is approved, provide the OWNER with one signed and sealed copy and an electronic version in PDF format of the plans for bidding. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4A If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER. 4.1.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. 4.1.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Task. 4.1.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.1.4 Additional engineering services required by revisions to regulations (after the date of this Task) as applicable to the Florida Department of Environmental Protection,the St. Johns River Water Management District, or other regulatory agency requirements. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER'S representative with respect to the work to be performed under this Task, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER'S policies and decisions pertinent to the work covered by this Task. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Task. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 Provide personnel to locate facilities and mow,trim, or otherwise make them accessible for inspection. 5.1.5 Examine all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. 5.1.6 Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. 5.1.7 Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, soils investigations if advised in writing by the ENGINEER that they are necessary or advisable. 5.1.8 Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense, necessary additional services as stipulated in Section 4 of this Task, or other services as required. 5.1.9 Provide such legal, accounting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. 5.1.10 Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PAYMENT Payments for services and expenses of the ENGINEER to be as set forth below: 6.1.1 Principals and Employees of the ENGINEER. 6.1.2 The fee for the engineering design scope of services described herein will be provided for a lump sum fee of$ 66.305.20 for the basic services, broken down as follows: Basic Services: 1. Survey 1.a Topographic Survey $ 7,780.00 1.b Right-of-Way Research (Optional) $_ 4,670.00 2. Geotechnical (Sub) $ 5,690.00 3. Final Design and Specifications $ 47_,950.00 4. Estimated Expenses $ 215.20 TOTAL BASIC SERVICES $ 66,305.20 6.2 REIMBURSED EXPENSES 6.2.1 The OWNER will make prompt monthly payments in response to ENGINEER'S monthly statements without retention for all categories of services rendered under this Task and for reimbursable expenses incurred. 6.2.2 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.3 will be computed at a rate of$650.00 per day or any portion thereof(but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed on an hourly rate). 6.2.3 If this Task is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under this Task shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.2.4 The ENGINEER shall promptly begin work on the services authorized by this Task upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Task are made on the basis of his experience and qualifications and represent his best judgment as a design professional familiarwith the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Task and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Task. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed. The purpose of the exploration is to obtain geotechnical engineering data to assist in the design of the proposed roadway improvements at the above-referenced site. This proposal outlines our understanding of the project, presents a recommended scope of services, and contains a time and cost estimate for providing those services. A. SITE AND PROJECT DESCRIPTION The project site is located at the existing Central Winds Park at 1000 Central Winds Drive in the City of Winter Springs, Florida. The proposed project consists of an approximate 750 Lf. extension of Central Winds Drive, reconstruction of approximately 1,200 Lf. of Orange Avenue, and an approximate 400 Lf. extension of Orange Avenue, The expansion of existing and/or addition of stormwater ponds may also be included. B. GEOTECHNICAL SCOPE OF SERVICES Terracon will perform a geotechnical investigation to facilitate design of the proposed improvements and construction of the Project. N Mobilization of truck drill rig and crew to the site. E Perform a total of eight (8) shallow manual auger borings to depths of about 5 feet within the proposed roadway areas. Perform up to three (3) machine auger borings to a depth of about 20 feet in the proposed stormwater pond areas. Obtain up to two (2) bulk samples for laboratory permeability testing. Perform visual classification and appropriate laboratory testing of the soil samples obtained from the borings; as well as laboratory permeability testing on the obtained bulk samples. The exploration will be supervised by a qualified Geotechnical Engineer registered in the State of Florida, and the results of the exploration will be presented in a geotechnical engineering report. The report will address the following items: Existing site conditions. Exploration, testing and sampling methods. Subsurface soil conditions encountered and soil classification. ru Depth to groundwater at the time of the exploration and estimated seasonal high groundwater levels. A discussion of general site preparation techniques, fill compaction, fill suitability, etc. Geotechnical design parameters to assist in pond design. General recommendations for pavements. Following preparation of roadway plans and profiles, we can review proposed roadway grades for potential underdrain requirements. C. GEOTECHNICAL PROJECT SCHEDULE Based on our present schedule, we are prepared to mobilize to begin the field operations on this project within about one (1) week of your authorization to proceed. We anticipate the field portion of the study to be completed in approximately two (2) to three (3) days. Engineering analysis, necessary laboratory work, and report preparation should be completed within approximately two (2) weeks after the completion of field work. COMPENSATION A Scope of Services and Proposed Fee for geotechnical services is attached to this proposal and will be applicable for services on this project. Our not-to-exceed fee for geotechnical services for the described exploration is $5,690.00. In computing this budget figure, we have assumed the site is accessible to our field crew, that we have right of entry to the site, and that we will not experience excessive delays due to rubble at borehole locations or for other reasons beyond our control. If such conditions are encountered that could cause the cost of the exploration to exceed the budget figure, we will notify the client and obtain approval for the additional work before we proceed.
