REQUEST:
The Community Development Department requests the City Commission approve the
Seven Oaks Three replat and authorize the replat to be recorded.
SYNOPSIS:
Seven Oaks is a 138 -unit single- family residential subdivision by Meritage Homes located
on the south side of Shepard Road, north of Florida Avenue, and east of Boat Lake. A plat
for the subdivision was approved by the City Commission in November 2013 and the
subdivision is substantially built out. This item is for a replat of two lots adjacent to Boat
Lake.

Shepard Road, north of Florida Avenue, and east of Boat Lake. Final Engineering
for Seven Oaks was approved by the City Commission at the August 26, 2013 Commission
meeting and a plat for the subdivision was approved at the November 18, 2013 City
Commission meeting. Home construction started in May 2014 and is now substantially

RECOMMENDATION:
Staff recommends the City Commission approve the Seven Oaks Three replat, and
authorize the City Manager and City Attorney to prepare and execute any and all applicable
documents.

Property Description
A parcel of land being a portion of Lot 15 of ENTZMINGER FARMS, ADDITION
N0. 3, a and in Plat Book 6, Page 27, Public Records of Seminole
County, Florida and Lots 10 and 11 of SEVEN OAKS, a corded in Plat Book
77, Pages 85 through 91, Public Records of Seminole County, Florida; all
lying in Section 33, Township 20 South, Range 30 East, Seminole County,
Florida and being more particularly described as follows:
BEGIN at the Southeast c of Lot 10 of SEVEN OAKS, a corded in Plat
Book 77, Pages 85 through n91, Public Records of Seminole County, Florida;
thence North 85 °13'36" West, along the South line of Lot 10 of sold SEVEN
OAKS, a distance of 130.00 feet to the Southwest corner of said Lot 10;
thence continue North 85 °13'38" West, along the Westerly extension of the

2. All lot lines are radial, unless otherwise noted as not radial (N.R.)
3. All platted utility ease ents shall also be e se ents for the
construction, installation, and maintenance for all utilities; provided,
however, no c nstruction, installation, maintenance, and
operation shall interfere with the facilities and services of any other
utility. In the event a cable television company damages the facilities
of a public utility, it shall be solely responsible for the damages.
This section shall not apply to those easements granted to or
obtained by a particular electric, telephone, n gas, o other public
utility. Such construction, installation, maintenance, and operation
shall comply with the National Electrical Safety Code as adopted by
the Florida Public Service Commission.
4. Within the Upland Preservation Area, as shown on lots 10 and 11,
existing trees (the "Protected Trees ") may not be removed unless the
City arborist authorizes their removal and any applicable City permit
is obtained for such removal. In no way shall the Upland Preservation
Area limit the use of the rear yards of Lots 10 and 11 except as
required to save and preserve Protected Trees. Accordingly, pruning of
Protected Trees is permitted, as is clearing of undergrowth and
underbrush; however, no filling, grading or other clearing may be
conducted within the Upland Preservation Area.
5. This replat adds additional property owned by Meritage Homes of
Florida, Inc. to Lot 10 (owned by Thomas Rinne and Debra Rinne) and
Lot 11 (owned by Sherr Arief and Cherry Ibrahim), SEVEN OAKS, as
recorded in Plat Book 77, Pages 85 through 91, Public Records of
Seminole County, Florida. The conveyance of the additional property to
the Owners of Lots 10 and 11 will be by separate deed. The new
boundaries of Lots 10 and 11 are legally described and depicted on
this replat.
6. Each Owner of Property covered by this replat consents to the
terms and conditions of this replat and the recording of this replat in
the Public Records of Seminole County, Florida.
NOTICE: This plat, as recorded in its graphic form, is the official depiction
of the subdivided lands described herein and will in no circumstances be
supplanted in authority by any other graphic of digital form of the plat.
There may be additional restrictions that are not recorded on
this plat that may be found in the public records of this county.
