HomeMy WebLinkAbout2013 08 12 Regular 602 On-Street Parking Moratorium Update COMMISSION AGENDA Informational Consent ITEM 602 public Hearings g Regular X August 12, 2013 KS KB Regular Meeting City Manager Department REQUEST: The Police Department and the City Manager request the Commission receive information from the Police Department concerning on-street parking regulations in the City and provide direction on whether these regulations should be modified or repealed, in whole or in part, going forward. SYNOPSIS: On February 25, 2013, the Commission adopted Resolution 2013-06 which temporarily suspended the prohibition of parking on certain roadways within the City. The temporary suspension enacted by Resolution 2013-06 was for a six month period, expiring August 25, 2013. Upon or prior to expiration, the City Manager and Police Department were tasked to provide information and recommendations to the Commission regarding this issue. CONSIDERATIONS: Since 2006 when four designated areas of the city were selected to serve as trial locations to see if on-street parking could be supported, and more intensely over the last six months, we have had the opportunity to assess on-street parking relative to the temporary suspension of the requirements of city ordinance Section 12-65. During this time, we have had the chance to see first-hand what, if any, potential problems would result from the moratorium. As you know, the language in the moratorium closely mirrors that of the annual holiday ordinance suspension. To that end, we have observed the following: . Many residents seem to be aware of where they are parking and the limitations of some roadways to support it. We have seen situations where residents police Regular 602 PAGE 10 F 3-August 12,2013 themselves more often than not and intervention by police officers has been minimal, as there have been approximately 27 calls handled for illegal parking since early February 2013. Nearly all of these instances were on roadways deemed "Collector" or "Arterial" and the situations were resolved quickly. There has been one residence where officers were forced to write a parking citation after numerous attempts to gain voluntary compliance by meeting with the homeowner failed. Additionally, we have issued approximately 85 warnings and 19 parking citations for various offenses still prohibited by State laws or not included in the permissions of the moratorium. . After consultation with members of police department supervision and Seminole County Public Safety, we have not discovered any instances where emergency vehicles were impeded by cars parked on the street. Over time, the ordinances of the city concerning parking have failed to evolve and may no longer fit the needs of the community. We were brought here through the adoption of the Resolution mentioned earlier. While there has been action by the Commission to give residents relief for parking, the fact is many areas do not permit some or all of the options. For example, the creation of a Designated Parking Area (DPA) was permitted, however, most HOAs do not allow them to be built. The residents cannot park across a sidewalk or on the right-of-way either. With the current parking ordinance remaining in place, it is almost impossible for someone to legally park anywhere outside of a driveway or garage/carport. We request the Commission to consider the options presented and to direct the police department accordingly. FISCAL IMPACT: There is no fiscal impact associated with this item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. Notification of this agenda item has been provided in the City's recent newsletter and via e- Alert. RECOMMENDATION: It is recommended that the Commission choose one of the following options: Regular 602 PAGE 2 0 F 3-August 12,2013 I. Adopt provisions of the current temporary moratorium as a permanent ordinance. 2. Make no change to existing on-street parking prohibitions and restrict residents and visitors from using the city streets for parking. 3. Extend the current temporary moratorium an additional six (6) months to permit the police department to continue to assess this situation. 4.
