HomeMy WebLinkAbout2014 02 10 Regular 600 On-Street Parking Final Report COMMISSION AGENDA Informational Consent ITEM 600 Public Hearings Regular X February 10, 2014 KS CD Regular Meeting City Manager Department REQUEST: The Police Department and the City Manager request the Commission receive information from staff concerning on-street parking regulations in the City and provide direction on whether these regulations should be modified or repealed, in whole or in part, going forward. SYNOPSIS: On February 25, 2013, the Commission adopted Resolution 2013-06 which temporarily suspended the prohibition of parking on certain roadways within the City. The temporary suspension enacted by Resolution 2013-06 was for a six month period, expiring August 25, 2013. At the August 12, 2013 meeting, the moratorium was extended for an additional six month period which will expire in mid-February. Upon or prior to expiration, the City Manager and Police Department were tasked to provide information and recommendations to the Commission regarding this issue. Such information is included herein. CONSIDERATIONS: Since 2006 when four designated areas of the city were selected to serve as trial locations to see if on-street parking could be supported, and more intensely over the last year, we have had the opportunity to assess on-street parking relative to the temporary suspension of the requirements of city ordinance Section 12-65. During this time, we have had the chance to see first-hand what, if any, potential problems would result from the moratorium and we have observed the following: Many residents still seem to be aware of where they are parking and the limitations of Regular 600 PAGE 1 OF 3-February 10,2014 some roadways to support it. We have seen situations where residents police themselves more often than not and intervention by police officers has been minimal, as there have been approximately 223 calls handled for illegal parking since early February 2013. Nearly all of these instances were for cars parked in violation of State law (against posted signage, wrong direction, etc.) or in some cases on roadways deemed "Collector" or "Arterial". In those cases, the situations were resolved quickly. Approximately 62 parking citations for various offenses still prohibited by State laws or not included in the permissions of the moratorium were issued. . After secondary consultation with members of police department supervision and Seminole County Public Safety, we have not learned of any instances where emergency vehicles were impeded by cars parked on the street. As was discussed in earlier meetings, the parking ordinances of the city have failed to evolve and no longer fit the overall needs of the community. While there has been past action by the Commission to give residents relief for parking, many areas of the city do not permit some or all of the options to be used. The creation of a Designated Parking Area (DPA) was permitted, however, most HOAs do not allow them to be built. Residents cannot park in their driveways in a manner that blocks a sidewalk or park on the city right- of-way either. With the current parking ordinance remaining in place, it is almost impossible for someone to legally park anywhere outside of a driveway or garage/carport. Thus, many residents find themselves without viable options. FISCAL IMPACT: There is no fiscal impact associated with this item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: The Police Department and the City Manager recommend the Commission choose one of the following options: 1. Adopt provisions of the current temporary moratorium as a permanent ordinance. Staff would then prepare and present said ordinance for approval at subsequent Regular 600 PAGE 2 OF 3-February 10,2014 Commission meetings. 2. Make no change to existing on-street parking prohibitions and continue to restrict residents and visitors from using the city streets for parking city-wide. 3.
