Code Enforcement Division — Police Department CASE #2017CE001168 Steve And Jennifer Defazio 647 Pearl Road Winter Springs, Florida 32708 City Code: 6- 84.(d) Permits. (Accessory Buildings) Florida Building Code: 105.1 Required. (Permits) Inspector: Code Officer Rich McLaren Code Officer Richard McLaren, Code Enforcement Division, Police Department introduced the Case and related information. Continuing, Code Officer McLaren testified, "Case started on May 13, 2017, received an email complaint from Community Development [Department]/Permitting reference to possible unpermitted construction work ongoing at this residence. Upon inspection of the property, I found a side gate open, which provided a clear view of a deck being constructed with a roof attached by posts over it. Permitting section advised they had no Permits on file for any work being done at this location. May 14, 2017 Notice of Code Violation was prepared and posted at the residence, as well as sent Certified /return receipt requested. The mailing was returned and the mail as unclaimed. Resident did apply. for a Permit, however, follow -up documentation requested by City Staff was never submitted and no inspection has been done to this date. A Notice of Code Board Hearing was posted at the residence, City Hall, and mailed to resident by Fist Class mail, as well as Certified Fist Class return receipt requested on July 8, 2017." Photographs from "WS -1" were shown with additional comments. Concluding, Code Officer McLaren stated, "I recommend the property be found in Violation of the Ordinances as cited and be given until August 8, 2017 to come into Compliance or a Fine of two hundred and fifty dollars ($250.00) per day be applied." Mr. Steve Defazio, 647 Pearl Road, Winter Springs, Florida: testified that he had been in contact with multiple engineering firms and added, "I have spoke with Florida Engineering and I'm working with them right now to try and see if they'll take on the project. I have applied for a Permit, but until I can get engineered plans for the roof, I guess, I can't go any further with the Permit." r CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - JULY 25, 2017 PAGE 4 OF 8 Continuing, Mr. Defazio referenced several emails and noted that the deck was built over a year ago. Board Member Maurice Kaprow asked how long it would take to complete the engineering portion. Mr. Defazio stated, "If I could find an Engineer — that'll take it on,wµ then I don't know how long it takes." Mr. Defazio briefly described the structure. w Discussion followed on permitting and inspection procedures. Mr. Defazio added, "I didn't know I needed a Permit for it." Chairperson Criswell suggested, "I think if we settled something out and you had forty - five (45) days, I really think you could get some engineered plans." Additional comments followed regarding local Engineers. Senior City Attorney Jennifer Nix stated, "I would suggest asking City Staff for any - contact information that you need." Further discussion followed on a corrective action date. Note: The Respondent was present "I MOVE TO FIND THE RESPONDENT IN VIOLATION OF CITY CODE AND ORDER THE RESPONDENT BE GIVEN UNTIL SEPTEMBER 26, 2017 TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENTS FAIL TO COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF TWO HUNDRED AND FIFTY DOLLARS ($250.00) SHALL BE IMPOSED FOR EACH DAY THE VIOLATION CONTINUES THEREAFTER." Code Enforcement Division — Police Department CASE #2017CE000666 Doris B. Rodriguez 1319 Augusta National Boulevard Winter Springs, Florida 32708 City Code: 13 -2.(e) Stagnant Pool. Inspector: Code Officer Rich McLaren General Case information was presented by Code Officer McLaren who then testified, "The property was found in violation of City Ordinance by the Code Enforcement Board and given until July 7, 2017 to come into Compliance or a daily Fine of one hundred and fifty dollars ($150.00) per day would be applied. The Order was also secured to remedy the Violation if not corrected. The property was re- inspected on July 10, 2017 and no change was noted in the condition of the pool. Email notification was sent to Public Works to have a crew remedy the Violation. At this time, they're still making arrangements to have it done; it has not been done as of yet." Photographs from "WS -1" were shown with additional comments. Code Officer McLaren concluded, "My recommendation is that the property be assessed the hundred and fifty dollar ($150.00) Fine that was adopted last month for the Non - Compliance, and also — we have the Public Works Department going out there to remedy it." Brief discussion followed on the Fine and the work to be completed by the Public Works Department. Board Member Carole Giltz asked, "The owner is not living in the house ?" Code Officer McLaren stated, "Yes, she is; it's the owner and her son." Additional comments. Senior City Attorney Nix commented on Code Enforcement procedures related to Notices and nuisance abatement. Further remarks. Note: The Respondent was not present. PUBLIC HEARINGS AGENDA - NEW CASES PUBLIC HEARINGS - NEW CASES 500. Code Enforcement Division — Police Department CASE #2017CE001150 Coberturas Medicas Of Florida Prop. Inv. LLC 243 Winding Hollow Boulevard Winter Springs, Florida 32708 IPMC: 304.1 General. (Exterior Structure) Inspector: Captain Chris Deisler Captain Chris Deisler, Code Enforcement Bureau, Police Department presented information related to this Case, and then testified, "A couple months ago, received a call from City Staff regarding the buildings in question. This property is the three (3) vacant office buildings on Winding Hollow Boulevard on the east side of the street. We got a call regarding the flashing on top of the roofs — appears to be a metal style flashing on the rooftops. Looks like it had blown off or come lose in a storm, but the flashing was lose and posed a possible safety hazard to the neighborhood. On the eleventh of May of this year, I was able to go out there and personally inspect those buildings; I found the conditions as reported, started the case accordingly. We sent a Notice of Code Violation letter Certified to the owner and the registered agent of the LLC who is named as a Roberto Llavina — it was received by Mr. Llavina on May 31 St of this year. Subsequently there was no work done so the Code Board Hearing Notice was also mailed Certified to this same two (2) entities on June 27th of this year; it was also received by CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD,: 61 1 REGULAR MEETING - JULY 25, 2017 PAGE 7 OF 8 Mr. Llavina on July 10'h of this year. We posted the bulletin board out front and the property with the Notice of Code Board Hearing on June 27h. The form that I believe Officer McLaren turned into you, I would just like to introduce as 'WS-2', which is the original Affidavit of Posting for the Hearing. That particular piece of paper did not make it into your Agenda but it was done. There hasn't been any progress on the property at all; the flashing is essentially the same. I've had no contact with the owner." Photographs from "WS -1" were shown. Additional comments followed. Captain Deisler continued, "As of this afternoon, the property looks almost exactly the same as you see it which is the same since I observed it originally on 5/11/17. I am requesting that the respondent be given 'till August 14th of this year to come into Compliance, then assessment of one hundred dollars ($100.00) a day if not in Compliance." Brief discussion followed on previous Cases for properties in the vicinity. Further remarks. Note: The Respondent was not present. "I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE AND ORDER THE RESPONDENT BE GIVEN UNTIL AUGUST 14TH, 2017 TO CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT FAILS TO COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF ONE HUNDRED DOLLARS ($100.00) SHALL BE IMPOSED FOR EACH DAY THE VIOLATION CONTINUES THEREAFTER."
