REQUEST: The Community Development Department—Planning Division requests that the Local
Planning Agency/Planning& Zoning Board hold a Public Hearing to consider: 1)Preliminary/Final
Engineering Plan, and 2) Aesthetic Review for Red Bug Self Storage, located on the west side of
Dovera Drive, south of the Amberly subdivision.
SYNOPSIS: The City of Winter Springs Community Development Department-Planning Division
has received an application for a Preliminary/Final Engineering Plan and Aesthetic Review for Red
Bug Self Storage,which upon completion will consist of one,three-story climate controlled building,
and three, single-story non-climate controlled self-storage buildings. The subj ect property is located
within a portion of the Oviedo Marketplace Development of Regional Impact(DRI)that is in the City
of Winter Springs, and is subj ect to the terms and conditions of the Oviedo Marketplace Parcel 14B
Implementation Agreement, which permits the development of up to 100,000 square feet of a low
intensity, non-industrial storage facility on the subj ect property.

DISCUS SION:
Preliminary/Final Engineering Plan
The City of Winter Springs Community Development Department-Planning Division has received an
application for a Preliminary/Final Engineering Plan and Aesthetic Review for Red Bug Self Storage,
which upon completion will consist of one,three-story climate controlled building, and three, single-
story non-climate controlled self-storage buildings. The subj ect property is located within a portion of
the Oviedo Marketplace Development of Regional Impact(DR�that is in the City of Winter Springs.
In 2009,the City of Winter Springs and The Viera Company entered into an agreement which permits
the development of up to 100,000 square feet of a low intensity, non-industrial storage facility on the
subj ect property.
The Preliminary/Final Engineering Plan details the construction of one,three-story climate controlled
building, and three, single-story non-climate controlled self-storage buildings on a 2.54 acre property.
Of the 2.54 acres, 1.8 acres will consist of impervious surfaces and 0.8 acres will consist of open
space. The three story, climate controlled structure will be approximately 91,092 square feet in area;
and the three, single-story,non-climate controlled buildings will range from 2,100 to 2,400 square feet
in area. In addition, a 900 square foot office and associated 900 square foot structure will be provided
on site. A total of 99,792 square feet of floor area will be constructed on site. Access to the site will be
provided via Dovera Drive. Three parking spaces and one handicap parking space will be provided on
site to accommodate the use. A 16-foot cross-access drive aisle will be provided to connect the site to
the property to the south which has an existing parking lot that serves the adj acent YMCA property.
Aesthetic Review
The attached Aesthetic Review package includes all of the submittal requirements for aesthetic
review as set forth in Section 9-600 through 9-607 and include the following (a) a site plan; (b)
elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all
walls, fences, and other accessory structures and the indication of height and their associated
materials; (d)elevation of proposed exterior permanent signs or other constructed elements other than
habitable space, if any, (e)illustrations of materials, texture, and colors to be used on all buildings,
accessory structures, exterior signs; and (f) other architectural and engineering data as may be
required. The procedures for review and approval are set forth in Section 9-603.

The City Commission may approve, approve with conditions,or disapprove the application only after
consideration of whether the following criteria have been satisfied:
(1) The plans and specifications of the proposed proj ect indicate that the setting landscaping
proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are
coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural
character of the community.
The architectural elevations for the three-story climate controlled building and the office
building includes architectural design elements such as CMU(concrete masonry unit),painted
stucco finish, parapets, recessed bands, horizontal E.LF.S. bands, and alternating color
patterns. The plans and specifications of the proposed project indicate that the setting,
proportions,materials,colors,textures,scale,unity,balance,rhythm,contrast,and simplicity
are coordinated in a harmonious manner relevant to the surrounding area.
(2) The plans for the proposed proj ect are in harmony with any future development which has been
formally approved by the City within the surrounding area.
The design of the proposed buildings is in harmony with the surrounding developments in the
area.
(3)The plans for the proposed proj ect are not excessively similar or dissimilar to any other building,
structure or sign which is either fully constructed,permitted but not fully constructed, or included on
the same permit application,and facing upon the same or intersecting street within five hundred(500)
feet of the proposed site,with respect to one or more of the following features of exterior design and
appearance:
A. Front or side elevations,
B. Size and arrangement of elevation facing the street, including reverse arrangement,
C. Other significant features of design such as,but not limited to: materials,roof line,hardscape
improvements, and height or design elements.
The design of the proposed buildings is consistent with the architectural styles exhibited in the
surrounding area. This project represents a positive addition to the City of Winter Springs.
Significant design features include CMU (concrete masonry unit), painted stucco finish,
parapets, recessed bands, horizontal E.LF.S. bands, and alternating color patterns are
provided.
(4) The plans for the proposed proj ect are in harmony with, or significantly enhance,the established
character of other buildings, structures or signs in the surrounding area with respect to architectural
specifications and design features deemed significant based upon commonly accepted architectural
principles of the local community.
The proposed project is complementary with the established character of other buildings,
structures or signs in the surrounding area with respect to architectural specifications and

the local community. The proposed project enhances the character and overall aesthetics of
the site and the surrounding area. The City of Winter Springs is comprised of diverse
architectural styles and,therefore,the proposed project represents a positive addition to this
area of the City. The architectural style also complements the existing office buildings along
Red Bug Road and the buildings within the Oviedo Marketplace mall area.
(5)The proposed proj ect is consistent and compatible with the intent and purpose of this Article,the
Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center
guidelines, SR 434 design specifications) and other applicable federal state or local laws.
The proposed project is consistent and compatible with the Comprehensive Plan and the design
specifications and architectural styles that are provided within the surrounding area.The final
architectural plans will be reviewed for compliance with all building code criteria.
(6) The proposed proj ect has incorporated significant architectural enhancements such as concrete
masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers,
porches, arches,fountains,planting areas, display windows,and other distinctive design detailing and
promoting the character of the community.
The project has incorporated a number of features such as CMU (concrete masonry unit),
painted stucco finish,parapets,recessed bands,horizontal E.LF.S.bands,and alternating color
patterns,and provides distinctive design details that promote the character of the City of Winter
Springs.
FISCAL IMPACT:
Approval of the Final Engineering Plan and Aesthetic Review allows the subject property to be
developed into a low intensity, non-industrial storage facility.Development of the subj ect property is
anticipated to provide an increase to the City's taxable value. The potential tax revenue of the
proposed project is as follows:
• 99,792 square feet of commercial buildings = $4,000,000 assessed tax value
o $4,000,000/1000 =4000
o $4000.00 x(2.4300) _ $9720.00
o $9720 (less the 4% statutory discount) _ $9331.00 tax revenue
COMMUNICATION EFFORTS:
The Meeting Agenda and this Agenda Item have been forwarded to the Planning and Zoning Board
members and are available on the City's Website,LaserFiche, and the City's Server. The Agenda has
been forwarded to the Mayor and City Commission; City Manager; and City Attorney/Staff.
Additionally, the Meeting Agenda has been sent to media/press representatives, all Homeowner's
Associations on file with the City,all individuals who have requested Agenda information,Department
Directors; and also posted outside City Hall; posted inside City Hall with additional copies available
for the general public.

STAFF RECOMMENDATION:
Staff recommends that the Local Planning Agency/Planning & Zoning Board forward a
recommendation of approval to the City Commission for: 1)Preliminary/Final Engineering Plan, and

storage facility!mini-warehouse dealing primarily with the onsite rental or leasing of secure sgace to
the general public (i.e., rooms, compartments, lockers, containers, or outdoor space) where the
g�i ral public can store and retrieve their personal beIongings; and
WIiEREAS,the City and Developer desire to memorialize their mutual understanding and
ment as�Q what kind of storage facility/mini-warehouse would constitute a"RetaillOfFice"
elop tlfn the Property consistent with the terms of the Developrnent Order;and
S, the City finds that a low-intensity, non-industria[ storage facility ! mini-
wareho as further defined herein,is consistent with the Property's development designation
of"Retail' set fo the Develogment Order and further,that such use�s comglimentary to and
compatible rvit t ther uses allowed on the Property pursuant to the Development Order and
with existing dev ' cent to the Property;and _
WI�REAS, t ' any storage facility 1 mini-warehouse now or hereafler
constructed on the Property i piementary to and compatible with both the other uses allowed on
the Property pursuant to the elop Order and with existing development adjacent to the

valuable considerations,the receipt and sufticiency of which re ledged by the City,
the parties hereto agree as follows:

2. Authoritv. Ttiis Agreement is entered into pursuant to the Flori cipal Home
Rule Powers Act.

Developer shall develop and utziize up to 100,000 squaze feet of the Property as a low-intensity,non-
industrial storage facility / rt�ni-warehousing use pursuant to the following limitations and
conditions:

A. Developer agrees ti�at any storage facility / mini-warehousing use on the
Property shaIl be limited to the leasing or renting of enclosed, secure space onsite to the
gener ublic(i.e.,rooms,compartments,lockers,or containers,)where the generaj public
c t e and retrieve their personal belongings. 7'he use of the rented or leased storage
e retail-like store fronts from which goods and/or services are so�icited for sale to the
e blic is strictly prohibited.
B. r purposes of preserving the Property's low-intensity, non-industrial
charac#e o 1 wing high-intensity, industrial uses shall be prohibited on the Property:
outside st ind; fleet and dispatch yards; bulk storage; other lcinds of storage
yards of ei le ardous or non-flammable/non-hazardous materials; cold .
storage and froz rs;lumber,bailding and home improvements supply storage;
and merchandise wa;r sing and storage facilities which handle goods in containers,such
as boxes, barrels,an rums ' g e�uipment,such as forklifts,pallets,and racks.
C. Retail sales associated with the principal storage faciIity / mini-
warehausing use (such as bo s, ta other storage supplies) is permitted an the
Property,provided that the retail sale e�i ted to one(1)location on the Property in close
proximity to the Property's entranc illary, secondary and incidental to the
principle storage facility/mini-warehousi us

ordinances and reguIations of the City(including, but not rte , th ' Land Development
Reg�lations)which are applicable to the development af the rty
6. Representations of tbe Parties. The City and De� e ach represent and
warrant to ihe other that it has the power and authority to execute,deli the terms and
pravisions of this Agreement and has taken all necessary action to authari e 'c� livery
and performance of this Agreement. This Agreement will,when duty execute de ed by the
City and Developer and recorded �n the Public Records of 5eeninole County, constitute a
legal, valid and binding obligation enforceable against the parties hereto and Pro in

l6. City's Po�ice Power. Developer agrees and acknowledges that the City hereby
reserves all police powers granted to the City by law. In no way shall this Agreement be construed as
the City bargaining away or surfendering its police powers.

l7. Xnter retatian. The parties hereby agree and acknowledge that they have both
' ated equally in the drafting of this Agreement and no pariy shall be favore� or disfavored
ing the j,gterpretation to this Agreement in the event of a dispute between the parties.

Third-Party Ri�hts. This Agreement is not a third-pariy beneficiary contract and
shall i y whatsoever create any rights on behalf of any third party.
19. S ec' � Performance. Strict compliance shall be required with each and every
pro�ision ofthi e t. The parties agree that failure to perform the obligations provided by
ttiis Agreement s ' eparable damage and that specific performance of these obligations
may be obtained by t n e ity. � � _
20. Attorne 's e connection with any arbitration or litigation arising out of this
Agreement, the prevailing p shall ntitled to recover reasonable attorney's fees and costs
throug4�all appeals to the extent pe y law.
21. Development Permits, ot � ein shall limit the City's authority to grant or
deny any development permit applications o re sts subsequent to the effective date of this
Agreement. The failure of this Agreement y particular City, County, State andlor
Federal permit,condition,term or restriction shall t r e�eloper or the City of the necessity
of complying with the law governing said permi condition, ternl or restriction.
Without i�nposing any limitation an the City's police p rs, 'fiy�erves the nght to withhold,
suspend,or terminate any and all certificates of occupancy f y in unit if Developer is in
breach of any term and condition o£this Agreement.
22. Default;.U�portunitv to Cure. Should either p si declare the other party
in default of any ternl and condition of this Agreement, the non-defa ' hail provide the
defaulting party a written ❑otice of default. T'he wri�ten notice shall, a m ' , e with
particularity the nature of the default,the manner in which the default can be r onable
time period of not less than thirty(30)days in which the default must be cured �on�nay be
taken in a court of law on the basis that a breach of this Agreernent has occurred such ' as
the requirements of this paragraph have been satisfied.
23. Terminabon. The City shall have the unconditional right, but not pbligatzo , o
terminate this Agreement, without notice or penalty, if Developer fails to receive building pe '
and substantially coinmence construction of Project within�hree(3}years o£the effective date ofthus �
Agreement.In addition,the City shali have the right,but not obligation,to terminate the Agreem
if Developer permane�tly abandons constraction of the Project,provided,however,the Ciry sha

first deliver written notice and an opportunity to cure as set forth in Section 23 herein. If the City
terminates this A�eement, the City shall record a notice of termination in the public records of
