HomeMy WebLinkAbout2013 02 25 Consent 200 Resolution 2013-06, Moratorium for On-Street Parking COMMISSION AGENDA     Informational Consent X ITEM200 Public Hearings Regular       February 25, 2013KS Regular MeetingCity ManagerDepartment         REQUEST: The City Manager requests the City Commission approve Resolution 2013-06 to memorialize its recent action to temporarily suspend the prohibition of on-street parking on certain streets within the City.    SYNOPSIS: At the February 11, 2013 Regular Commission Meeting, the City Commission voted to temporarily suspend the current prohibition of parking vehicles on certain roadways pursuant to the City Code.  Resolution 2013-06 is presented herein to memorialize that action and suspends the prohibition of on-street parking for a period of six (6) months, except for certain roadways, and directs the City Manager to conduct a planning study regarding the City's on-street parking regulations. CONSIDERATIONS: Section 12-65(1)a.1 of the City Code prohibits parking of vehicles on any roadway unless expressly authorized within a particular zoning district, such as the Town Center.  Section 12-65(1)a.3 authorizes the City Commission to temporarily suspend the on-street parking prohibition for public purposes.   For the past several years, the City Commission has temporarily suspended the on-street parking prohibition during the holiday season, with certain exceptions consisting of arterial streets, collector streets, and other local streets that do not support on-street parking.   At the February 11, 2013 City Commission meeting, the Commission discussed the City's current on-street parking regulations and voted to temporarily suspend the prohibition of on- Consent 200 PAGE 1 OF 2 - February 25, 2013 street parking for a period of six (6) months.   During the six-month suspension period, the City Manager, in consultation with the Police Chief, shall conduct a planning study regarding the City's on-street parking regulations.  At the conclusion of the planning study, the City Manager will make a recommendation at a public meeting of the City Commission on whether the parking regulations should be repealed or modified in any way.   Resolution 2013-06 suspends on-street parking, with the exception of certain streets listed in Exhibit A of the Resolution, plus streets not open to the public including private streets in gated communities.  The list of exceptions in Exhibit A is generally the same as the exceptions used in the past during the suspension of the on-street parking prohibition during the holiday season.   Resolution 2013-06 will become effective immediately upon adoption by the City Commission. FISCAL IMPACT: There is no fiscal impact associated with Resolution 2013-06. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   A public notice of the temporary suspension of the on-street parking prohibition will be posted on the City website, published in the City newsletter, and further distributed as needed. RECOMMENDATION: Staff recommends the City Commission approve Resolution 2013-06 and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents. Resolution 2013-06 (4 pages) Consent 200 PAGE 2 OF 2 - February 25, 2013 RESOLUTION NO. 2013-06 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, TEMPORARILY SUSPENDING THE PROHIBITION OF PARKING ON CERTAIN ROADWAYS WITHIN THE CITY PURSUANT TO THE AUTHORITY SET FORTH IN SECTION 12-65(1)a.3. AND AS SET FORTH HEREIN; PROVIDING THE CITY MANAGER SHALL CONDUCT A PLANNING STUDY TO RECOMMENDTO THE CITY COMMISSION WHETHER THE CITY’S ON-STREET PARKING REGULATIONS SHOULD BE MODIFIED OR REPEALED, IN WHOLE OR IN PART; PROVIDINGFOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE DATE. the City is granted the authority under Section 2(b), Article VIII, of the State WHEREAS, Constitution to exercise any power for municipal purposes, except when expressly prohibited by law; and section 12-65(1)a.3. of the City Code authorizes the City Commission to WHEREAS, temporarily suspend the prohibition of parking vehicles on any roadway for public purposes; and the CityCommission desires to temporarily suspend the prohibition of parking WHEREAS, vehicles on certain roadways pursuant to section 12-65(1)a.3 in order to allow the City sufficient time to conduct a planning study and hold one or more public meetings in order to determine whether said regulations should be modified or repealed by the City Commission, in whole or in part, in the future; and the City Commission of the Cityof Winter Springs deems that this Resolution WHEREAS, is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: The foregoing recitals are herebyfullyincorporated herein by this reference Section 1.Recitals. and are deemed a material part of this Resolution. The City Commission Section 2.Declaration of Public Purpose; Required Planning Study. hereby declares that temporarily suspending the prohibition of parking vehicles on roadways serves a significant public purpose under the terms and conditions set forth herein. During the suspension period, the City Manager, in consultation with the City’s Police Chief, is hereby directed to conduct City of Winter Springs Resolution No. 2013-06 Page 1 of 3 a planning study regarding the City’s on-street parking regulations and make a written recommendation at a public meeting of the City Commission on whethersaid regulations should be modified or repealed by the City Commission, in whole or in part, in the future. The City Manager’s recommendation shall be due no later than six (6) months from the effective date of this Resolution unless additional time is granted by the City Commission. Section 3.Implementing Section 12-65(1)a.3. of the City Code. A.Except for the roadways set forth in paragraph B, the prohibition of on-street parking on City roads is hereby temporarily suspended for a period of six (6) months, commencing on the effective date of this Resolution. Said time period shall be automatically extended if the City Manager is granted additional time by the City Commission to conduct the planning study required in accordance Section 2 of this Resolution. B.The temporary suspension provided for herein shall not apply to: 1. The roadways set forth in which is attached hereto and fully Exhibit “A” incorporated herein by reference. 2. Any roadway not open to the general public for travel including, but not limited to, private roadways in gated communities. . Nothing herein shall prohibit the City from Section 4.Emergency/Public Safety Situations prohibiting on-street parking on any street located within the City in the event of an emergency or in order to safeguard the public health, safety, and welfare. . All prior resolutions or parts of Section 5.Repeal of Prior Inconsistent Resolutions resolutions in conflict herewith are hereby repealed to the extent of the conflict. If any section, subsection, sentence, clause, phrase, word, or portion Section 6.Severability. of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
