Regular Meeting City Manager Department
The Community Development Department requests the City Commission approve:
1) the Tuskawilla Crossings Phase 1 plat; 2) an associated Developer's Agreement
Amendment; and 3) Resolution 2018-15, and authorize these documents to be recorded,
subject to satisfaction of the conditions of approval.
SYNOPSIS:
Tuskawilla Crossings is a 379 -unit single-family residential subdivision by Lennar Homes
located southeast of the SR 434 / Tuskawilla Road intersection. Final Engineering Plans,
Aesthetic Review documents, and a Developer's Agreement were approved by the City
Commission on April 24, 2017, and the sitework is currently under construction. The
owner/developer, Standard Pacific of Florida (Lennar Homes), is seeking City approval to
record the phase 1 plat, Developer's Agreement Amendment, and Resolution 2018-15.

City of Winter Springs Code of Ordinances, Chapter 9, Land Development
DISCUSSION:
Tuskawilla Crossings is a proposed 379 -unit single-family residential subdivision by
Lennar Homes (formerly CalAtlantic Homes) located southeast of the SR 434 /
Tuskawilla Road intersection. The total project area is approximately 133 acres and
includes a central amenity area and a 3.2 -acre commercial outparcel at the north end of the
subdivision. An Annexation Agreement was approved by the City Commission in May of
2014 which requires the property to be developed in conformance with the Town Center
District Code.
At the April 24, 2017 City Commission meeting, the Commission approved the Final
Engineering plans, Aesthetic Review, and a Developer's Agreement. Sitework
construction commenced in May 2017 and is nearing completion. Phase 1 of Tuskawilla
Crossings consists of 189 single-family lots in four different lot sizes.
Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various
sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the
plat be fully executed by the owner(s) of record, by all mortgagees having an interest in
the land to be subdivided, by the professional surveyor and mapper of record, and by the
independent professional surveyor and mapper who reviews the plat for consistency with
Chapter 177, Florida Statutes. City Staff, including the City's independent surveyor,
Southeastern Surveying and Mapping Corporation, have reviewed and approved the plat,
subject to the conditions noted below.

The Developer's Agreement Amendment is necessary to document a total of seven (7) lots
that exceed the 175 -foot maximum lot depth in the T3 Transect of the Town Center Code.
The previously approved and recorded Developer's Agreement identified three of these
lots (#'s 27, 28, and 29). Review of the plat identified four additional lots (#'s 134, 135,
230, and 23 1) that exceed the 175 -foot lot depth.
Resolution 2018-15 formally vacates the pre-existing rights-of-way on the Tuskawilla
Crossings Phase 1 property, with the exception of the Old S.R. 434 right-of-way, which
will remain a City right-of-way. The pre-existing rights-of-way are being vacated and
replaced with the new Tuskawilla Crossings street network.
The Phase 1 plat approval shall be subject to satisfaction of the open comments listed in
Attachment 2, as determined by City Staff, prior to recording.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional

RECOMMENDATION:
Staff recommends the City Commission approve the Tuskawilla Crossings Phase 1 plat, the
associated Developer's Agreement Amendment, and Resolution 2018-15, subject to
satisfaction of the conditions of approval, and authorize the City Manager and City Attorney
to prepare and execute any and all applicable documents.

Plat Comments to be Cleared Prior to Recordi
Title Report
• The Temporary Utility Easement and Irrigation Easements between Standard Pacific and
Schrimsher Land Fund should show on the plat.
• Provide verification that the Declaration of Restrictive Covenant by L.D. Plante, Inc. and FDEP has
been complied with, including any necessary FDEP approval(s)
Dedication
• Drainage easements must be reviewed in detail to determine which ones should be dedicated to
the public and maintained by the City. Currently, the dedication language reads as if all drainage
easements, including swales in between lots, are dedicated to the public and are to be maintained
by the City. The Plat Notes will also have to be changed in accordance with our conclusion to
address this issue.
Plat Notes
• Plat Note 9: Should state that Tracts .... Are designated common areas as defined in the
Declaration "and are to be owned and maintained by the Association."
• Plat Notes 7, 9, 13, and 14 all dedicated utility easements without saying to which entity they are
being dedicated. Clarify if they are being dedicated to the City.
• Plat Note 10: Sidewalk is to be maintained by the HOA or the City?
• Plat Note 16 should say: "All landscaping, irrigation, hardscape improvements and other
decorative features within this Plat's Right -of -Ways shall be maintained by the Association or
adjacent lot owner as defined in the Declaration in accordance with the Use and Maintenance
Agreement recorded at Official Records Book_, Page _ of the Public Records of Seminole
County, Florida."
Other
• There are a number of places where "5.00 Typ" appears, without saying what it is. The Developer
will have to label if this is a DE (drainage easement) or UE (utility easement).

THIS AMENDMENT TO DEVELOPER'S AGREEMENT (the "Amendment") is
made and executed this day of July, 2018, by and between the CITY OF WINTER
SPRINGS, a Florida Municipal Corporation (the "CITY"), whose address is 1126 East S.R. 434,
Winter Springs, Florida 32708, and STANDARD PACIFIC OF FLORIDA, a Florida general
partnership ("DEVELOPER"), whose address is 444 West New England Avenue, Suite 220,
Winter Park, Florida 32789.
WITNESSETH:
WHEREAS, the CITY and DEVELOPER entered into that certain Developer's
Agreement ("Agreement") dated April 24, 2017, and recorded in Book 8939, Page 457, Official
Records of Seminole County, Florida, with respect to the development of that certain real
property located in Seminole County, Florida and more particularly described on EXHIBIT "A
which is hereby frilly incorporated herein by this reference (the "Property"); and
WHEREAS, DEVELOPER and CITY desire to amend the Agreement as more
particularly set forth below.
NOW THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties mutually agree as follows:
1.0 Recitals. The foregoing recitals are true and correct and are hereby incorporated
herein by this reference.
2.0 T-3 Zoning Lot Depths. Section 13.0 (c) of the Agreement is hereby deleted in
its entirety and the following is inserted its place and stead:
(c) T3 Zoning Lot Depths. The CITY's Code for Town
Center T3 transect zoning provides that lot depths shall not exceed
one hundred seventy five (175) feet. The CITY agrees that lots 27,
28, 29, 134, 135, 135, 230 and 231, as depicted on EXHIBITS "D -

1'; "D-2" AND "D-3" attached hereto and incorporated herein
shall be permitted to have maximum lot depths not to exceed two
hundred sixty five (265) feet.
3.0 Full Force and Effect. Except as modified herein, in all other respects the
Agreement shall remain in full force and effect.
4.0 Effective Date. This Amendment shall become effective upon approval by the

5.0 Recordation. This Agreement shall be recorded in the Public Records of
Seminole County, Florida.

A RESOLUTION OF THE CITY COMMISSION OF
WINTER SPRINGS, FLORIDA; VACATING PRE-
EXISTING RIGHTS-OF-WAY, EXCEPT THE OLD SR 434
RIGHT-OF-WAY, WITHIN THE PORTIONS OF D.R.
MITCHELLS SURVEY OF THE LEVY GRANT, GARDENA
FARMS, GARDENA FARMS TOWN SITES, AND PHILLIP
R. YONGE GRANT PLATS THAT ARE REPLATTED BY
THE TUSKAWILLA CROSSINGS PHASE 1 REPLAT;
PROVIDING FOR THE REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS, RECORDING,
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs has been asked to
consider vacating pre-existing rights-of-way, except the Old SR 434 Right -of -Way, within the
portions of the D.R. Mitchells Survey of the Levy Grant, Gardena Farms, Gardena Farms Town
Sites, and Phillip R. Yonge Grant Plats that are being replatted by the Tuskawilla Crossings Phase
1 Replat; and
WHEREAS, the D.R. Mitchells Survey of the Levy Grant, Gardena Farms, Gardena Farms
Town Sites, and Phillip R. Yonge Grant Plats are recorded in Plat Book 1, Page 5; Plat Book 6,
Page 23; Plat Book 6, Page 39; and Plat Book 1, Page 36, respectively; and
WHEREAS, the City of Winter Springs does not currently use, nor has any plans to use,
the subject rights-of-way; and
WHEREAS, to the best of the City's knowledge, no other public utilities are currently
utilizing such rights-of-way; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds
this Resolution is in the best interests of the public health, safety, and welfare of the citizens of
Winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by
this reference as legislative findings of the City Commission of Winter Springs.
Section 2. Vacation of Rights -of -Way. The City Commission of the City of Winter
Springs hereby vacates the pre-existing rights-of-way, with the exception of the Old SR 434 Right -
of -Way, within the portions of D.R. Mitchells Survey of the Levy Grant as recorded in Plat Book 1,
City of Winter Springs

Page 5; Gardena Farms as recorded in Plat Book 6, Page 23; Gardena Farms Town Sites as
recorded in Plat Book 6, Page 39; and Phillip R. Yonge Grant as recorded in Plat Book 1, Page 36,
Public Records in and for Seminole County, Florida, that are replatted by Tuskawilla Crossings Phase
1 Replat.
Section 3. City Clerk to Record. Following adoption of this Resolution and upon
the effective date, this Resolution shall be recorded by the City Clerk in the Official Records for
Seminole County, Florida.
Section 4. Repeal of Prior Inconsistent Resolutions. All other prior inconsistent
resolutions adopted by the City Commission are hereby repealed.
Section 5. Severability. If any section, clause, phrase, word, or provision is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, whether for
substantive or procedural reasons, such portion shall be deemed a separate, distinct, and
independent provision, and such holding shall not affect the validity of the remaining portions of
this resolution.
Section 6. Effective Date. This Resolution shall become effective only after
adoption by the City Commission of Winter Springs and the recordation of the Tuskawilla
Crossings Phase 1 Replat by Standard Pacific of Florida, GP.
ADOPTED at a Regular Meeting of the City Commission of the City of Winter Springs,
Florida, assembled this 13th day of August, 2018.
