HomeMy WebLinkAbout2014 02 10 Consent 301 Starlight Baptist Church Utility Easement COMMISSION AGENDA     Informational Consent X ITEM301 Public Hearings Regular       February 10, 2014KLKL Regular MeetingCity ManagerDepartment         REQUEST: Public Works Department requesting authorization for the City Manager to execute a Utility Easement granting the Starlight Baptist Church the right to install, operate, and maintain a force main in a 15-foot wide non-exclusive easement on City property near Hayes Road and Bahama Road.   SYNOPSIS: The Starlight Baptist Church recently completed sanitary sewer improvements including a new lift station and a force main connecting to the existing City sewer main on Lancers Drive. A portion of the force main was approved by the City to extend across the City property adjacent to the church property.  The proposed utility easement provides the church rights to install, operate, and maintain a force main within the easement.  The easement has no impact on the City's use of the land.  CONSIDERATIONS: The Starlight Baptist Church is located at the northwest corner of Hayes Road and Bahama Road.  In 2011, the church completed site improvements including the installation of a new lift station and a force main extending offsite to a connection to the City sanitary sewer system in Lancers Drive.  A portion of the offsite force main was approved by the City to extend across the City property immediately adjacent to the church's west property line (see Exhibit A for location).   This agenda item authorizes the granting of a 15-foot wide non-exclusive Utility Easement to Starlight Baptist Church on the City property.  The Utility Easement grants Starlight Baptist Church the right to access the easement area to install, operate, and maintain an Consent 301 PAGE 1 OF 2 - February 10, 2014 underground sanitary force main and other incidental appurtenances.  The proposed 15-foot wide by 75-foot long easement requires Starlight Baptist Church to relocate its facilities to a new location on the City property, if required by the City, at no expense to the City.  The Underground Utility Easement Agreement is attached as Exhibit B.     FISCAL IMPACT: There is no cost to the City for the proposed Utility Easement. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   RECOMMENDATION: Staff recommends that the City Commission authorize the City Manager to execute a Utility Easement granting the Starlight Baptist Church the right to install, operate, and maintain a force main in a 15-foot wide non-exclusive easement on City property near Hayes Road and Bahama Road, and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents.  ATTACHMENTS: 1.Exhibit A - Map of Approximate Easement Location (1 page) 2.Exhibit B - Underground Utility Easement Agreement (7 pages) Consent 301 PAGE 2 OF 2 - February 10, 2014 EXHIBITB
