HomeMy WebLinkAbout2013 05 13 Public Hearing 500 RaceTrac Final Engineering Plan and Aesthetic Review COMMISSION AGENDA     Informational Consent ITEM500 Public Hearings X Regular       May 13, 2013KSRS Regular MeetingCity ManagerDepartment         REQUEST: The Community Development Department - Planning Division requests the City Commission hold a public hearing for the approval of  1) Final Engineering Plans and 2) Aesthetic Review for a RaceTrac convenience store and gas station, located south of the intersection of US 17-92 and SR 419.   SYNOPSIS: The applicant, RaceTrac Petroleum, Incorporated is requesting approval of  1) Final Engineering Plans and 2) Aesthetic Review for a 5,928 square foot RaceTrac convenience store and gas station with approximately twenty (20) fuel pumps under a canopy. The subject property is 2.39 acres in size and is located on the southeast corner of the intersection of US 17-92 and SR 419. Section 9-605.    Submittal requirements.   DISCUSSION: Final Engineering Plans The Final Engineering Plans proposes the construction of a 5,928 square foot convenience store and gas station with approximately twenty (20) fuel pumps under a canopy. Currently, the northern portion of the site is an abandoned Hess gasoline station. The Final Engineering Plans propose the demolition of the existing Hess station. The proposed demolition includes removal of all existing above ground and underground improvements. In addition to the demolition of the Hess station, several one story structures and existing signs are proposed for demolition on the southern portion of the site.   On March 11, 2013, the City Commission approved an Annexation Agreement for the proposed development. Per the provisions of this agreement, the Final Engineering Plan details the reconfiguration of an existing billboard which exists on the southern portion of the site. This billboard will remain in its current location, but will be raised to permit it to Public Hearings 500 PAGE 2 OF 6 - May 13, 2013 be visible over the canopy that is proposed adjacent to US 17-92. Additionally, this agreement controls building architecture and site signage.   A total of 37 parking spaces are proposed on site to accommodate the convenience store portion of the development. A stormwater retention pond is proposed at the northeastern corner of the site, adjacent to the US 17-92/SR 419 intersection. This section of US 17-92 is scheduled for widening in approximately 2015. A sidewalk will be provided along the US 17-92 frontage in conjunction with the road widening. The Florida Department of Transportation (FDOT) will construct this sidewalk. Per the City’s Code of Ordinances, a sidewalk is required along the SR 419 frontage. The Florida Department of Transportation (FDOT) requested this sidewalk to end on the south side of the SR 419 access point as this is a “logical terminance” point for the sidewalk.   Vehicular access to the site will be via two access points. One access point is located on US 17-92, with at the southern portion of the site. This access point is proposed as a full access. The second access point is proposed as a full access along SR 419. Vehicles will be required to enter and exit the site from either of these access points.   Aesthetic Review The attached Aesthetic Review package includes all of the submittal requirements for aesthetic reviews as set forth in Section 9-600 through 9-607 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required.   The procedures for review and approval are set forth in Section 9-603.    The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied:   (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community.   The project is locatedon the southeast corner of the intersection of US 17-92 and SR 419 on the site of a former Hess gas station. The design of the proposed building includes architectural design elements such as stone veneer, awnings, fiber cement siding, stucco, and pitched roof elements with metal shingles. A water table is provided around the perimeter of the proposed building to help break up blank expanses on the façade. The applicant worked with staff in providing distinctive design details such as faux windows with awnings on the portions of the building fronting SR 419, and a slight “pop-out” of the front façade of the building at the entry doors to allow architectural variation which adds to the quality of the proposed building. Staff feels that this project incorporates numerous quality design elements that are promoted Citywide. Additionally, the architecture is consistent with what was presented in the Annexation Agreement, which was approved by the City Commission on March 11, 2013.   Public Hearings 500 PAGE 3 OF 6 - May 13, 2013 (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area.   The design of the proposed building is an upgrade to the surrounding area and exhibits architecture that exceeds a typical gas station and convenience store.   (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: A.Front or side elevations, B.Size and arrangement of elevation facing the street, including reverse arrangement, C.Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements.   The proposed building, as designed, represents a significant upgrade to the site, to the surrounding area, and is a positive addition to the City of Winter Springs.Significant design features include a stone veneer, awnings, fiber cement siding, stucco, a water table element on the building facade, and pitched roof elements with metal shingles.   (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community.   The proposed project does enhance the character and overall aesthetics of the surrounding area.  The local community is comprised of a variety of architectural styles.  The proposed project represents a unique and positive addition to this area.   (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines, SR 434 design specifications) and other applicable federal state or   local laws.   The proposed project is consistent and compatible with the Comprehensive Plan and the Annexation Agreement which was approved by the City Commission on March 11, 2013. The final architectural plans will be reviewed for compliance with all building code criteria.   (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community.    The project has incorporated a number of features such as a stone veneer, awnings, fiber cement siding, stucco, water table, pitched roof elements with metal shingles and upgraded landscaping. The applicant worked with staff in providing distinctive design details such as faux windows with awnings on the portions of the building fronting SR 419, and a slight “pop-out” of the front façade of the building at the entry doors to allow architectural variation which adds to the quality of the proposed building. Public Hearings 500 PAGE 4 OF 6 - May 13, 2013   FINDINGS:   The 2.36 acre RaceTrac convenience store and gas station is located south of the  intersection of US 17-92 and SR 419. Portions of this parcel were annexed into the City of Winter Springs.  The existing Hess station was already located in the City.  The entire  property is zoned C-2 (General Commercial). The subject property has a Commercial Future Land Use designation. The subject property is located at a major commercial intersection. Gas stations with convenience stores are predominantly found at major commercial intersections.   The Final Engineering Plans are consistent with Section 20-418 of the City’s Code  of Ordinances. Specifically, the site exceeds the minimum air line distance of three hundred fifty (350) feet, measured in a straight line from the nearest points of lot boundaries, between a proposed gasoline station and any existing gasoline station or between a proposed gasoline station and any lot zoned residential or any lot on which a school or playground is proposed or exists.   The Final Engineering Plans and Aesthetic Review are consistent with all  applicable provisions of the Annexation Agreement which was approved by the City Commission on March 11, 2013.   The proposed elevations are consistent with the Aesthetic Review requirements  prescribed in the City Code of Ordinances.   The elevations include detailing and attention adding to their appearance and the  quality of the development.   The proposed development utilizes colors and materials that complement the  adjacent developments in the surrounding area. FISCAL IMPACT: (See Attachment C - Fiscal Impact Analysis) COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors.
