The Regular Meeting of Tuesday, August 27, 2019 of the Code
Enforcement Board was called to Order by Chairperson Matthew
Criswell at 5:30 p.m. in the Commission Chambers of the Municipal
Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.

A moment of silence was held followed by the Pledge of Allegiance.
No changes were made to the Agenda.
City Clerk Andrea Lorenzo-Luaces swore in those who would be
providing Testimony during tonight's Meeting - Captain Matt Tracht,
Support Services Bureau, Police Department and Respondent Ms. Koree
Hyman -Robinson.

Inspector: Captain Matt Tracht
Captain Matt Tracht, Support Services Bureau, Police Department
introduced this Case and testified, "This stemmed from complaints we
were getting, especially through the Commission, about all the blue
tarps, the extended blue tarps that were on the roofs of residents
throughout the city.

So, May 14, 2019 while on patrol, I observed that weathered blue tarp
affixed to the roof of this residence. The condition of these particular
tarps clearly indicated that it's been there for an extended period of time.
IPMC [International Property Management Code] states that the roof
shall be sound, tight, and not have any defects that admit rain. Notice of
Code Violation was mailed out, Certified, Return Receipt with the
correction date of July 16, 2019 which was sixty (60) days from the time I
initiated it."
Photographs were shown on from "WS -V with further comments.
Continuing, Captain Tracht explained, "The Notice of Code Violation was
returned unclaimed on June 7t", it was set for the Code Board, and it was
posted, mailed, certified and posted here at City Hall. Tracking history
shows August 9t" that Notice was left by USPS [United States Postal
Service], it was still not claimed, and to this date it has still not claimed."
Additional photographs were shown from "WS -1."
Captain Tracht then stated, "This is a picture as of today, this afternoon,
nothing has changed on this residence. As of today, it's been returned
unclaimed. I recommend the owner be held in Violation of [International
Property Management Code] 304.7 and be given to October 26, 2019 to
come into Compliance; if not a Fine of two hundred and fifty dollars
($2S0.00) per day be applied; and that's essentially another sixty (60)
days."
Note: The Respondent was not present.
I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
[INTERNATIONAL PROPERTY MANAGEMENT CODE] AND ORDER
THAT RESPONDENTS BE GIVEN UNTIL OCTOBER 26, 2019 TO
CORRECT THE VIOLATION. IN THE EVENT RESPONDENTS FAIL TO
COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF TWO HUNDRED

Inspector: Captain Matt Tracht
This Case was introduced by Captain Tracht who testified, "On May 20th
while on patrol, I observed the blue tarps on this house. It's not like the
others where it was weathered, but IPMC says the same thing, shall be
sound, tight, and not have any defects. Notice of Code Violation was
mailed with a correction date of July 23, 2019, 60 days."
Further, Captain Tracht noted, "On this house the whole roof seems to
be tarped. The Notice of Code Violation Letter was returned unclaimed
on June 14th. It was set for Code Board, letter was mailed, posted at the
residence and City Hall. At that point, I was in contact with the owner,
we had a discussion on the phone and her Code Board letter was
accepted on August 9th which she signed for."

Captain Tracht added, "As of today this is what it looks like, no change.
Same thing, I recommend the owner found to be held in Violation of
[International Property Management Code] 304.7 and given until
October 26, 2019, unless there's some type of exigent circumstance
where she needs a longer date, to come into Compliance; if not the Fine
of two hundred and fifty dollars ($250.00) per day."

Chairperson Criswell invited the respondent to address the Code
Enforcement Board.
Ms. Karee Hyman -Robinson, 223 Sherry Avenue, Winter Springs, Florida:
stated, "I did speak to Captain Tracht. I did let him know that
unfortunately I went through a third -party company, adjuster, to get the
roof fixed and also I had other issues with the home. They're taking
longer that expected and he suggested that he'll ask for sixty to ninety
(60-90) days.
I did sign the contract with them, so the only thing that is left is for the
insurance to send the check out and I would need to get it processed. I
did get an estimate on the roof by more than one (1) roofer and so I do
have options as to who I would want to fix my roof. It's just taking a little
bit of time and so I'm asking if I could get a little bit more than sixty (60)
days just in case. I don't know how long because it's really been drawn
out and I am trying to get in touch with the adjusters to find out what is
going on and why it's taking so long.
So, at least ninety (90) days, the minimum. I am asking for. Although the
roofers I talked to, they did tell me it doesn't take long to get it fixed,
within a day or two (2)."
Vice -Chairperson Maurice Kaprow asked about the Respondent having
a contract to which Ms. Hyman -Robinson responded that she was
waiting for a check from the insurance company before any work would
begin.
Board Member Dennis Robinson asked when the claim was approved to
which Ms. Hyman -Robinson responded that she was unsure but was
willing to share documents she had brought.
Chairperson Criswell noted that the Respondent would still need to get
permits and recommended giving the respondent 120 days to come in
to compliance which would be December 23,d with Code Enforcement
going to look at the property.
Captain Tracht stated, "I would not be opposed to that."

Senior City Attorney Jennifer Nix noted that the Board may want to wait
to get the referenced document or may not even wish to take the
document in to evidence.
Discussion followed regarding December 23rd, 2019 as a date by which
the property would need to be in compliance and that Captain Tracht
would be responsible for checking on the property at that time and
bringing back a Non -Compliance Case if necessary.
