CALL TO ORDER
The Regular Meeting of Monday, October 23, 2017 of the City Commission was called to Order by
Mayor Charles Lacey at 5:15 p.m. in the Commission Chambers of the Municipal Building (City Hall,
1126 East State Road 434, Winter Springs, Florida 32708).

Prior to "Public Input ", Mayor Lacey referenced Consent Agenda Item "302" and pointed out that
Resolution 2017 -16 related to Consent Agenda Item "302" and advised the public that although this
Resolution (2017 -16) did not go out with the original Agenda Item, it is applicable and part of Consent
Agenda Item "302 ".

Mr. Mark Duplantis, 1590 Wrentham Court, Winter Springs, Florida: mentioned that his home flooded
during Hurricane Irma, asked what would be done by Southern Oaks to prevent this from happening
again, and mentioned a berm being built, however he did not see this as a viable solution.
Mayor Lacey addressed Mr. Brian Fields, P.E., Director, Community Development Department and
asked that he get with Mr. Duplantis.
Mayor Lacey closed "Public Input".

REQUEST:
The Community Development Department requests the City Commission approve the Winter
Springs Apartments plat, and authorize the plat to be recorded, subject to satisfaction of the
conditions of approval.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.

301. Community Development Department
REQUEST:
The Community Development Department requesting authorization to renew the contract with
The Lake Doctors, Inc. for one year in the amount of $43,740.90, plus a 10% contingency, for
aquatic weed control and maintenance services of City - maintained lakes, ponds, and other
stormwater facilities.
FISCAL IMPACT:
The total cost over the one -year contract renewal period is $43,740.90, plus a 10% contingency,
funded by the Stormwater Utility Fund.

Line Adjustment at 679 and 681 Canadice Court.

recommendation finding the Nursery Road Warehouse Phase 4 sitework to be built in substantial
accordance with the Final Engineering plans, subject to the enclosed punchlist; and 2) accept the
public infrastructure improvements for ownership and maintenance.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.

Final Engineering plans, subject to satisfactory completion of the remaining open punchlist items.

The Community Development Department is requesting City Commission authorization of
$175,000 for Universal Engineering Sciences' performance of Professional Building Department
Services.

The requested authorization in the amount of $175,000 is funded by the Development Services

USA Services of Florida, Inc. in the amount of $32,656.50 for citywide street sweeping services for
one year, piggybacking off City of Jacksonville contract #CS- 0003 -16.
FISCAL IMPACT:
The total cost of street sweeping for one year is $32,656.50, funded by the Stormwater Utility
Fund.

REQUEST:
The Information Services Department requests Commission authorization to dispose of surplus
assets according to the attached disposition sheet(s).

of Winter Springs and the Rotary Club of Winter Springs for the 2017 Veteran's Day Event.

602. Office Of The City Clerk — Andrea Lorenzo - Luaces, MMC
City Clerk Andrea Lorenzo- Luaces asked the Mayor and City Commission if they would be willing to
consider dates for a 2018 Board and Committee Appreciation event and if so, an Agenda Item could be
provided on this matter at possibly the December City Commission Meeting for the City Commission's
consideration.
This was agreed to.

603. Office of Commissioner Seat Four - The Honorable Cade Resnick
Commissioner Cade Resnick commented on concerns between Seminole County Public Schools, Winter
Springs High School, and the City related to a proposed parade route as noted on social media, to which
Commissioner Resnick said that no one from Winter Springs High School had approached him about
any parade route.

Continuing, Commissioner Resnick pointed out that he thought that our Police Department had the most
experience with safety, that he would always err on the side of safety for everyone, and conveyed that
Teachers see things differently than law enforcement.

604. Office of Commissioner Seat Five - The Honorable Geoff Kendrick
Commissioner Geoff Kendrick mentioned that his family had just held a get- together at Trotwood Park
and offered kudos to Mr. Chris Caldwell, Director, Parks and Recreation Department and his
Department. Commissioner Kendrick added, "Everything that has been done there, all of the
construction, all of the Staff that you have — just a dynamite job! Job well done, Sir. I do appreciate
everything that the Parks and Recreation Department is doing."
Furthermore, Commissioner Kendrick spoke of his four (4) years serving on the Parks and Recreation
Advisory Committee and remarked, "It was a wonderful experience and it seems to get better every
year. I don't know how you do it. It is a testament to your hard work as well as your Staff's."
Speaking about many of the great events happening in Winter Springs, Commissioner Kendrick
referenced the 10th Annual "ARTOBERFEST" that was held this past weekend, recognized Deputy
Mayor Pam Carroll's efforts, and noted that he and his family enjoyed the gathering.
Next, Commissioner Kendrick referred to the upcoming Oak Forest Fall Festival being held on
Saturday, October 28a' from 3:00 to 5:00 p.m. and advised that the occasion would include bounce
houses, food, Halloween costumes, and more.
The Hometown Harvest event scheduled for Saturday, November 4th at 5:00 p.m. was addressed by
Commissioner Kendrick who suggested everyone should attend, as this is always a great celebration.
Commissioner Kendrick then indicated that on Saturday, November 11th, an Honor Flight of Central
Florida Reunion would be held at the Winter Springs Senior Center.
Referencing news just announced today that the City of Winter Springs was listed as the 14th Safest City
in Florida, Commissioner Kendrick stated, "It is such an incredible testament to again, Chief Brunelle
and your Staff - "Winter Springs - `Safe Cities in Florida'."
City Manager Kevin L. Smith added that the City was noted as "l0a"' on another similar list.
Commissioner Kendrick inquired if the information was available on line, to which Manager Smith said
that it was.

605. Office of the Mayor - The Honorable Charles Lacey
Mayor Lacey communicated that he recently attended a breakfast which included the President of Duke
Energy Corporation and that Mayor Lacey brought up issues related to the recent hurricane. During the
breakfast meeting, Mayor Lacey expressed that Duke Energy Corporation indicated that their data
system was overloaded during Hurricane Irma and that they would correct this problem going forward.
Mayor Lacey commented that he suggested that they also pay attention to keeping easements cleared so
that lines could be fixed as needed.

606. Office of Commissioner Seat One - The Honorable Jean Hovey
Commissioner Jean Hovey acknowledged that the City's Veterans Day event was being held on
Saturday, November 11th, 2017 at 6:00 p.m.
Next, Commissioner Hovey asked for an update on City parks. Mr. Caldwell reviewed the status of City
parks noting that all were open now except for the back part of Central Winds Park, and pointed out that
that area was expected to be fully open in one (1) to two (2) weeks.
Commissioner Hovey spoke further on what Commissioner Resnick had noted earlier about Facebook
posts, and recommended that instead of people "stirring the pot ", that she hoped they would instead pick
up the telephone and call someone with the City for the facts. Commissioner Hovey stated that Chief of
Police Kevin Brunelle, Police Department had posted many times asking for telephone numbers so he
could call people to explain the real situation. Commissioner Hovey added that the Mayor and City
Commission were always available to answer questions.

607. Office of Commissioner Seat Two - The Honorable Kevin Cannon
Commissioner Cannon also referenced the 10th Annual "ARTOBERFEST" and said that he enjoyed it
very much.
Secondly, Commissioner Cannon thanked Attorney Garganese for sending an article to the City
Commission and then commented on Home Rule.
Next, Commissioner Cannon acknowledged how the Mayor and City Commission and City Staff were
supportive of Winter Springs High School, and in terms of recent social media postings related to
Winter Springs High School and a proposed parade route, Commissioner Cannon indicated that if our
Police Chief had major safety concerns, pushing school preferences via social media and not listening to
Law Enforcement's concerns was not the best thing to do. Commissioner Cannon urged parents and
school officials to instead simply make a telephone call to anyone with the City, as safety is paramount,
and we can address security concerns better over the telephone than on social media where anyone can
monitor postings.

Lastly, Commissioner Cannon expressed that he was excited about upcoming school events and what is
in store with Winter Springs High School, as well as upcoming City events.
REPORTS
608. Office of Commissioner Seat Three /Deputy Mayor - The Honorable Pam Carroll
Deputy Mayor Carroll spoke of last weekend's 101 Annual "ARTOBERFEST ", that in the future she
would be helping further in an advisory role, and mentioned that some students from other Seminole
County schools signed up for community service and had helped during "ARTOBERFEST "; however,
Deputy Mayor Carroll hoped that in the future, Winter Springs High School students might also be able
to assist with this event.
Regarding Facebook posts, Deputy Mayor Carroll noted that due to the Sunshine Law, that if another
Winter Springs Elected Official had commented in any way on a Facebook post, that she or any other
Elected Official from the City could not respond, and wanted people to understand that that was why she
might not be able to post any comments. Deputy Mayor Carroll added that residents could always call
her.
Deputy Mayor Carroll mentioned that the Senior Center Staff had prepared folders for
"ARTOBERFEST" and all were given out, therefore Deputy Mayor Carroll trusted that would bring in
new members.
Concluding her Report, Deputy Mayor Carroll offered kudos to A Budget Tree Service, Inc. and
remarked that they had picked up 1.5 million cubic feet of storm debris.
Commissioner Resnick further addressed the Sunshine Law and how it restricted Elected Officials from
commenting on Facebook if another Elected Official had already posted a comment, no matter how
minor the comment was. Commissioner Resnick asked Attorney Garganese about this.
Attorney Garganese stated, "There are some Attorney General Opinions out there that provide some
guidance on that issue which I'd be happy to forward to all the Commission. Be happy to talk to you
more in detail about that. The most conservative approach is if you see another Commissioner on a
Facebook thread, is to not post, just to avoid altogether the appearance that there is a Sunshine Law
issue." With further remarks, Commissioner Resnick inquired if this could be looked into.
PUBLIC INPUT
Mayor Lacey opened "Public Input".
Mr. Ron Ligthart, 1036 Winding Waters Circle, Winter Springs, Florida: pointed out that his
Halloween event was a few days away and commented on some of the thematic aspects he had been
working on, and also spoke of millage rates, detection systems, and next year's Budget.
Mayor Lacey closed "Public Input".
