SYNOPSIS: The applicant, Meritage Homes, is requesting approval of the Final Engineering Plans and Aesthetic Review for Seven Oaks, a 138 unit single-family development located on the south side of Shepard Road, north of Florida Avenue, east of Boat Lake (see Attachment A - Location Map). The Final Engineering Plans detail the construction of the infrastructure in the development (see Attachment B - Final Engineering Plans for Seven Oaks). The purpose of the Aesthetic Review is to encourage creative, effective, and flexible architectural standards and cohesive community development consistent with the intent and purpose of Article XI-Minimum Community Appearance and Aesthetic Review Standards. Lam: None APPLICABLE LAW&, PUBLIC POLICY Home Rule Powers Florida Statutes City of Winter Springs Comprehensive Plan City of Winter Springs Code of Ordinances Developer's Agreement between the City of Winter Springs and The Keewin Real Property Company CHRONOLOGY The subject property has a lengthy development history which is defined below: • June 12, 2006 — City Commission adopted a change of Future Land Use from "Industrial" to"Medium Density Residential" on the Dittmer parcels. • June 14, 2006 — A Developer's Agreement between the City of Winter Springs and Keewin Real Property Company was made and executed in reference to a proposed townhome/condominium project at said location . • July 24, 2006 — Adoption of the change of Future Land Use from "Industrial" to Medium Density Residential" on the Elesa and Florida Avenue parcels. • June 23, 2007— City Commission approved the concept plan, subject to conditions. Public Hearings 500 PAGE 2 OF 7-August 26,2013 • December 10, 2007 — City Commission unanimously approved a PUD Master Plan, Preliminary Plan, and Preliminary Engineering/Subdivision Plan for a 338 unit development known as Winter Place. • May 13, 2013 — City Commission unanimously approved a newly proposed PUD Master Plan and the Preliminary Subdivision Plan for the Seven Oaks development. • August 14, 2013 -Planning and Zoning Board unanimously recommended approval for both the Final Engineering and Aesthetic Review for Seven Oaks (see Attachment C - Draft/Unapproved Minutes from Planning and Zoning/LPA — August 14, 2013) . DISCUSSION: The proposed Final Engineering Plan is in substantial compliance with both the Preliminary Subdivision Plan and PUD Master Plan that were approved by the City Commission on May 13, 2013. The Plan proposes access to the development at one point on Shepard Drive and another on Florida Avenue. General data for the Final Engineering Plans include the following: Land Use: Medium Density Residential (3.6 du/ac— 9 du/ac) Existing Zoning: Planned Unit Development(PUD) Total Number of Acres: 37.27 Gross Acres Commercial Acreage: 2.09 Acres Net Acreage: 35.18 Acres Total Number of Units: 138 Single-Family Units Density: 3.92 DU/Acre Open Space: 21.42 Acres Green Space/Park Area: 19.23 Acres Wetland/Conservation: 0.74 Acres Retention Pond: 1.45 Acres Building Setbacks: Public Hearings 500 PAGE 3 OF 7-August 26,2013 Front: 25' Rear: 10' Side: 5' Side Street: 10' Project Boundary: 20' Minimum Lot Width: 50' Minimum Lot Depth: 110' Maximum Building Height: 3 stories The proposed single-family units are one (1) and two (2) stories in height and have varied architectural details. In addition to approval of the Final Engineering Plans, the applicant is also requesting approval of the Aesthetic Review package for Seven Oaks. (see Attachment D - Seven Oaks Aesthetic Review Package). The submittal requirements for aesthetic review are set forth in Section 9-600 through 9-607 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9-603. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The Aesthetic Review is specifically for a 138 unit single-family development and associated amenities located on the south side of Shepard Road, north of Florida Avenue, east of Boat Lake. The proposed single-family units are one (1) and two (2) stories in height and vary in architectural patterns. The proposed units will be an asset to the surrounding area as well as the new community. (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. The proposed single-family elevations are in harmony with and, for many areas, represents an enhancement to the architecture exhibited within the surrounding areas. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or Public Hearings 500 PAGE 4 OF 7-August 26,2013 more of the following features of exterior design and appearance: A. Front or side elevations, B. Size and arrangement of elevation facing the street, including reverse arrangement, C. Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed single-family residences and associated amenity feature elevations don't appear excessively similar or dissimilar to the other structures in the immediate area. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. The proposed aesthetic review package details a single-family development that truly enhances the character and overall aesthetics of the surrounding area. The local community is composed of an existing commercial, industrial and multi-family development. The proposed aesthetic review package includes following: A. Single Family Home Construction/Finishes Traditionally most of the homes constructed are two-story, first floor being block and second story wood frame construction. Exterior finish pallet is very diverse ranging from multiple variations of stacked stone, brick and stucco finishes and they have also included several variations of siding and clapboard and trim these are very popular with the Meritage product type. These exterior materials are also accented with brick pavers located in selective areas of walks and driveways. The roof material range from architectural dimensional shingles to several variations of concrete tile roof finishes. The color patterns for the proposed homes are within the earth tone color scheme, a tone that reflects the earthy tones found in a lot of the finish materials used on the exterior accents to define specific elevations. R Pool and Cabana Construction/Finishes This amenity will be reflective of the design elements used in the proposed homes. Because of the historic streetscaping theme recently completed by the city of Winter Springs, Meritage has selected to use a concrete block wall structure with brick on the bottom half of the structure with clapboard siding above and architectural dimensional shingles. Matching concrete pavers will be consistent with the cabana and the pool deck area. The color scheme for this building will also fall within the earth tone color scheme. C. Entry Signage The plans highlight an ten (10) foot high brick entrance sign along Shepard Road. The sign will incorporate a leaf medallion and brick caps in order to accentuate the proposed entry feature which is also consistent with the recently completed Shepard Road streetscape.. D. Dedication Plaque Public Hearings 500 PAGE 5 OF 7-August 26,2013 The plans highlight an eight (8) foot high dedication plaque within Tract D, located just west of the proposed pool/cabana parking lot. E. The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines, SR 434 design specifications) and other applicable federal state or local laws. The proposed project is consistent and compatible with the Comprehensive Plan and other applicable design guidelines. The final architectural plans will be reviewed for compliance with all building code criteria and approved aesthetic review guidelines. F. The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. The proposed aesthetic review package details a single-family development that truly enhances the character and overall aesthetics of the surrounding area. The local community is composed of an existing commercial, industrial and multi-family development. Specific design elements were noted within response to question number four (4) above . FINDINGS: 1. The proposed single-family elevations are consistent with the Aesthetic Review requirements prescribed in the City Code of Ordinances. 2. The single-family elevations include detailing and attention adding to their appearance and the quality of the development. 3. The proposed single-family elevations utilizes colors and materials that complement the adjacent commercial, industrial, and multi-family developments in the surrounding area. 4. The proposed development is located within the City of Winter Springs: it has a Medium Density Residential Future Land Use designation and is located within a Planned Unit Development(PUD) zoning district. 5. The proposed Final Engineering Plan is in substantial compliance with both the Preliminary Subdivision Plan and PUD Master Plan that were approved by the City Commission on May 13, 2013. FISCAL IMPACT: The proposed Final Engineering Plan for Seven Oaks lays the groundwork for the development of 138 single-family homes and 2.09 acres of future commercial property fronting Shepard Road. In addition, a yellow sign noting the date and time of the public hearing has been erected on the property. And at this point, the majority of the comments that you have as part of your August Ist , (2013) DRC (Development Review Committee) Letter, those have been addressed and at this point we have minimal geotechnical type issues." Discusson ensued about the boundaries and power on easement. Mr. David Evans, Evans Engineering, 719 Erma Avenue, Orlando Florida: explained that the bumper with respect to the twenty (20) foot space is done so according to West boundary, south boundary and the perimeter boundaries which back up to the Easement. Further comments about wildlife running out once the dirt starts being moved and the screen wall being placed on top of the mound. Mr. Evans explained that the plans have changed to move the screen wall from the top of a mound and make it more of a stepped wall. There will be a wall on the boundary of the property which is higher than the development and extends up six (6) feet high. There will be a second wall going towards the residential area that steps down the property four (4) feet making the net screen wall that is ten (10) feet tall. The screen wall will be constructed of pre-cast colored concrete walls that are flat on both sides. City Engineer 1. Sheet 7. Delete the double yellow center line at the south entrance. This is not required or recommended at this location. 2. Landscape Plans. Please remove the live oak trees along the street frontage of lots 97, 98, and the monument/common area, as they will potentially block the sight distance for both vehicles and pedestrians going to and from the pool area. A different type of tree may be considered at these locations. 3. Provide a detail showing the required striping modifications on Shepard Road westbound approaching 17-92 (per TPD's latest traffic analysis). At the left turn storage lane, relocate the existing yellow gore area east as far as possible while maintaining a minimum lane width of 9- feet. Provide additional left turn arrows as needed. 4. Sheet 8. In the Shepard Road offsite detail, please call for the entire width of Shepard Road to be milled and resurfaced from the nose of the relocated median to the end of the curb return on the western side of the new intersection. The current plans would create an asphalt patch within the new intersection. 5. Sheets 9 and 10 and Road Profile Sheets. Overall, the sanitary sewer system still appears to be unnecessarily deep in many places. Please review this with City staff and shallow up the system where possible. Drop manholes can be used where necessary. 6. Sheets 11 and 12. The City does not allow the use of roadway underdrains to be used to protect roadway base materials from groundwater impacts. The streets must be elevated such that the bottom of the roadway base is at least 12-inches above the SHGWT, as determined by the geotechnical engineer. The City Code states underdrains "may be required;" however, it is our practice that underdrains not be required by properly elevating roadways above the SHGWT. The City has experienced failures of roadway underdrains, often due to causes beyond the City's control, and this has required streets to be resurfaced or in some cases completely rebuilt well before their normal schedule. Please revise the grading plans and street profiles accordingly. Underdrains may be utilized as a supplemental means of protecting the roadway base, or at isolated locations where raising the street grade is determined to be impractical. 7. Sheet 11. Provide a rip-rap pad at the Florida Avenue culvert crossing discharge. 8. Sheet 12. Previous comment #24. Provide more detail of the proposed grading at the intersection of Shepard Road and Street A. Stormwater runoff in Shepard Road currently drains Seven Oaks Final Engineering Page 1 of 2 from west to east across the proposed intersection location. Street A drains towards Shepard Road. Show how the existing runoff in Shepard Road will be addressed, without using a valley gutter. A new stormwater inlet at the northwest corner of Shepard Road and Street A, piped to STS-23, could be one solution. 9. Sheet 19. Revise detail G to show a double service line (per the City standard detail) that splits into two single services and meter boxes. 10. The landscape, hardscape, and irrigation plans were received for the first review on August 13 and these plans are still under staff review at this time.
