The Community Development Department is requesting the City Commission: 1) approve
Staff s recommendation of Wharton- Smith, Inc. as the top- ranked firm to provide
Construction Manager at Risk (CMAR) services for the Winter Springs Fieldhouse at
Torcaso Park under RFQ# 009- 17 -BS; 2) authorize the expenditure of $38,128 for Wharton -
Smith's preconstruction services; and 3) authorize the City Manager and City Attorney to
finalize the terms of the CMAR services agreement with Wharton- Smith.
SYNOPSIS:
The Winter Springs Fieldhouse is a proposed 22,600 square foot multi - purpose gymnasium
located at Torcaso Park adjacent to the Winter Springs Police Department on Moss Road.
This agenda item is for the selection of Wharton -Smith to serve as the City's Construction
Manager for the project.
CONSIDERATIONS:
PROJECT BACKGROUND:
The Winter Springs Fieldhouse is a proposed multi - purpose gymnasium building to
be located in Torcaso Park on the field immediately south of the Police Station on
North Moss Road. The Fieldhouse building will be used for a variety of recreation
activities including basketball, volleyball, camps, clinics, exercise classes, and other
programs. The facility will be used for sports league play, tournaments, and daily
recreational and community activities.

At the October 24, 2016 City Commission meeting, the Commission approved a
design services agreement with Borrelli + Partners to complete the architectural
design services including preliminary design, final construction documents,
permitting, and building support services. The preliminary design is in progress and
Staff has been working with the architect on various options for the site plan, building
floor plan, and the architectural and engineering style for the building.
The proposed Fieldhouse building is tentatively planned to be approximately 22,600
square feet in size and consists of a main gymnasium space, multi - purpose rooms,
restrooms, a lobby area, storage space, hallways, and utility rooms. The
main gymnasium floor space is approximately 14,700 square feet and has been sized
and configured to accommodate two regulation -sized basketball courts or two
volleyball courts. The gymnasium floor plan (Exhibit A) also includes space for
spectator seating, walking aisles, and team benches. The gymnasium and seating
areas can be configured as one main court (basketball or volleyball), or as two
regulation -sized courts separated by a retractable curtain.
CONSTRUCTION MANAGER AT RISK SERVICES:
• Construction Manager at Risk (CMAR) is a project delivery method which entails
hiring a Construction Management firm, under contract with the City, to deliver the
project within a Guaranteed Maximum Price (GMP). For the Winter Springs
Fieldhouse, using a CMAR is recommended due to the volatility in the construction
cost market, the specialized nature of the construction, and the need to establish a
fixed price for the project.
• During the design process, the Construction Manager At Risk (CMAR) works
directly and collaboratively with the City and the Architect to determine the final
design parameters and construction costs. The result of this process is a Guaranteed
Maximum Price (GMP), based on the final construction documents and specifications
plus any reasonably inferred items or tasks. The CMAR provides professional
services and acts as a consultant to the owner in the design development and
construction phases. In addition to acting in the owner's interest, the CMAR must
manage and control construction costs to not exceed the GMP because contractually
any costs exceeding the GMP that are not change orders are the financial liability of
the CMAR. By giving the Owner the GMP prior to bids, the CMAR assumes the risk
of bids coming in higher as the CMAR is contractually bound to deliver the project
per the plans and specifications and any additional allowances as defined in the GMP.
• In August 2017, the City issued Request for Qualifications #RFQ 009 -17 -BS for
Construction Manager At Risk Services for the Winter Springs Fieldhouse. Proposals
were received from two qualified firms: Wharton- Smith, Inc. and Oelrich
Construction, Inc. On October 5, 2017, a selection committee consisting of three City
Department heads conducted interviews with both firms. The selection committee
unanimously ranked Wharton -Smith as the top- ranked firm.
• Wharton- Smith's tasks as CMAR consist of two phases: preconstruction services and
the construction phase. The preconstruction phase services will be performed for a
lump -sum fee of $38,128 and include the following tasks (see Exhibit B):
. Preliminary evaluation of project program, schedule, budget, and construction

• Consultation with the City and Architect
• Coordinate construction with potential subcontractors and suppliers
• Prepare detailed cost estimates at the 30 %, 60 %, and 90% design stages
• Prepare a Guaranteed Maximum Price based on the final construction
documents
. Prepare a project construction schedule
The Guaranteed Maximum Price, which will be prepared and submitted for City
Commission approval in 2018, includes the cost of all construction work plus the
Construction Manager's Fee. The Construction Manager's Fee is typically 4% to 8%
of the total construction cost.
NEXT STEPS:
Acting as the City's Construction Manager, Wharton -Smith will immediately begin
working on the preconstruction services outlined herein.
City Staff will coordinate discussions with Wharton -Smith (CMAR), Borrelli +
Partners (Architect), and CPH (Engineer) to review detailed design and cost
considerations.
As the design progresses to the 60 %, 90 %, and final design stages, detailed cost
estimates will be prepared based on City Staff s design decisions. A Guaranteed
Maximum Price (GMP) will be established at final design and submitted for City
Commission approval. The GMP is expected to be ready in 3 -5 months, with
construction to then start in mid -2018.
FISCAL IMPACT:
Wharton- Smith's preconstruction services in the amount of $38,128 are funded by the
Infrastructure Surtax Fund (One Cent Sales Tax - 3rd Generation). The authorization of the
construction expenditure is not part of this agenda item and will be a separate approval at a
future meeting after a Guaranteed Maximum Price has been proposed.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at six (6) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.

RECOMMENDATION:
Staff recommends the City Commission: 1) approve Staffs recommendation of Wharton -
Smith, Inc. as the top- ranked firm to provide Construction Manager at Risk
(CMAR) services for the Winter Springs Fieldhouse at Torcaso Park under RFQ# 009-17 -
BS; 2) authorize the expenditure of $38,128 for Wharton- Smith's preconstruction services;
and 3) authorize the City Manager and City Attorney to prepare and execute any and all
applicable documents.
