REQUEST:
The Public Works Department requests the City Commission approve the Seven Oaks plat
and authorize the plat to be recorded.
SYNOPSIS:
Seven Oaks is a 138-unit single-family residential subdivision by Meritage Homes located
on the south side of Shepard Road, north of Florida Avenue, and east of Boat Lake. This
agenda item is for the approval of the plat including the dedication of public streets to the
City.

Seven Oaks is a 138-unit all single-family subdivision by Meritage Homes located south of
Shepard Road, north of Florida Avenue, and east of Boat Lake. Final Engineering
for Seven Oaks was approved by the City Commission at the August 26, 2013 Commission
meeting. Sitework construction commenced in September 2013 and the construction of the
first model unit is expected to begin within the next 60 days.

The land subject to this plat consists of a total of 35.18 acres, consisting of the following
components:
138 single-family residential lots
Public right-of-way dedications for all streets
Common area tracts to be owned by the Homeowner’s Association
Easements for items such as drainage, utilities, walls, landscaping, and sidewalks
Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various
sections) and Chapter 177, Florida Statutes. Chapter 177, Florida Statutes require that the
plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the
land to be subdivided, by the professional surveyor and mapper of record, and by the
independent professional surveyor and mapper who reviews the plat for consistency with
Chapter 177, Florida Statutes.
Before the plat can be recorded, per Section 9-76 of the City Code Meritage Homes is
required to provide a bond, letter of credit, or cash deposit in favor of the City in an amount
equal to the construction cost of the site improvements that have not been completed.
During the City Commission's review of the Final Engineering plans for Seven Oaks, there
was some discussion about the 175-foot wide Florida Power easement that separates Seven
Oaks from the Wildwood subdivision. Specifically, concerns were
raised about maintenance of the 175-foot power easement after Seven Oaks is built.
Meritage Homes has control of the adjacent power easement property and has agreed to
convey this land to the Seven Oaks Homeowner's Association. Since the adjacent power
easement property was not initially part of the Seven Oaks development property, it is not
part of the plat submitted under this agenda item. Staff is recommending that the
conveyance of the power easement property (parcel # 28-20-30-5DL-0000-0001) to the
Seven Oaks Homeowner's Association be completed prior to the City
Commission's acceptance of the site improvements. The conveyance could be
accomplished by a minor modification to the plat (prior to recording) subject to a Staff
approval, or by a separate conveyance in a form acceptable to the City Attorney.
City Staff including the City’s independent surveyor, Southeastern Surveying and Mapping
Corporation, have reviewed the plat and have no outstanding review comments.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.

This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and
the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City’s Website, LaserFiche, and the City’s
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff

is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends the City Commission approve the Seven Oaks plat, subject to:
1) provision of the required bond, letter of credit, or cash deposit prior to recordation; and 2)
conveyance of the power easement property adjacent to the eastern boundary to the Seven
Oaks HOA prior to site acceptance, and authorize the City Manager and City Attorney to
prepare and execute any and all applicable documents.
