Task Order No. 6 SJRWMD Reclaimed Information - 2017 10 24 a re TASK ORDER 6 TO AGREEMENT DATED February 19,2015 CONSULTING ENGINEERING SERVICES FOR SJRWMD Reclaimed Information BETWEEN THE CITY OF WINTER SPRINGS AND CPH, INC. This Task Order, dated October 24 2017 by and between the City of Winter Springs (hereinafter called the OWNER) and CPH, Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Task Order based on Agreement for Engineering Services dated February 19, 2015. The appropriate provisions of the Agreement apply as fully as if repeated herein. B SECTION 1 GENERAL 1.1 The .purpose of this Task Order is to 'provide for Engineering Services, more specifically itemized herein, in the preparation of data for the SJRWMD Reclaimed Information-2017 letter request. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER's professional engineering representative in those phases of the project to which this Task Order applies, and will give consultation and advice to the OWNER during the performance of his services. The ENGINEER will perform the services for the City Commission under the general supervision of the City Manager and will submit interim plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL A detailed scope of services, Exhibit A, and a manpower plan, Exhibit B are attached. SECTION 4 SUPPLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGINEER will furnish or obtain under subcontracts, supplementary services which will be paid for by the OWNER, such as preparing Landscape or Hardscape plans. 4.1.1 Additional services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as A described herein. 4.1.2 Additional services in connection with the project including services normally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Task Order. 4.1.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.1.4 Additional engineering services required by revisions to regulations (after the date of this Task Order) as applicable to the Florida Department of Environmental Protection, the St. Johns River Water Management District, or other regulatory agency requirements. 4.1.5 Provide, through a subconsultant, additional surveying services if required or requested by the OWNER. 4.1.6 Provide, through a subconsultant, soils investigation services if required or requested by the OWNER. SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5.1.1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER's representative with respect to the work to be performed under this Task Order, and such person shall have complete authority to transmit instructions, receive information, interpret and define the OWNER's policies and decisions pertinent to the work covered by this Task Order. 5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform his work under this Task Order. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them accessible for inspection. 5.1.5 Examine,all studies, reports, sketches, and other documents presented by the ENGINEER and render decisions pertaining thereto within a reasonable time so as not to delay the work of the ENGINEER. 5.1.6 Obtain approval of all governmental authorities having jurisdiction over the project, and such approvals and consents from such other individuals or bodies as may be necessary for completion of the Project. 5.1.7 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, necessary additional services as stipulated in Section 4 of this Task Order, or other services as required. 5.1.8 Provide such legal, accounting, and insurance counseling services as may be required for the project and such auditing services as the OWNER may require. 5.1.9 Give prompt written notice to the ENGINEER whenever the OWNER observes or otherwise becomes aware of any defect in the Project. SECTION 6 PAYMENT 6.1 PAYMENT Payments for services and expenses of the ENGINEER to be as set forth below: 6.1.1 The fee for the scope of services described herein will be provided as an Lump Sum Fee of two thousand, two hundred and thirty-five dollars ($2,235.00). Miscellaneous reimbursable expenses are included. 6.1.2 The OWNER will make prompt monthly payments in response to ENGINEER's monthly statements without retention for all categories of services rendered under this Task Order and for reimbursable expenses incurred. 6.1.3 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.4 will be computed at a rate of$650.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed in accordance with the funding levels as set forth in Paragraph 6.1.1 and 6.2.1 herein). 6.1.4 If this Task Order is terminated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 and 6.2.1 on account of that and all prior work under this Task Order shall be due and payable, and shall constitute total payment for services rendered. In addition, upon termination, the ENGINEER shall be paid for any Additional Services authorized and rendered under Section 4. 6.1.5 The ENGINEER shall promptly begin work on the services authorized by this Task Order upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost of labor, materials, or equipment, or over any construction contractor's method of determining prices, any opinions of probable construction cost which may be provided in the services of this Task Order are made on the basis of his experience and qualifications and represent his best judgment as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executors, administrators and assigns to the other party of this Task Order and to partners, successors, executors, administrators, and assigns of such other party in respect to all covenants of this Task Order. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefits hereunder to anyone other than the OWNER and the ENGINEER. SECTION 8 EXECUTION OF PROJECT 8.1 The ENGINEER agrees to prosecute the work in a timely manner until the Project is completed. The SJRWMD form is required to be submitted by November 17, 2017. To be able to respond to SJRWMD with appropriate data by November 17, 2017, we will approach this project by using the available 2040 population projection data from the 2017 Water Supply Plan. We have population projections through 2040 for Winter Springs as a whole from the Water Supply Plan. This will be used as a comparison with data described below. We will perform the following: 1) Delineate the separate service areas for East and West based on the City wastewater collection/transmission map. No map will be created, this will be for internal use only. 2) Determine population for each WRF service area. We have a spreadsheet from the Winter Springs Planning Department that identifies the number of units in each development within the City of Winter Springs. We will verify the spreadsheet data by utilizing the City Service area map and counting individual lots. We will use the City data for multi-family as we cannot count units from the map. 3) Based on census data, Winter Springs has 2.63 people per single family household and apartments have 1.5 people per household. We will use this data and the unit count method of item 2 above, to determine the population in each WRF service area. 4) Prepare an analysis of the un-sewered areas within each WRF service area. Take the water population projections and subtract the un-sewered (septic systems) population (TBD based on unit count on the map). This will yield an equivalent sewered population that will be compared to the unit count data. 5) Analyze and tabulate the Average Annual Daily Flow (AADF) to each WRF for the past five years based on DMR's. 6) Determine a five-year average per capita flow for each WRF. 7) Determine/estimate 2017 WRF flows from the DMR's for each facility. 8) In the Water Supply Plan, we identified a population growth of 2160 persons from 2017 to 2040 based on City data. Identify how much of this is East WRF or West WRF population growth based on the data in the spreadsheet from the planning department. Take the population growth for each WRF times the five-year average per capita flow and add the calculated flow to the 2017 AADF of each WRF. This will yield a wastewater flow for each facility in 2040. 9) Compare the sum of the two WRF's to the water data for verification of assumptions. 10)Analyze the five-year historical reuse consumption based on City data. It is our understanding that the reuse distribution system will not be expanded. Therefore no additional use will be projected. 11)Review the City's wastewater service area as shown in the "Wastewater Treatment Areas in CFWI Map Viewer" and verify that it reflects the current service area and the 2040 service area. if not, the City will provide a GIS shapefile to SJRWMD. 12)Estimate, with the help of staff, planned conservation or inflow/infiltration reduction projects and their effects on future flow. SJRWMD Request Form - Projected Flows The CFWI Reclaimed Water Data Request Form requires the following information for each WRF for 2040: 1) Total Treated Wastewater -TBD by the analysis. 2) Supplemental Water—For this, we will report the Lake Jesup Augmentation Water CUP numbers. 3) Water Reuse—We will report the five-year historical reclaimed water average per WRF. 4) Reclaimed water Imported form another utility/facility—this will be zero. 5) Reclaimed water Exported form another utility/facility—this will be zero. 6) Wastewater Disposal—This will be based on the WRF DMR's. SJRWMD Re guest Form - Projected Reuse T es The CFWI Reclaimed Water Data Request Form requires the following information for each WRF for 2040: 1) Residential Irrigation and Other Public Access Areas—This will be equal to the five-year historical average for each WRF. 2) Golf Courses -This will be equal to the five-year historical average for each WRF. 3) Agricultural Irrigation -this will be zero. 4) Sprayfields —This will be based on Winter Springs data. 5) Ground Water Recharge (including RIBS)-This will be based on Winter Springs data. 6) Indirect Potable Reuse -this will be zero. 7) Industrial- this will be zero. 8) Wetlands -this will be zero. 9) Other(Ex. The St. Johns River Water Management District(SJRWMD) is updating the Regional Water Supply Plan for the Central Florida Water Initiative (CFWI). Wastewater and reclaimed projected flow for 2040 is required. Our proposal includes assistance to the City of Winter Springs to generate the information requested and to complete the form received from SJRWMD. Task Order # 6 is attached and contains the Scope of Services, Exhibit A, and a Manpower and Fee Estimate, Exhibit B. Payment for our services will be in accordance with our existing Continuing Services Contract. We propose to provide the services for a lump sum amount of $2,235.00 including reimbursable expenses. We agree to work closely with you under your general direction and control, keeping you apprised of progress on the project.
