REQUEST:
The Community Development Department- Planning Division requests that the City
Commission adopt Resolution 2013-11, which updates and re-establishes the City's outdoor
off-premises sign inventory.
SYNOPSIS:
Resolution 2013-11 updates and re-establishes the City's outdoor off-premises sign
inventory. The outdoor off-premises sign inventory is the inventory of existing billboards
that are located in the City. This inventory is being updated following the annexation of
three parcels of land located on the southwest corner of the intersection of U.S. 17-92 and
State Road 419. One of these parcels contained one lawfully existing billboard in un-
incorporated Seminole County, which was annexed into the City of Winter Springs. The
annexed property will be the location of a new RaceTrac facility.
CONSIDERATIONS:
On October 22, 2001, the City Commission adopted Ordinance 2001-50, which prohibits
off-premises signs or billboards in the City of Winter Springs. Ordinance 2001-50 identifies
an inventory which depicts billboards that are considered legal nonconforming structures.
Pursuant to Ordinance 2001-50, the number of existing billboards can be increased only
when a lawfully existing billboard located within an unincorporated area of Seminole
County is annexed into the City of Winter Springs.
On March 11, 2013, the City Commission adopted Ordinance 2013-03, which annexed
three parcels of land located on the southwest corner of the intersection of U.S. 17-92 and
State Road 419. One of these parcels contained one lawfully existing billboard which was

located in unincorporated Seminole County. Resolution 2013-11 updates and re-establishes
the City's outdoor off-premises sign inventory to include this billboard which was annexed
into the City via Ordinance 2013-03.
FISCAL IMPACT:
There is no fiscal impact associated with this agenda item.
COMMUNICATION EFFORTS:
This Agenda Item has been electronically forwarded to the Mayor and City Commission,
City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and
the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the
respective Meeting Agenda which has also been electronically forwarded to the individuals
noted above, and which is also available on the City's Website, LaserFiche, and the City's
Server; has been sent to applicable City Staff, Media/Press Representatives who have
requested Agendas/Agenda Item information, Homeowner's Associations/Representatives
on file with the City, and all individuals who have requested such information. This
information has also been posted outside City Hall, posted inside City Hall with additional
copies available for the General Public, and posted at five (5) different locations around the
City. Furthermore, this information is also available to any individual requestors. City Staff
is always willing to discuss this Agenda Item or any Agenda Item with any interested
individuals.
RECOMMENDATION:
Staff recommends the City Commission adopt Resolution 2013-11, which updates and re-
establishes the City's outdoor off-premises sign inventory.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, UPDATING AND
REESTABLISHING THE CITY'S OUTDOOR OFF-
PREMISES SIGN INVENTORY;PROVIDING FOR REPEAL
OF PRIOR INCONSISTENT RESOLUTIONS;
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, off-premises signs, also known as billboards, are generally prohibited in the
City of Winter Springs,except for those off-premises signs legally existing on October 22,2001 and
identified in an inventory filed with the community development department, which signs are
considered legal nonconforming structures; and
WHEREAS, pursuant to section 16-77(d), of the City Code, the number of existing off-
premises signs may be increased only by the number of lawfully existing off-premise sign structures
within unincorporated areas of Seminole County which are annexed by the City of Winter Springs;
and
WHEREAS, on March 11, 2013, the City Commission adopted Ordinance No. 2013-03,
annexing three (3) parcels of land generally located on the southwest corner of the intersection of
U.S. 17-92 and State Road 419, which land contained one(1) lawfully existing off-premises sign,
now located within the corporate boundaries of the City of Winter Springs; and
WHEREAS,the City Commission desires to update and reestablish the City's inventory of
legally nonconforming off-premises signs as set forth herein; and
WHEREAS,the City Commission deems this resolution to be in the best interests of public
health, safety, and welfare of the citizens of Winter Springs, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully
incorporated herein by this reference.
Section 2. Update and Reestablishment of Off-Premises Sign Inventory. The City
Commission of the City of Winter Springs hereby updates and reestablishes the City's Off-Premises
Sign Inventory pursuant to section 16-77(d) of the City Code. From and after the date of this
Resolution,the number of outdoor off-premises signs located within the corporate boundaries of the
City shall be limited to those legally existing off-premises signs located on the following properties:

I. Schrimsher Land Fund,North Side of State Road 434,East of
Tuskawilla Road;
2. Schrimsher Land Fund, South Side of State Road 434, 1,200
feet East of Tuskawilla Road;
3. Margaret S.O. Casscells, Trustee, South Side of State Road
434 at Spring Avenue;
4. Margaret S.O. Casscells, Trustee, South Side of State Road
434 West of the Greenway Interchange;
5. Dittmer Properties Inc., Southeast corner of intersection of
U.S. 17-92 and Shepard Road;
6. Diawantie & Mahindra Ram, South Side of State Road 434,
400 feet East of U.S. 17-92; and
7. RaceTrac,Southwest corner of intersection of U.S. 17-92 and
State Road 419.
Section 3. Repeal of Prior Inconsistent Resolutions. All resolutions or parts of resolutions
in conflict herewith are hereby repealed to the extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause,phrase, word, or portion
of this resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.
Section 5. Effective date. This Resolution shall become effective immediately upon adoption
by the City Commission of the City of Winter Springs, Florida.
DONE AND ADOPTED in regular session of the City Commission of the City of Winter
Springs, Florida, this 10th day of June, 2013.
