SYNOPSIS: One of the responsibilities of the City Clerk is to provide the Mayor and City Commission with a submittal of all Meeting Minutes, as soon after a City Commission meeting as possible; so, that it is a reminder to the Mayor and City Commission, as to what transpired at their most recent meeting, and also provides a record of the actions and directives of the City Commission, for the future, and which becomes the official record. If the City Commission is in agreement with what the City Clerk provides in these Minutes, then the City Commission would be asked to Approve the Minutes, as submitted. Should the Mayor and/or City Commission feel something is not appropriately documented in these Minutes, then a Motion would be appropriate to have the Minutes changed to reflect what the majority of the City Commission would prefer. CONSIDERATIONS: This Agenda Item includes the Minutes from the Monday, April 15, 2013 City Commission Workshop. Even though these Minutes are being submitted by the City Clerk, (with proofing by Office of the City Clerk Staff), no other party has required that changes be made to the Minutes before being submitted. These Minutes are being submitted by the City Clerk Consent 204 PAGE 1 OF 2- May 13,2013 for the Approval by the City Commission. FISCAL IMPACT: There is no fiscal impact related to the approval of this Agenda Item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City's Website, LaserFiche, and the City's Server. Krebs - Seat Five CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP-APRIL 15,2013 PAGE 2 OF 10 CALL TO ORDER The Workshop of Monday, April 15, 2013 of the City Commission was called to Order by Mayor Charles Lacey C=• at 6:00 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs,Florida 32708). Roll Call: " Mayor Charles Lacey,present Mayor Cade Resnick,present Commissioner Jean Hovey,present Commissioner Rick Brown,present Commissioner Pam Carroll,present Commissioner Joanne M.Krebs,present City Manager Kevin L. Smith,present City Attorney Anthony A. Garganese, arrived at 6:02 p.m. City Clerk Andrea Lorenzo-Luaces,present A moment of silence was held with special recognition of those at today's Boston Marathon. The Pledge of Allegiance followed. Mayor Lacey inquired of the City Commission, "Is the Agenda acceptable?" With no objections voiced, Mayor Lacey confirmed this and said, "No objections,we will move on." PUBLIC INPUT Mayor Lacey briefly addressed procedures related to Public Input. City Attorney Anthony A. Garganese arrived at 6:02 p.m. Mr. Arnie Nussbaum, 687 Andover Circle, Winter Springs, Florida: stated, "Speaking as part of the HOA (Homeowner's Association) of Georgetown", Mr. Nussbaum asked whether their Homeowner's Association will supersede Winter Springs rules; how would ownership registrations be determined; and commented on zero lot lines, demographics of their community, some recent mailbox/car accidents and said that with concern for their residents, community property, and pets, that their community of Georgetown not be part of any change and hoped the City would allow the Police Department to tickets any parked cars. On a personal note,Mr.Nussbaum spoke of community interactions and events; and showed some photographs of Miami gutters and noted that some people do not park correctly on such; and then noted the size of many emergency vehicles and his concern with parked cars on their streets which might impact timely medical assistance. Mr. Nussbaum closed by suggesting that perhaps one general rule for the entire City might not work for all communities. Mr. Bob Henderson, 635 White Ibis Court, Winter Springs, Florida: representing his community Association, Mr. Henderson suggested the Ordinance in question needs to be amended or changed; that some streets like George Street do have inherent issues; that the Ordinance should be amended to allow the Police Chief the ability to make exemptions where needed; and that if parking on one (1) side of a street is the rule,then that would cause other issues and may not work for all streets. CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP-APRIL 15,2013 PAGE 3 OF 10 w Ms. Carolyn Arch, 203 Hazelnut Court, Winter Springs, Florida: noted that she chose to live in Winter Springs !' because on-street parking was not allowed and that she felt that was good for safety and for aesthetics in C""' neighborhoods. Ms. Arch then provided some photographs for the Mayor and City Commission to consider and they were provided to the City. Mr. Kevin Cannon, Post Office Box 1501, Orlando, Florida: As the Tuscawilla Homeowner's Associations' City Liaison, Mr. Cannon thanked the City for holding this Workshop, and said that the Tuscawilla Homeowner's Association includes more than 4,800 homes, that many communities do not have Covenants and Restrictions which might prohibit on-street parking, and asked that the Tuscawilla community be exempted from on-street parking. Continuing, Mr. Cannon further spoke of the importance of aesthetics and property values; and how they have helped previously with Keeth Elementary School and the adverse impact on property values. Mr. Cannon further asked that the Tuscawilla community be exempted from on-street parking; mentioned a vehicle in his community that was parked within twenty feet (20') of a fire hydrant on a curve; and thought that the Police Department should be provided with a"mechanism"to deal with those that violate such Ordinances. Dr. Ted Johnson, 1107 Pheasant Circle, Winter Springs, Florida: referred to a document that was being passed out to the Mayor and City Commission and commented about the need for emergency vehicles to be able to pass parked cars on streets,and the need for quick responses by emergency personnel. Furthermore, Dr. Johnson noted that he had checked into the use of City resources for on-street parking issues, and did not think it was excessive; and also noted the importance of keeping up property values for future sales. Mr. Lee Jensen, 134 Nandina Terrace, Winter Springs, Florida: representing the Howell Creek Reserve Community Association, Mr. Jenson commented on cars parked in streets; similar communities in California where on-street parking is allowed, and how much nicer it is without on-street parking allowed; and that the Ordinance may need to be customized for other communities which need it for relief, but that he thought his community and Tuscawilla should be exempted. Mr. Drew Hawkins, 427 Woodcrest Street, Winter Springs, Florida: as a resident of the Winding Hollow subdivision, Mr. Hawkins spoke of recent issues he had and that he wanted to find a way to have driveways used and to not block sidewalks,and how to make it work for everyone. Mayor Lacey stated, "I do have two(2)others [Public Input forms] from people who do not want to speak,both in opposition to parking on the street and their comments will be in the Record." Ms. Kim Coburn, 1778 Seneca Boulevard, Winter Springs, Florida: noted that she was a Realtor and that she agreed with what others have said and that "Parking on the streets definitely will affect the property values" and added that she thought Winter Springs had become a beautiful community. Ms. Coburn agreed that some people should be able to park on the street in some areas and that permits would be helpful and would also provide revenue to the City. Commissioner Joanne M. Krebs asked, "I was wondering if there was any literature that Ms. Coburn had that she could share with us -the statement that she said that it will affect home values." Ms. Coburn stated, "I would be happy to do some research and get it to you." Public Input was then closed by Mayor Lacey. Mayor Lacey recognized former Commissioner Donald A. Gilmore. Police Department •4 The Police Department requests the Commission receive a presentation from staff concerning on-street parking,as requested. `rte FISCAL IMPACT: Depending on the action of the Commission, fiscal impacts will be varied or none. The highest potential for fiscal impacts is with the possibility of additional signage being posted along routes or areas where parking may be restricted should the language of the ordinance change. A typical "No Parking" sign costs approximately$25.00 to make. Additionally, information about this workshop was also sent via the eAlert/eCitizen system, an informational note on customer's City Water Bills, the City Newsletter, and the City Hall Electronic Sign. RECOMMENDATION: Options for the Commission to consider include the following: Option 1: Leave the current parking ordinances in place with no changes; use moratorium language as in years past for holidays or emergency reasons. Option 2: Adopt the conditions of the current parking moratorium, and/or variation(s) thereof, a s written code. Option 3: Any other changes or direction deemed appropriate by the Commission. Chief of Police Kevin Brunelle addressed the Mayor and City Commission on this Agenda Item. Commissioner Krebs said to Chief Brunelle, "I wanted to thank you for having this on-street parking Workshop information put together. It was very, very informative because when you look at all of the Agendas that we have gone over on this topic, over the years —I am looking back to 2005 and I know that it was an issue even before that." CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP—APRIL 15,2013 PAGE 5 OF 10 Mayor Lacey inquired of Chief Brunelle, "Is this document that you gave us, is it on the website anywhere or r3ra available?" Chief Brunelle responded, "Most of the information is the exact same thing as in the Agenda–the r... ' only thing that's different from that document that was provided to you that's in the Agenda, most of the information is exactly the same other than a couple of options or considerations." Chief Brunelle commented, "We could also put it up if you wanted to, as well." Mayor Lacey remarked, "I think it would be a good idea to °— take the entire document and put it up on the website." City Manager Kevin L. Smith further spoke about the information provided for this Workshop and added, `Be happy to get it on the website." Discussion followed on citations that have been issued and educating the citizens on Ordinances; and what is involved to determine Violations. Next, Commissioner Krebs mentioned a discussion that the City Commission had in July of 2005 related to the Second Reading of the Ordinance allowing on-street parking by Resolution and that Attorney Garganese had mentioned some data that could be used to set up permitting for short-term parking. Attorney Garganese pointed out, "The Ordinance is set up where it's a blanket prohibition, however, the Commission by Resolution on a case-by-case basis can set up parking zones and if those parking zones are properly marked, then they're an exception to the general prohibition. In addition, the Ordinance says that the Commission may temporarily suspend by Resolution the prohibition on parking in the streets which the Commission has exercised a couple of times, especially during the holidays." Commissioner Krebs then mentioned the Consensus noted in the Minutes and asked if it had been brought back. With discussion, Commissioner Krebs commented, "Whatever we do here, that it shouldn't be punitive and it certainly shouldn't be harmful or hurt our citizens. It is something that we all we should be able to live with and I don't know exactly what that is, but I certainly don't want to make it a hardship on anybody." Tape 1/Side B Discussion followed on who was interested in the Ordinance being enforced or who was not, what the Police Department was trying to do related to possible issues,hardships, and that a few subdivisions might not qualify. Commissioner Pam Carroll said, "I don't think we have ever clearly communicated within this document in basic language that you can't park opposite each other." With further comments on life/safety emergency concerns, Commissioner Carroll suggested, "Should we look at, a resident sticker so that if somebody calls and said–there is a problem car parked in front of my house- the Police Officer responds and there is a sticker on the bumper." Further, Commissioner Carroll recommended that if parking is allowed, "You ought to have parking, this side only,and maybe it is the side of the street that is opposite the fire hydrant and no parking here to the corner." Mayor Lacey remarked about the document provided to the Mayor and City Commission and stated, "You said the Police Department has not encountered one (1) instance when we can recall where an emergency vehicle was hindered in any way by parking in the street." Mayor Lacey added, "And they discovered few, if any issues at all rising from the temporary Moratoriums imposed for the holidays; and street parking in the pilot areas along City streets during times of holiday and moratorium have not impacted the Police Department or Fire Departments from being able to serve our community." Continuing with his comments, Mayor Lacey asked Chief Brunelle, "There is great concern that we will have safety issues if we open up parking– so my question to you is if we change the paradigm in the City from being no on-street parking as a default to on-street parking allowed, do you think your history there bears out what the future would be? Do you still think that we would, you in enforcement would not see many safety issues that would come about?" CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP-APRIL 15,2013 PAGE 6 OF 10 A Chief Brunelle responded,"We could find no incidences." Furthermore, Chief Brunelle stated, "We cannot recall =am or remember any situation where we had to go and assist the Fire Department in moving a vehicle." Discussion ensued on illegal situations; that many communities utilize alternate side of the street parking; that citizens need to assist the Police Department with issues that the Police Department might need to be aware of traffic calming; and barriers to slow down traffic. Commissioner Rick Brown said that on-street parking has always been a problem in his community and mentioned a few dangerous situations involving parking near hydrants and on corners; and said that residents do not seem to contact the Police Department on such issues. Deputy Mayor Cade Resnick spoke of the permitting suggestion and stated, "I have a problem with that based on the fact of what I am hearing and understanding is someone can come into City Hall,pay a Fee to be able to park on the street. To me that is a form of a Tax and it is also a benefit to somebody who has enough money to be able to do that." Deputy Mayor Resnick added, "To reiterate,the permitting for me is an issue." Commissioner Carroll spoke of situations involving numerous cars at a residence with no garage and said, "Maybe a designated parking area could add one more space but you may have five (5) cars. Maybe we don't charge a Permit Fee, but we require you to fill out paperwork and register with the City and get your sticker and put it on your cars and that alleviates the concern." Commissioner Jean Hovey stated, "I definitely don't agree with the Permit and charging people. That is more government." With continued discussion, Commissioner Hovey noted, "We have to do something for everyone and there is no easy solution; but why are we the only City in the County—that has all these Ordinances, when no one else does." Safety issues were addressed next by Chief Brunelle; along with different issues related to the ratio of cars and residents at many residences; and designated parking areas. Commissioner Krebs commented that "I am not really for a Permit right now. I am hoping we can find another solution other than Permits." Mayor Lacey pointed out that, "I think there is a clear Consensus that we will not be doing Permitting for parking." Commissioner Brown mentioned that he was intent on listening to everyone right now and added, "We do have to think about the entire City and what is best for everybody." Continuing, Commissioner Brown noted, "We have evidence to say there is not an increase in crime; there is not an increase in safety issues. In fact, you said we have never had a safety issue..." Chief Brunelle added, "...The increase in crime, as it relates to a blight issue of parking in the street—I don't have any information at all. I've done some research on it but I haven't been able to find anything or am I familiar with anything that says that parking in the street creates a crime issue as it relates to blight." The broken window theory, previous parking situations related to Keeth Elementary School, some aesthetic issues with some homes in the Tuscawilla community were addressed next. Next, Commissioner Brown suggested, "I think we need to approach this really based on having all the accurate information." Deputy Mayor Resnick asked about some areas on the west side of the City where it might be difficult to put people on both sides of the street. Chief Brunelle stated, "What I need from you all is relief for the citizens who are in the various situations I've explained." Further comments. Commissioner Carroll noted, "I am not sure how many of our citizens in this great City even realize that the on- street parking ban has been lifted temporarily." With additional remarks, Commissioner Carroll said, "I don't feel that the temporary lifting between Thanksgiving and just after New Years is a good measurement because that was geared towards allowing people with holiday needs; so, it is a temporary, kind of one-shot time period that is not a 365 days a year, whole City." Discussion followed on Police Department procedures and education, and possible misunderstandings. CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP—APRIL 15,2013 PAGE 7 OF 10 A Tape 2/Side A =7 Furthermore, Commissioner Carroll then remarked, "I am still concerned that not enough citizens even know about this and that I don't feel we can treat the whole City equally. I think we need to really scrutinize, and there t are areas that really need it and there are other areas that should be left alone." neett Commissioner Krebs suggested that Deputy Mayor Resnick had recommended using "facebook" to get the word out. Discussion followed on what times of day or night, the most cars are parked on the street; issues with cars that are leaking oil on streets; and the suggested Recommendations in the Agenda Item. PUBLIC INPUT Ms. Tina Alenius, 1520 South Greenleaf Court, Winter Spring, Florida: as a resident of the Glen Eagle community, Ms. Alenius said that she had moved to Winter Springs because there was no on-street parking, so her children would be safer, and because they wanted a community they could better enjoy. Mr. Edward Cregar, 1525 Eagle Nest Circle, Winter Spring, Florida: said that he lives just near a curve in the Glen Eagle community and it is often a dangerous situation; and commented on the need for safety especially for children, and recommended that the Ordinance be enforced where necessary but that it was not needed in the Tuscawilla community. Mr. Bob Holmes, 1689 Wingspan Way, Winter Spring, Florida: said that he also resided in the Glen Eagle subdivision; that he liked the community that they moved into but would not want to stay there if there was on- street parking in their community; and suggested that the Ordinance may not work for all areas of Winter Springs. Ms. Laura Leigh Wood, 713 Sybilwood Circle, Winter Spring, Florida: noted that she was a Realtor and that aesthetics does matter when it comes to selling homes, and especially when taking photographs of homes; and noted issues with maneuvering around cars parked on streets; and that a permit might work, but there might be issues with some people having to pay for a permit. Commissioner Brown mentioned that people are currently driving around cars parked on streets but that they should call the Police Department on any illegally parked cars. Mr. Terry Even, 106 Marsh Creek Cove, Winter Springs, Florida: mentioned he was having some renovations done at his residence and that with Contractors doing work at his house, he would appreciate some discretion in such situations; and asked the residents in attendance about their support of the Ordinance in question. Discussion followed on getting the word out to residents and Commissioner Carroll commented, "I am still not convinced that enough of our City is aware that we have even temporarily lifted it." Commissioner Carroll added that related to previous comments, that people were afraid to call about issues with infractions. In regards to "People are afraid" — Commissioner Krebs thought that "People are afraid of what they don't know. That is usually the way it is; and what we don't know is what kind of impact an Ordinance like this would have." Commissioner Krebs then remarked that she would further review what had been discussed and she would further review the Florida Statutes. Ms. Tina Alenius, 1520 South Greenleaf Court, Winter Spring, Florida: further addressed the Mayor and City Commission and explained that previously while living on a busy street in Orlando, a young neighbor fell in a pool and because cars blocked emergency vehicles trying to get to his house,the little boy was seriously impaired and disabled; and that because of that occurrence, she had looked for a neighborhood which was safer and where cars would not be in the way. CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP-APRIL 15,2013 PAGE 8 OF 10 r Mr. Ron Pillara, 882 Benchwood Drive, Winter Springs, Florida: as a resident of the Oak Forest community,Mr. Pillara did not have any issues with parking, but noted his personal concerns should parking on one side of the street be agreed to. Mr. Arnie Nussbaum, 687 Andover Circle, Winter Springs, Florida: commented on issues in the Casa Park community and said that there were some streets on the west side of the City where emergency vehicles would • have some problems getting through; and also spoke of"fire protocol" in Seminole County and how life/safety issues was a big concern in his community and some other areas in the City. Mr. Kevin Cannon, Post Office Box 1501, Orlando, Florida: mentioned he has had to call for emergency assistance for a family member, and has also seen problems with a garbage truck not being able to pass through a street in his community, Howell Creek Reserve, and thought that the previous speaker was correct in his comments about time being a big issue in life/safety matters. Furthermore, Mr. Cannon thought some relief needed to be given to the Police Department and showed a photograph with a four-wheel drive truck that is often parked on a corner in his subdivision. Mr. Cannon explained that the owner of the home where the truck is often parked,told Mr. Cannon that the truck leaks oil and that is why it is always parked in the street. Mr. Cannon then suggested more education might help and that he opposed a blanket Waiver. Commissioner Brown noted that the truck shown in Mr. Cannon's photograph is already in violation of Florida Statutes and asked what could be done to solve this problem. Mr. Cannon next inquired why this has been happening for about a year and is still an on-going problem; and then showed a sketch which outlined some different driveway situations that could cause problems and asked that this be taken into consideration also. Chief Brunelle stated that he had not seen the truck in question and added, "It's a Violation and if we're not enforcing it, I'll take care of that." Further regarding a sketch which showed some driveway issues, Chief Brunelle explained, "The particular Statute for parking across from the driveway is the way the Statute is written, is you can't park immediately adjacent to it. Now, that could be interpreted depending on what the Officers decide to do enforcement-wise; whether they're going to write a Citation for it, for improper parking or whether or not,they're not going to write a Citation." With further comments on interpretations, Commissioner Brown added, "And the right thing to do at any time, any parking violation like that occurs is to pick up the phone and call the Police Department." Chief Brunelle stated, "Absolutely." Discussion. Dr. Ted Johnson, 1107 Pheasant Circle, Winter Springs, Florida: again representing the Tuscawilla Homeowner's Association, Dr. Johnson thought that different communities have different needs and suggested the City survey the residents of Tuscawilla before the City Commission makes a final decision on this Ordinance. Dr. Johnson also mentioned what his community has done in terms of any properties in Tuscawilla that might be considered as blight. Discussion followed that Florida Statutes outweighs City Ordinances; and Commissioner Hovey thought that if a survey was to be done,then the entire City should be surveyed. Commissioner Carroll stated, "I just want to commend Brian (Fields, P.E., City Engineer, Public Works Department) for also coming up with the measurements of all the streets in the whole City." CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP—APRIL 15,2013 PAGE 9 OF 10 Mr. Lee Jensen, 134 Nandina Terrace, Winter Springs, Florida: again representing the Howell Creek Reserve Community Association, Mr. Jenson thought that some of the issues in his subdivision might be due to it being a =.1r41 gated community and referenced a previously signed private enforcement agreement. Deputy Mayor Resnick thanked the citizens for their input and noted that he thought a Survey might be helpful tot the City Commission and that it could provide more data. Deputy Mayor Resnick added,that he hoped they could take some time to consider the information discussed, speak with their constituents, and "Reconvene back as a body again at a later time, with all that data, maybe as another Workshop." Commissioner Carroll said, "I concur." Mr. Drew Hawkins, 427 Woodcrest Street, Winter Springs, Florida: thanked Captain Deisler for the information he provided and thought it was factual that no resident had been deprived of medical assistance; and that based on Commissioner Krebs' comments that the City be given more time to consider the impact of the Moratorium. Tape 2/Side B Furthermore, Mr. Hawkins suggested that data related to crime, property values, and life/safety matters be further evaluated before a final decision is made. Commissioner Krebs noted a previous Ordinance related to the number of pets allowed, and how the City Commission has previously utilized "tests" and said that "Sometimes a test is really a good indication of what it will be like and whether it is—a road we really want to travel." Manager Smith mentioned that this same concept has also been used for banners and signage in the past. Commissioner Krebs then recommended, "We come back and we look at it and we change what we can or if want to change it, or if we see it is still going, fine, and maybe that is the avenue to your point we should also take, is actually do the test and bring back this information. That is really going to help us a lot; and start calling on those illegally parked cars." Mr. Maurice Kaprow, Post Office Box 19523, Winter Springs, Florida: commented that often many people do not come out [to meetings] if things are going fine, and that often people only speak up when something upsets them. Mr. Kaprow also spoke of life/safety concerns and that there do not seem to have been any issues during the past few months while the Moratorium was ongoing; commended the Chief; and suggested that the Commission consider all of the alternatives possible, and added that because Tuscawilla residents are upset, this does not mean that all City residents are also upset. One other resident said that today is a different day than previous times and situations are different, and that some people may need to park on streets; some kind of identification or marking for cars might help the Police Department and others; that maybe parking on the street is something needed, and we need to help everybody; that a Survey might be a good idea; and that it should be considered, who attended this evening, and who does not seem to care. Mayor Lacey closed Public Input. Commissioner Carroll remarked, "I was just going to remind everybody that a few years ago, when Oak Forest was in question along with the other two (2) subdivisions, that Captain (Glenn) Tolleson did use Surveys before this decision was made and I don't know what the Survey percentage response was,but as I understood it,he sent them to all of the residents of Oak Forest, all of Mount Greenwood,all of the areas in questions,and yes there was test period. So, again my concern—I don't know what percentage of our City does or does not even know that there has been a temporary lifting. The holiday lifting ended in January. This Commission except for me voted to lift it again temporarily, I believe in late January. But it had ended, and the holidays were always targeted toward the holidays because people had expressed the need. And that could still happen- I think the Survey will help us and I agree with Deputy Mayor Resnick that we need time to digest all of this, get the results of a Survey, and then maybe do another Workshop." CITY OF WINTER SPRINGS,FLORIDA MINUTES CITY COMMISSION WORKSHOP—APRIL 15,2013 PAGE 10 OF 10 Mayor Lacey suggested the City Commission be cautious about committing to do a Survey as he did not think it was a good idea for the City to sanction a Survey, but that other organizations could always do what they wanted to do. Commissioner Carroll said to Chief Brunelle, "Do you still have the results of Captain Tolleson's? It was designed by him, coming from the Police Department. It wasn't the Commission's." Chief Brunelle stated, "I'd have to look in the file and see what we may have in the records." Commissioner Carroll said, "I will find it and send it to you." Chief Brunelle asked Captain Deisler for his input and remarked, "I could check with the Clerk's Office to see if they have anything." Commissioner Hovey remarked that she thought a Survey was a good idea to find out what the residents think. Mayor Lacey added that we are not professional pollsters and that Elected Officials should use their best judgment to make the best decision, and that a Survey may not give us correct data.
