HomeMy WebLinkAbout2013 06 24 Consent 202 Moss Park Commercial Site AcceptanceCOMMISSION AGENDA ITEM 202 June 24, 2013 Regular Meeting REQUEST: Informational Consent X Public Hearings Regular KS City Manager KL Department The Public Works Department requesting the City Commission validate the Staff recommendation finding the Moss Park Commercial /Apartments sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of the remaining open punchlist items. SYNOPSIS: Sitework for the Moss Park Commercial /Apartments mixed use project is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE: Section 9 -178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. The Moss Park Commercial /Apartments project is a mixed -use development with a combination of retail uses and multi - family units, vertically integrated with two stories of apartments (15 units) over 6,000 square feet of ground floor /commercial storefronts. The 1.25 acre property is located on the north side of State Road 434, east of the intersection of Moss Road and State Road 434. The subject property is a part of the recently completed and adjacent Moss Park Apartments complex. The Final Engineering Plans were approved by the City Commission at the December 10, 2012 Commission meeting. Sitework on the mixed use project commenced in February 2013. This agenda item is for the conditional site acceptance of the site improvements. The sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A. FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations /Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Moss Park Commercial / Apartments sitework to be built in substantial accordance with the approved Final Engineering plans and accept the public infrastructure for ownership and maintenance, subject to completion of all open punchlist items as noted on Exhibit A prior to issuance of any Certificates of Occupancy. Bill of Sale Received for Infrastructure being turned over to the City for ownership and maintenance 6.
