The Regular Meeting of Tuesday, June 27, 2017 of the Code Enforcement Board was called
to Order by Vice -Chairperson Gregg Roero at 5:32 p.m., in the Commission Chambers of
the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708.

Captain Chris Deisler, Code Enforcement Bureau, Police Department presented the Case
information. Continuing, Captain Deisler testified, "This Code Board heard a Case very
similar to this in October, 2014 for the exact same Ordinance Violation. It was brought
before you at the time — junk and debris. At the time of the original 2014 Hearing, the
property was brought into Compliance prior to the Hearing date, but was assessed a one-
time Fine for the Violation.

On May 17 of this year, we again noticed the property had fallen in a state where numerous
articles of junk and debris had accumulated. Based upon these facts, and since the property
was still owned by the original Violator, we were within our original five (5) years from
the first Case as being brought to you now as a Repeat Violation.
The Notice for this Hearing was mailed Certified to the property owners on May 19, 2017.
I'd like to have Officer [Terri] Guerra present what's going to be my item "WS -2" — which
is actually a proof of the Certified mailing that I was able to pull today. For some reason,
I still have not gotten the green card back, but that does accurately reflect the Certified mail
number. It was delivered on June 13 of this year; the property and City Hall bulletin board
were also posted." Captain Deisler pointed out that the Respondent was present.
Continuing, Captain Deisler stated, "For a while, I noticed some progress on the property
to try to move some stuff around and get it stored right, but there's still quite a bit of stuff
on the property in Violation of this Code. There's also — as of at least right before
lunchtime this afternoon — there was a large utility trailer parked on the south side of the
residence that was loaded with what would be akin to junk and debris. I have not had any
contact with Mr. Lesage on this Case until I saw him here tonight."

Concluding his testimony, Captain Deisler stated, "Like I said, as of this afternoon, the
property stands in as about the same condition since I observed it on May 17 this year, and
based on the condition of the property, and in accordance with State Statute, I am
recommending the five hundred dollar ($500.00) per day Fine for the Repeat Violation if
found in such."
Mr. Ronald Lesage, 31 North Cortez, Winter Springs, Florida: briefly commented on his
previous appearance before the Code Enforcement Board and said, "My son — is also
starting to bring his stuff there. I have a shop, that's where I keep my bobcats and other
things like that; I keep all at the shop."
Continuing, Mr. Lesage stated, "As of last Monday day, my son told me he spoke with
[Captain Deisler], because like he said, I haven't spoke with him — he said the last thing
that needed to go was the vehicle which I had just brought home cause where I was storing
it, I was unable to store it there. So, we brought it home to get it running, and sold it. So,
I had to wait for a tow truck last Monday; I thought as of then we were in Compliance.
Mr. Lesage remarked on the process for Repeat Violations. Referring to the state of the
property, Mr. Lesage stated, "It does change every day; my son brings home a trailer and
then he stops there and goes to the shop. Mine is the other side, which is beyond the face
of the house. All I keep is one (1) trailer there."

Further, Mr. Lesage stated, "I was in Violation; if I still am, I would definitely want to
know exactly — where I'm still in Violation." Mr. Lesage then explained his current
financial state and circumstances and summarized, "Between a rock and hard place." With
further comments, Mr. Lesage concluded, "I wish I had pictures to show that it's a lot better
than that now."
Vice -Chairperson Roero inquired as to who owned the property. Mr. Lesage stated, "I do."
Additional comments followed.
Board Member Carole Giltz asked, "What does he have to do?" Captain Deisler noted,
"Contrary to his claim, I've had contact with no one representing his property since the
time I started this Case." Referring to Board Member Giltz' question, Captain Deisler
stated, "Well, first thing he needs to do is involve us — that's the only way we're going to
get resolution. Second, he needs to keep his property in check with the Code."
Discussion followed on the work vehicles parked at residences, trailers, junk and debris,
and fine accrual. Captain Deisler stated, "The goal for us has never been and it will never
be to try to cause financial hardship or burden for anyone, but the bottom line is the
neighborhood and the City have standards and they're asking me to comply with it and
follow it."
Regarding questions on a corrective action date, Senior City Attorney Jennifer Nix stated,
"For a Repeat Violation, it is different because they already had — that first Hearing in 2014
and that was established. Now anything in the future? Repeat Violation. And in the case
of Repeat Violations, the financial charge per day, it starts for each day the Violation
continues beginning with the date that it was first observed, so May 17, 2017, per Captain
Deisler." Additional remarks followed.
Further comments ensued on compliance, repeat Violations, Fine accrual, the Public
Hearing Notice, Code Enforcement Board procedures, and the Lien reduction request
process.

Inspector: Code Officer Terri Guerra
Code Officer Terri Guerra, Code Enforcement Division, Police Department introduced the
Case and related information. Continuing, Code Officer Guerra testified, "June 29, 2016 I
observed several areas where the paint was chipping off of the front of the residence; there
was also wood exposed on the overhang extensions. On August 8, 2016, I sent Notice of
Code Violation to the owner of the property. On August 12, 2016, Nancy Biehl signed for
the NCV (Notice of Code Violation). On August 22, 2016, I received a call from Ms. Biehl
requesting more time due to being elderly and not having the money to correct the Violation
which I agreed to so that she could have some more time

On November 3, 2016, I attempted to call Ms. Biehl because I had not heard from her, and
there was no answer and I left a message. On June 1, 2017, I sent Notice of Code Board
Hearing to the owner of the property. Code Officer [Rich] McLaren posted the property
and City Hall with the Notice. On June 5, 2017, Ms. Biehl signed for the registered Code
Board letter.

Concluding, Code Officer Guerra stated, "There has been no contact from the owner of the
property until today — she came today. I am recommending that the Board find the property
in Violation of the Code and the owner be fined fifty dollars ($50.00) a day if found in
Non -Compliance; the owner should be given until July 18, 2017 to comply.
Ms. Nancy Biehl, 132 Bay Berry Court, Winter Springs, Florida: began her testimony with
a brief commentary of her illness and current circumstances. Continuing, Ms. Biehl stated,
"So, I have been trying to get everything done."
With further comments, Ms. Biehl stated, "The last thing I remember she was going to try
to get someone to help me and try and get it done — because I can't even smell paint because
of my lungs." Further remarks.
Community resources that could possibly assist the Respondent were mentioned.

Senior City Attorney Nix commented briefly on the circumstances of the Case, and
referring to the Respondent clarified, "There's a Motion that was seconded — with a date
of August 18, 2017. While someone has told you that they're going to - assist in getting
the Boy Scouts to potentially help — and of course we all hope that happens — you are the
property owner. So, I just want you to know that it is on you to where if it's not fixed by
August 18, 2017 — it's not going to matter who was supposed to help, who tried to help and
whatnot. That's when the fifty dollar ($50.00) a day Fine would kick in."

Case information was presented by Captain Deisler who then testified, "During some
patrols of this area, and as of information that was given to me by other City Staff, we
noticed that over the last year or so — a good majority of the landscaping plants, the shrubs,
have all died and turned brown. There's also a great deal of trash and debris around the
property and specifically near and inside the dumpster enclosure.
All the flowerbeds are equipped with that brown irrigation drip tubing, and you may have
noticed — the drip tubes are exposed from lack of adequate cover. There's nothing to cover
the drip tubes; it looks unsightly. Additionally, the grounds, like I was telling you earlier,
and the dumpster enclosure has excessive junk and debris.
The Notice of Code Violation was mailed Certified and received on April 25, 2017. The
Hearing Notice for this Hearing tonight was mailed Certified to the owners of the property
and received on May 18 of this year. We also have the City Hall bulletin board and the
property posted with a Notice for tonight on May 12.
I have not heard from anyone on this property; I have not noticed any progress to make any
changes on the property. There is still a bunch of junk and debris on the property and the
dumpster enclosure. The dead landscaping is as prevalent now as it was before; the drip
tubes were still exposed presenting that unsightly presentation, and again I have had no
contact with the owner."

that the Respondent be given until July 14 of this year to come into Compliance, and that
one hundred dollars ($100.00) a day be assessed if found in Non-Compliance." Discussion

observed several vehicles parked all over the front yard of this residence. I sent a Notice
of Code Violation to the owner of the property; I also put a Resident's Guide to Driveway
and Parking Regulations pamphlet inside the Notice.

This Case was introduced by Code Officer Guerra and then reviewed relevant related
information.
Senior City Attorney Nix asked, "Just to check — is the fence thing dropped?" Code Officer
Guerra confirmed, "Yes."
Continuing, Code Officer Guerra testified, "November 21, 2016 — I sent a Notice of Code
Violation to the resident and posted the property regarding the vehicle that is being stored
in the backyard of property. The letter was returned on January 19, 2017. On June 1, 2017,
I sent a Notice of Code Board Hearing both Certified and First Class to the owners of the
property; the Notice was also posted at City Hall and the property. There has been no
contact from the owner at this time."

Code Officer Guerra remarked, "There has been no contact from the owner of the property.
I recommend the Board find the property in Violation. If the Violation is not corrected by
July 18, 2017, a Fine of fifty dollars ($50.00) a day be imposed on the owner until it has

Vice -Chairperson Roero inquired if it were possible to just cover the vehicle in order to
achieve Compliance. Code Officer Guerra indicated that residents only have a month to
have a disabled vehicle on their property, and in response to Vice -Chairperson Roero's
question, Code Officer Guerra confirmed, "No."

Inspector: Code Officer Rich McLaren
Code Officer Guerra presented the Case information and testified, "The Case was referred
to Code Officer [Rich] McLaren by Road Patrol in reference to a stagnant pool at the
address; Patrol left a written warning at the residence.
On May 16, 2017, the condition had not corrected; pool water was stagnant and had odor
emanating from the area. Notice of Code Violation was mailed Certified Mail/Return
Receipt requested and posted at the residence. NCV (Notice of Code Violation) was signed
for by Doris Rodriguez on May 22, 2017. Property and City Hall were posted on June 1,
2017 for Code Board; Intent to Remedy language was included in the Notice. No contact
has been made with the homeowner."

Code Officer Guerra remarked, "He is recommending that the property be found in
Violation of City Ordinance and the owner be given until July 7, 2017 to come into
Compliance.

In the event they do not come into Compliance, a daily Fine of a hundred and fifty dollars
($150.00) be applied to the property, and the Code Board issue an order to have this
Violation corrected as needed."
Providing background round information Code Officer Guerra stated "There's an elderly female

that lives there with her son that has — possibly some - issues. We've been out there several
times; they never contacted us about the pool." Code Officer Guerra also indicated, "The
screen enclosure is intact all the way around."
Senior City Attorney Nix referenced procedural matters related to nuisance abatement.
Board Member Maurice Kaprow remarked, "Is it appropriate to state that this Violation
constitutes a serious threat to public health and safety?" Senior City Attorney Nix replied,
"You can, but that's where you're getting your authority from [Sec.] 13-4."

"I MOVE TO FIND THE RESPONDENT IN VIOLATION OF THE CITY CODE
AND ORDER THAT THE RESPONDENT BE GIVEN UNTIL JULY 7TH, 2017 TO
CORRECT THE VIOLATION. IN THE EVENT THE RESPONDENT FAILS TO
COMPLY BY THIS DATE, A FINE IN THE AMOUNT OF A HUNDRED AND
FIFTY DOLLARS ($150.00) A DAY SHALL BE IMPOSED FOR EACH DAY THE
VIOLATION CONTINUES THEREAFTER.
FURTHER THE VIOLATIONS CONSTITUTE A SERIOUS THREAT TO THE
HEALTH, SAFETY, AND PUBLIC WELFARE. IN THE EVENT THAT THE
RESPONDENT DOES NOT CORRECT THE VIOLATION BY THE DATE SET IN
THIS ORDER, THE CODE INSPECTOR SHOULD BE NOTIFIED AND
APPROPRIATE ACTION MAY BE TAKEN BY THE CITY CONSISTENT WITH
THE CITY CODE OR APPLICABLE LAW TO BRING THE PROPERTY IN TO
