HomeMy WebLinkAbout2017 05 03 Planning and Zoning Board/LPA Regular Meeting Minutes CITY OF WINTER SPRINGS, FLORIDA MINUTES PLANNING AND ZONING BOARD/LOCAL PLANNING AGENCY REGULAR MEETING MAY 3, 2017 CALL TO ORDER The Regular Meeting of Wednesday, May 3, 2017 of the Planning and Zoning Board/Local Planning Agency was called to Order at 5:31 p.m. by Chairperson Bob Henderson in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairperson Bob Henderson, present Vice-Chairperson Rick Brown, absent Board Member Kok Wan Mah, present Board Member Sarah Miller, absent Board Member Bart Phillips, present Assistant City Attorney Kristen Eick, present Assistant to the City Clerk Antonia Della Donna, present A moment of silence was followed by the Pledge of Allegiance. Office Of The City Clerk The Office Of The City Clerk Requests That The Planning And Zoning Board/Local Planning Agency Review And Approve The Wednesday, April 12, 2017 (Rescheduled from Wednesday, April 5, 2017) Planning And Zoning Board/Local Planning Agency Regular Meeting Minutes. "I WOULD MOVE THAT THE MINUTES OF THE WEDNESDAY, APRIL 12TH (2017) MEETING BE APPROVED." MOTION BY CHAIRPERSON HENDERSON. SECONDED BY BOARD MEMBER PHILLIPS. DISCUSSION. VOTE: BOARD MEMBER PHILLIPS: AYE CHAIRPERSON HENDERSON: AYE BOARD MEMBER MAH: AYE MOTION CARRIED. PUBLIC HEARINGS AGENDA PUBLIC HEARINGS 400. Community Development Department—Planning Division The Office Of The City Attorney And Staff Request That The Land Planning Agency Review And Provide A Recommendation To The City Commission Regarding A Proposed Ordinance To Extend For An Additional 270 Days The Moratorium Prohibiting Any And All Medical Cannabis Activities In Winter Springs. (Ordinance 2017-10) Assistant City Attorney Kristen Eick presented the Agenda Item and gave an overview of the Moratorium and its origin, and commented on the evolution of the law regarding medical cannabis as well as the activities of the Legislature, the Department of Health, and the federal government. On a related note, Assistant City Attorney Eick stated, "Because of the continuing uncertainty regarding the law and what Bill will come out of the Legislature and what rule making will occur with the Department of Health, the City Commission requested that we present this Board with an Ordinance to extend the Moratorium for an additional 270 days." CITY OF WINTER SPRINGS,FLORIDA MINUTES PLANNING AND ZONING BOARD/LOCAL PLANNING AGENCY REGULAR MEETING-MAY 3,2017 PAGE 3 OF 4 Assistant City Attorney Eick commented briefly on the Legislature and recent activity on bills related medical cannabis as well as the Department of Health's rulemaking authorities as stipulated in Amendment 2. With further comments, Assistant City Attorney Eick pointed out, "The Board should, when considering proposed development regulations, look at their consistency with the Comprehensive Plan, and I would note that `Goal 1' of the Land Use Element asks that we ensure that the character, magnitude, and location of all Land Uses provide a system for orderly growth and development. I think the idea here with the Moratorium is to ensure that we study what the — law will be with respect to medical cannabis and then craft an Ordinance that corresponds with that and provides for orderly growth of these kinds of facilities, if at all." Discussion was followed by comments on the terminology of both treatment centers and dispensaries. Board Member Kok Wan Mah inquired if another extension to the Moratorium would be necessary. Assistant City Attorney Eick confirmed, "The Moratorium — the original and the extension Ordinance — directs Staff to investigate and study the effect of medical cannabis activities in the City during the Moratorium period. So, I think the idea would be to look at that during that period and then bring an Ordinance to the Board before the extension expires." Chairperson Henderson opened "Public Input". No one spoke. Chairperson Henderson closed "Public Input". REGARDING AGENDA ITEM 11400" AND ORDINANCE 2017-10, "I WOULD MOVE TO APPROVE." MOTION BY CHAIRPERSON HENDERSON. SECONDED BY BOARD MEMBER PHILLIPS. DISCUSSION. VOTE: BOARD MEMBER PHILLIPS: AYE CHAIRPERSON HENDERSON: AYE BOARD MEMBER MAH: AYE MOTION CARRIED. Mr. Brian Fields, Director, Community Development Department shared some information on a bald eagle's nest and referenced a map of the nest's location. The eagles have fledged which means they can sustain flight and leave the nest which is essentially the completion of the nesting season for this nest. And construction activity within kind of the critical zone—which is the 660' radius which is the yellow line — can continue; [Florida] Fish and Wildlife [Conservation Commission] has released that."
