REQUEST:
The Community Development Department requests City Commission approval for a
Boundary Line Adjustment at 679 and 681 Canadice Court.
SYNOPSIS:
A Boundary Line Adjustment has been proposed at 679 and 681 Canadice Court. This
agenda item provides the general information and background of the proposed Boundary
Line Adjustment.
CONSIDERATIONS:
APPLICANT AND PROPERTY INFORMATION:
• Property owner's name(s): Ramon Martinez
• Property addresses: 679 and 681 Canadice Court
• Property Parcel ID numbers: 08- 21- 31 -5JU- 0000 -2310, 08- 21- 31 -5TU- 0000 -2320
• Current zoning designations: PUD (Planned Unit Development)
• Current FLUM designations: Low Density Residential
BACKGROUND OF PROPERTIES:
. The existing lot at 681 Canadice Court contains two single - family homes, both
currently owned by Mr. Ramon Martinez. The adjacent smaller lot at 679 Canadice
Court, is vacant. Based on Staff s research, a lot split was planned in 1996, in
conjunction with the permitting and construction of the two homes, that would have
resulted in each of the two homes being properly located on separate lots. The

planned lot split was approved by the Planning & Zoning Board on October 2, 1996,
but it was never submitted for City Commission approval and it was never recorded.
Both lots and both homes have since remained under ownership by Mr. Martinez.
Mr. Martinez is now seeking to correct this problem through a Boundary Line
Adjustment. The Boundary Line Adjustment moves the boundary line between 679
and 681 Canadice Court to create two compliant lots with one home on each lot. City
Commission approval is required for a Boundary Line Adjustment, in accordance
with Section 9 -2 of the City Code.
. The 7.5 -foot drainage and utility easements that previously existed along the original
lot line between lots 231 and 232 were approved by the City Commission to be
vacated on October 14, 1996.
FISCAL IMPACT:
There is no fiscal impact associated with this Boundary Line Adjustment.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media /Press Representatives who have
requested Agendas /Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at six (6) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends the City Commission approve the Boundary Line Adjustment at 679 and
681 Canadice Court, and authorize the City Manager and the City Attorney to prepare and
execute any and all applicable documents.
