CALL TO ORDER
The Regular Meeting of Tuesday, June 26, 2018 of the Code Enforcement Board was called
to Order by Vice -Chairperson Gregg Roero at 5:31 p.m., in the East Training Room of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708).
Roll Call:
Chairperson Matthew Criswell, absent [Excused]

A moment of silence was held followed by the Pledge of Allegiance.
Vice -Chairperson Roero stated that Chairperson Matthew Criswell and Board Member
Suzanne Walker's absences would be Excused.
Assistant to the City Clerk Antonia DeJesus swore in those who would be providing
Testimony during tonight's Meeting.
Brief comments followed on the upcoming Board and Commission Appreciation Dinner.

City Code: 6-195. - Maintenance Of Fences Or Walls.
Inspector: Captain Chris Deisler
Captain Chris Deisler, Code Enforcement Division, Police Department, introduced the
Case and testified, "On April 2"d of this year - officers responded to this home concerning
a loose canine in the area. They discovered a hole in the fence that allowed the dog to
escape. Accordingly, a Notice of Code Violation letter was prepared and mailed to the
owner of record; this is a rental property, so we involve the owner right away. It was
delivered, but to an unknown person on April 251h of 2018 by the green card.
Since the Violation persisted past the correction date, the Notice of Code Board hearing
was prepared and then sent. It was delivered certified on June 6, 2018 to a person named
Antonia coincidentally enough."

Captain Deisler continued, "Since that time, I received a packet from the owner with
photographs and a letter indicating that he had corrected the Violation. I was actually able
to verify that information personally today. Henceforth, I'm recommending the property
being found only in Violation with a Finding of Fact in the event a future Violation occurs,
they can possibly be brought back as a reoffender. No Fines would be applicable, just
simply the Finding of Fact in this Case."
Discussion followed on the canine that had escaped.

DID CORRECT THE VIOLATION BY THE TIME SPECIFIED FOR
CORRECTION BY THE CODE INSPECTOR, THAT THE VIOLATION IS
CURRENTLY CORRECTED, THAT NO FINE BE IMPOSED; ANY
SUBSEQUENT VIOLATION OF THE SAME CITY CODE PROVISION BY THE
RESPONDENT WITHIN FIVE (5) YEARS FROM THE DATE OF THIS ORDER
SHALL CONSIDERED A REPEAT VIOLATION FOR WHICH A FINE OF UP TO
FIVE HUNDRED DOLLARS ($500.00) PER DAY MAY BE IMPOSED." MOTION

Inspector: Captain Chris Deisler
After introducing the Case, Captain Deisler testified, "On May 1 st of 2018, I received a
complaint that the drainage easement behind this home that is the property of the owner
has been left unattended and overgrown. A Notice of Code Violation letter was prepared
and mailed to the owner on May 91h of 2018; it was delivered certified to Cynthia Watson
on May 16th of 2018.
Since the Violation persisted beyond the correction date, a Notice of Code Board hearing
was sent and it was sent to the owner and delivered on June 15, 2018 to a Yvonne Johnson.
I later received additional photographs and information that the lot had been cut and
maintained; I was able to verify this on June 20th of 2018 where I met the owner at the
house.

Captain Deisler stated, "They have mowed that, but since it was not done so in manner
prescribed by the date, I recommend the property be found in Violation only with a Finding
of Fact — similar to the Case prior to this — in the event they reoccur. No Fines be applicable
at this time.
Discussion followed on mowing, property lines, fences, and the surrounding property,
