HomeMy WebLinkAbout2014 02 10 Consent 300 Offices at Winding Hollow COMMISSION AGENDA     Informational Consent X ITEM300 Public Hearings Regular       February 10, 2014KLKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requesting the City Commission: 1) validate the Staff recommendation finding the Offices at Winding Hollow Phase 1 sitework to be built in substantial accordance with the Final Engineering plans, subject to satisfactory completion of the remaining open punchlist items; 2) accept the public infrastructure for ownership and maintenance; 3) authorize reimbursement to the builder in the amount of $9,060 for oversizing of the new reclaimed water main installed as part of the project; and 4) require payment of the fine for unauthorized tree removals in the amount of $12,700 prior to issuance of any Certificates of Completion.   SYNOPSIS: Sitework for the Offices at Winding Hollow Phase 1 is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official.  This agenda item also accepts the public infrastructure for ownership and maintenance and authorizes reimbursement for the oversizing of the reclaimed water main installed along Winding Hollow Boulevard.  CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as Consent 300 PAGE 1 OF 3 - February 10, 2014 withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   (d)  … Certificates of occupancy will not be issued until all improvements are accepted by the city commission.   The Offices at Winding Hollow is a professional office development consisting of six (6) single-story buildings having a total of 19,230 square feet of office space. The 2.9 acre property is located on the west side of Winding Hollow Boulevard just south of S.R. 434.  Phase 1 consists of the first four (4) buildings at the southern end of the site having a combined total of 12,238 square feet of office space.     The Final Engineering Plans were approved by the City Commission at the April 22, 2013 City Commission meeting.  Sitework commenced in June 2013 and the four buildings in Phase 1 are nearly complete at this time.    This agenda item is for the conditional acceptance of the site improvements.  The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A.   The public infrastructure being conveyed to the City for ownership and maintenance include water, sewer, and reclaimed water mains, plus sidewalk and drainage improvements at the site entrance.    As part of the approved sitework, the builder installed a reclaimed water main along Winding Hollow Boulevard from the point of connection south of the site to the office property's northern property line, a distance of 720 feet.  The Offices at Winding Hollow project only needed a 2-inch reclaimed water main to service the property.  Staff requested the reclaimed water main be oversized to 8-inches to provide additional capacity and flexibility for future reclaimed service to properties north of the site.  The cost to oversize the reclaimed water main is $9,060.  The builder has provided the necessary documentation supporting the cost difference between the required 2-inch reclaimed water main and the oversized 8-inch main.   During site clearing, the builder failed to provide adequate tree protection of existing trees that were not designated on the approved final engineering plans to be removed.  As a result, the builder removed trees that were not authorized by the City's Arbor Permit, in violation of Section 5-18 of the City Code.  The penalty due for the tree violations is $12,700 per Section 5-14.  Staff is recommending with this agenda item that the tree penalty be required to be paid in full prior to the issuance of any Certificates of Completion. FISCAL IMPACT: The cost to oversize the reclaimed water main is $9,060 funded by the Utility Enterprise Fund. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the Consent 300 PAGE 2 OF 3 - February 10, 2014 respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors.
