CALL TO ORDER
The Regular Meeting of Tuesday, May 22, 2018 of the Code Enforcement Board was called
to Order by Chairperson Matthew Criswell at 5:33 p.m., in the East Training Room of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708).

Inspector: Captain Chris Deisler
Captain Deisler introduced the Case and testified, "Somewhere after the first of the year,
on January I I"' of 2018. I noticed that this yard had some junk and debris scattered
throughout, old wood/tree debris in the front yard and other unsightly materials. A Notice
of Code Violation was prepared and mailed but we got it back unclaimed. Accordingly, we
posted the NCV (Notice of Code Violation) at the residence on February 1.2, 2018;
however, these conditions have remained the same even to today. I believe this house is
now vacant and nothing is really being done to it.
The Notice of Code Board hearing was prepared and it was also returned unclaimed. We
posted the Notice at the house and here at City Hall March 21" of this year. And even to
today, I have not had contact with anyone."

After introducing the Case, Captain Deisler testified, `'On March 5th of this year, I
investigated an online complaint about this property from a neighbor; the complaint
stemmed around excessive amounts of household garbage being essentially stored in the
backyard. I found a toter in the backyard full of trash; it was clearly being invaded by
raccoons and the like.
Loose trash and debris was everywhere, there was a tire in the backyard, a shopping cart,
other items of jLink strewn throughout the property. Some stacks of paper blocks on the —
east side of the house, some old sand bags in the driveway, the numbers were also not
posted to Code standards. There was a broken window on the west side of the house that
was basically patched with a cardboard bov this is also a rental property so we had to

Captain Deisler continued, `By the required correction date on the Notice of Code
Violation of April 1Ot", there were some articles of trash picked up, but the Violations
persisted as a whole. Henceforth, we've mailed the Code Board hearing Notice on April

Further, Captain Deisler commented on the Violations and noted, "None of the Violations
were corrected by the time on the Notice of Code Violation."

Captain Deisler concluded, "I recommend the property come into Compliance by June 26, l
2018 or a Fine of two hundred and fifty dollars ($20.00) a day be established. If found in
Non -Compliance, on a side note, no more than an hour prior to this meeting. I actually
spoke with the property manager. it was a representative of the owner Tho lives out of
State.
Following brief comments about the Respondent, Captain Deisler noted, "I think they
intend to move forward with taking some solid action on getting it straightened out."

Captain Deisler presented Case information and then testified, "On March 2", of this year.
while driving passed the residence — I noticed that the wooden fence along the Deer Run
side was in disrepair, several slats are broken and missing. There are sections that appear
to fallen or unsupported,
A Notice of Code Violation was prepared and mailed to the owner and was received by
someone named Robbie Valentin on March 16t" of this year: no work has been completed.
Accordingly, the Code Board Notice was prepared and mailed; it was delivered to an
individual at the home on April 16t" of this year. Sometime after that. I eventually got a
call from someone identifying herself as Ms. Colon. A fence permit has actually been
pulled for this residence as of April 27t", but nothing has been done."

Captain Deisler indicated, "I recommend the property come into Compliance by June 26tH
of this year or a Fine of fifty dollars ($50.00) per day be established if found in Non-
Colnpliancc.-
Brief discussion followed on the surrounding trees and a wire on the property.

Before his testimony, Captain Deisler introduced the Case. Then Captain Deisler
continued. "On March 12th of this year, we observed the property had a lot of loose trash,
cigarette butts, and other debris present. The rear, side, and front of the building are in need
of a cleaning and a painting since the exterior treatments are either faded, peeling, or
inadequate to protect the structure.
At that time, I spoke on the phone to a representative of the management company who
said they would forward my information to the listing agent for follow up, and nothing was
done at that time.
A Notice of Code Violation was prepared and mailed to the owner and registered agent.
Both received on March 161h of this year, at this time nothing has been completed. The
Code Board Notice was then prepared and it was delivered to an individual last name
`Nguyen' to both entities on May 5, 2018, and nothing has been done to date."

Captain Deisler commented on the property's location and stated, "I recommend the
property come into Compliance by Jime 26, 2018 or a Fine of a hundred dollars ($100,00) -
a day be established if found in Non-Compliance." s
Mr. David T. 1-'can, 3807 Hollow Crossing Dive, Orlando, Florida: spoke about recent
efforts to correct the Violations and elaborated on an issue with a neighbor.
Board Member Bill Poe commented on the exterior coating. Mr. Van pointed out that it
had not been corrected but that he was waiting for his neighbor to cooperate. Further
discussion.
Chairperson Criswell asked Mr. Van how much time he would need to correct the
Violation. With brief comments. Mr. Van stated, "Yes. a month should be okay." Further
remarks.
