HomeMy WebLinkAbout2019 03 25 Public Hearings 401 Setback Waiver for 677 Cayuga DriveCOMMISSION AGENDA ITEM 401 REQUEST: Informational Consent Public Hearings X Regular March 25, 2019 KS TM Regular Meeting City Manager Department The Community Development Department requests the City Commission hold a public hearing for the approval of a waiver to Section 20-253(e)(2)(iv) of the City Code of Ordinances, which requires a corner yard setback of 25 feet. The applicant is requesting the waiver in order to construct an attached walk-in closet approximately 19 feet from the corner yard setback in lieu of the required 25 feet. The subject property is located at 677 Cayuga Drive, at the southwest corner of Cayuga Drive and Saranac Drive. SYNOPSIS: The City of Winter Springs Community Development Department received an application for a Waiver for setbacks, for the addition of a walk-in closet at 677 Cayuga Dr., located on the southwest corner of Cayuga Dr. and Saranac Dr. CONSIDERATIONS: APPLICANT AND PROPERTY INFORMATION: Applicant/Property owner's name(s): Benjamin and Jennifer Smith Property addresses: 677 Cayuga Drive, Winter Springs, Florida Property Parcel ID numbers: 08-21-31-5HS-0000-0770 Current FLUM Designation: Residential Current Zoning Designations: PUD Public Hearings 401 PAGE 1 OF 3 - March 25, 2019 Previously Approved Development permits such as conditional use, waiver, or variance (if any): Not Applicable Development Agreements (if any Not applicable Pending Code Enforcement Actions (if any). Not applicable City Liens (if any): Not applicable APPLICABLE LAW, PUBLIC POLICY, AND EVENTS: Home Rule Powers Winter Springs Code of Ordinances City of Winter Springs Comprehensive Plan DISCUSSION: Preliminary Site Plans The homeowners propose to fully enclose an area of their side yard that is currently delineated by a concrete wall. The wall appears to be original to the house and was built in the setback. Staff recommends approval as it would cover an existing, blank concrete wall in siding to match the house. Approval would also mirror the existing code in R-lA districts where a 15 foot side yard FISCAL IMPACT: Approval of the Waiver will allow the property owner to add additional living area to their home, which may result in a minimal increase in revenue to the general fund. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at six (6) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff and the Planning and Zoning Board found the request consistent with the Public Hearings 401 PAGE 2 OF 3 - March 25, 2019 Comprehensive Plan and all other applicable sections of the City Code and unanimously recommended approval of the Waiver to Section 205-25(e)(2)(iv) in order to construct an addition approximately 19 feet from the corner yard setback in lieu of 25 feet.
