Code Enforcement Division — Police Department CASE #2016CE001864 GC4A Commercial LLC 260 East State Road 434 Winter Springs, Florida 32708 City Code 13 -2.(b) Junk And Debris Inspector: Captain Chris Deisler Captain Deisler introduced the Case and submitted into Evidence, "'WS-l' and testified, "Last year in April time we brought this Case before you, you'll see a couple photographs in a few minutes regarding extensive debris, garbage, unsightly material. More or less, the back of the shopping center is used as a dumping ground at times. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - JULY 26, 2016 PAGE 3 OF 13 It's not frequently maintained by the management. Household trash, piles of broken glass — wooden pallets, old concrete, and so forth. At that time, you found the Respondent in Violation, your Order called for a two hundred and fifty dollars ($250.00) a day Fine. The property was eventually cleaned up prior to a Non - Compliance Hearing so it never came back before you for that, but, the Violation has resurfaced once again. There are some photographs that follow. This Notice of Violation and Notice of this Board Hearing were mailed Certified to the Owners July 6th of this year and our bulletin board out front and the property was also Posted on — July 81h of this year. The letter was received July I It1'." Captain Deisler referred to photographs from "WS -1" with additional comments. Concluding, Captain Deisler stated, "In closing, I recommend the Board impose a penalty on the property consistent with your Order from last year." Additional remarks about the location of the property and the most recent date of the Violation ensued. Captain Deisler stated, "This is something I noticed — I see the photographs I took on the 30th of June so I'll go with June 30th, it does stand in exactly the same condition as the day I wrote it up." Code Enforcement Division — Police Department CASE #2016CE001456 James E. Lawrence Trustee FBO 125 -131 Cory Lane Winter Springs, Florida 32708 City Code 13 -2.(a) Unsightly Matter City Code 17-1. Obstructing Streets And Sidewalks; Permit Required. Inspector: Captain Chris Deisler Introducing this Case, Captain Deisler submitted into Evidence "WS -1 ". Continuing, Captain Deisler testified, "A bit of background on these Cases and I'll repeat it for each one if it's necessary but you'll notice that there are a bunch of Cases on the Agenda for the same street. The reason why these came to light were because of personal observation by all the Officers present here and some residents who were having a problem with loose garbage being left out by the curbs on non pick -up days which was resulting in the scattering of that garbage by the vultures, the other critters that come around and tear garbage up. As it pertains to this particular property, there was loose trash and debris scattered throughout the property and the City right -of -way. Tenants are frequently placing their trash can totes out for pick up ahead of and following pick up days where they'll often be out there for weeks at a time, they're never brought back. Trash pick -up for this street is Monday and Thursday. As I mentioned before, when this condition persists, the vultures and the other pests scatter the trash everywhere, creating a hazard for the community. The Notice of Code Violation letter was sent June 1 of this year and received June 4th of this year. The letter prescribed a correction time of June 8th of this year, that deadline was not met, the conditions persisted and the trash cans were still left curbside; loose trash was everywhere. To date, the Owner has not contacted me, however, I believe the young lady in the back of the room is in some way tied to the property management company." Next, Captain Deisler referenced Code of Ordinances 17 -1. and referred to photographs from "WS -1" with additional comments. Discussion ensued on where to store garbage totes and loose trash. Captain Deisler continued, "The trash that you saw scattered along the public areas was removed by City crews shortly following the pictures being taken. Of course that stuff was not left out there. We recommend that the Owner be given until 8/8 of this year to correct the Violation or a Fine of two hundred and fifty dollars ($250.00) a day be imposed, due to the health welfare issue created by these conditions." Lawrence Trustee FBO 124 -130 Cory Lane Winter Springs, Florida 32708 City Code 13 -2.(a) Unsightly Matter Inspector: Captain Chris Deisler First, Captain Deisler introduced the Case and submitted into Evidence, "WS -1 ". Next, Captain Deisler testified, "On May 31" I noticed the property had loose trash and debris scattered throughout the property and City right -of -way, mostly the same issue as you saw a second ago. The condition persisted until I opened the Case June 2" d, of course as I mentioned, when the trash is not cleaned up the vultures and pests just scatter it everywhere. As I mentioned, to date the Owner has not contacted me however, again, the young lady in the back of the room is also here for this building. The Notice of Code Board Hearing was mailed July 11th, 2016, was also Posted at the property and City Hall July 12th of this year." Photographs from "WS -1" were referred to by Captain Deisler, with additional remarks. Captain Deisler then suggested, "I recommend the Owner be given until 8/8/16 to correct the Violations or a two hundred and fifty dollars ($250.00) a day Fine be imposed, due to the health welfare issue created by the conditions." Inspector: Captain Chris Deisler Captain Deisler introduced the Case and submitted into Evidence, "WS -1 ". CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - JULY 26, 2016 PAGE 7 OF 13 Continuing, Captain Deisler testified, "Again, Board Members, May 31St, 2016, this property also had loose trash and debris scattered throughout; the trash toters also being left curbside in the City right -of -way by the tenants on non pick -up days. Same issue with the trash not being cleaned up and the pests just scattering it all over the place. Code Violation letter was sent June 1 of this year, it was received June 4th. The letter prescribed a correction time of June 8th. That deadline was not met, conditions persisted, loose trash was present. To date, the Owner has not contacted me. Code Board Hearing Notice was mailed July l Ith and Posted at City Hall and on the property July 121h " Next, Captain Deisler referred to photographs from "WS -1" with additional comments. Concluding, Captain Deisler stated, "I checked this property tonight before the Hearing, I checked them all actually. The Violations are corrected but I would just like a Finding of Fact in case I have to bring them back." Note: The Respondent was present. "I MOVE TO FIND THE RESPONDENT VIOLATED THE CITY CODE AND FAILED TO CORRECT THE VIOLATION BY THE TIME SPECIFIED FOR CORRECTION BY THE CODE INSPECTOR, THAT THE VIOLATION IS CURRENTLY CORRECTED, AND THAT NO FINE BE IMPOSED. ANY SUBSEQUENT VIOLATION OF THE SAME CITY CODE PROVISIONS BY RESPONDENT WITHIN FIVE (5) YEARS FROM THE DATE OF THIS ORDER SHALL BE CONSIDERED A REPEAT VIOLATION, FOR WHICH A FINE OF UP TO FIVE HUNDRED DOLLARS ($500.00) PER DAY MAY BE IMPOSED." Obstructing Streets And Sidewalks; Permit Required. Inspector: Captain Chris Deisler Beginning, Captain Deisler introduced the Case and submitted into Evidence, "WS -1" and testified, "Much the same — June 3rd property had loose trash and debris scattered throughout, trash toters were being left curbside on City right -of -ways by tenants which causes a hazard and obstruction. When it's not cleaned up, the trash just blows everywhere and makes a mess. Notice of Code Violation letter was sent on June 3rd, 2016 prescribing a correction time of June 8th. That deadline was not met, conditions persisted, loose trash was present. To date, the Owner has not contacted me. I would like to point out however, the young lady at the front row with the red dress on does represent the property management company of the Owner and she is here should you need to speak with her. The Notice of Code Board Hearing was mailed July 11th of this year. It was posted at the property and City Hall July 12th of this year." Captain Deisler referred to photographs from "WS -1" with further remarks. Lastly, Captain Deisler stated, "I recommend the Owner be given until 8/8/16 to correct the Violation or a Fine of two hundred and fifty dollars ($250.00) a day be imposed due to the health welfare issue created by these conditions." Assistant to the City Clerk Ghersetich swore in the next individual to provide Testimony during tonight's Meeting. Ms. Kathryn Craver, Florida Realty Investments, 3451 Technological Avenue, Suite 11, Orlando: testified, "The Owner did contact me about this, so I did actually make sure we went out to the property, as of today. As he's explaining to you, it is an ongoing thing that we're trying to keep up with — at this point, I just want to kind of make sure that we try to avoid any fees or escalation if possible, but I would be personally making sure that we're following up on this on a regular basis." With additional comments, Ms. Craver continued, "There is actually space on the side of the buildings to put their containers." Further remarks about garbage totes followed. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - JULY 26, 2016 PAGE 9 OF 13 Captain Deisler added, "I would just like to remind everybody, the idea here is not to hold anyone to task that is an innocent bystander; however, there is a systematic problem out here that is often times beyond the control of the Owners of the property and we understand that. I think based upon the conversations I've had with the young lady who just spoke to you, as well as the young lady in the back of the room, that just a little bit more attention from time to time will keep this from occurring." Maintenance Of Fences Or Walls. Inspector: Code Officer Terri Guerra Code Officer Terri Guerra, Police Department, Code Enforcement Division introduced the Case and submitted into Evidence, "WS -1 ". Code Officer Guerra began, "On May 3rd, 2016, I observed the left side of the chain link fence door was falling off of its hinges. On May 25d', 2016, I went back to check the property again and there was a wooden fence also going down the side that is now falling in towards the property. The chain link fence is also still broken. The NCV (Notice of Code Violation) was Returned in the mail. July 12th, 2016 the Notice of Code Board was sent to the Owner on record Certified and also Posted at City Hall and the property. On July 16th, 2016, United States Postal Service website advised `Undeliverable as addressed'." Code Officer Guerra then referred to photographs from "WS -1" with further remarks. Furthermore, Code Officer Guerra continued, "There has been no contact from the Owner. The property is Vacant to my knowledge, I have not seen anyone there. I am recommending the Owner of the property be given until August 16'', 2016 to correct the Violation. If not corrected, a Fine of fifty dollars ($50.00) a day be imposed." Additional comments regarding ownership followed. Note: The Respondent was not present. Code Enforcement Division — Police Department CASE #2016CE000606 Louis Garcia 201 North Devon Avenue Winter Springs, Florida 32708 City Code 6 -195. Maintenance Of Fences Or Walls. Inspector: Captain Chris Deisler Captain Deisler introduced the Case and submitted into Evidence "WS-l". Captain Deisler testified, "You may recall as you see the photographs that this property had sections of fence along the side of the property, wasn't being maintained or installed per a Permit that he had received for the construction of this fence. During that meeting, the Board found the property in Violation and gave the Respondent until May 26th of this year to comply. The property stands in Non - Compliance. I think I've spoken to Mr. Garcia one (1) time, shortly after the first Hearing. I have not heard a word from him since relative to this issue. The Order you had called for a fifty dollars ($50.00) a day Fine for Non- Compliance, and as I've mentioned, little to no contact with the Owner. Notice of Non - Compliance Hearing was mailed Certified to the Owner. It was delivered to Mr. Garcia himself via Certified Mail, June 21s' of this year." With additional comments, Captain Deisler referred to photographs from "WS -1 ". Captain Deisler then concluded, "I recommend you impose a Lien on the property consistent with the original Orders from the first Hearing." Additional comments followed. Board Member Brown noted, "This will be my last meeting with all of you, and I have enjoyed it." Inspector: Captain Chris Deisler Senior Attorney Nix requested the previous Motion be clarified and stated with the appropriate date of the Board's previous Order. Further remarks on the corrective action date versus the date of the Board's previous Order. Board Member Kaprow stated, "I will retract my Second." Board Member Poe stated, "I will retract my Motion and restate it."
