HomeMy WebLinkAbout2013 01 28 Consent 205 Amberly Site AcceptanceCOMMISSION AGENDA ITEM 205 January 28, 2013 Regular Meeting Informational Consent X Public Hearings Regular KS KL City Manager Department REQUEST: The Public Works Department requesting the City Commission validate the Staff recommendation finding the Amberly sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of the remaining open punchlist items and recording of the final plat. SYNOPSIS: Sitework for Amberly is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE: Section 9 -178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city commission. Consent 205 PAGE 1 OF 3 -January 28, 2013 Amberly is a new 36 unit single - family subdivision located on Dovera Drive, north of Red Bug Lake Road, within the Oviedo Marketplace PUD. Final Engineering for Amberly was approved by the City Commission on July 23, 2012. Sitework construction commenced in August 2012 and construction of the first model units commenced in December 2012. A final plat for the Amberly subdivision was approved by the City Commission at the December 10, 2012 Commission meeting, subject to provision of the required bond, letter of credit, or cash deposit, which has yet to be provided and thus the plat has not been recorded. This agenda item is for the conditional site acceptance of the site improvements. The Amberly sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A. In addition, since the plat has not been recorded this site acceptance must be subject to the recording of the final plat. The engineer -of- record has provided a certification letter of approval and a complete set of record drawings. KB Home has provided the required two -year maintenance bond for the public infrastructure being turned over to the City for ownership and maintenance. This public infrastructure includes: • Roadway infrastructure (asphalt pavement, base, curb, gutter, etc.) for all public streets • Water distribution system including the mains, valves, and hydrants between the points of connection and the point of service (meter) to each lot • Public sidewalks, except those along the immediate frontage of residential units not yet constructed • Signage and striping in the right -of -way • Sanitary sewer system • Stormwater infrastructure in the right -of -way, pond, and drainage easements One condition of the City Commission's approval of the Final Engineering plans for Amberly was a requirement for the Dovera Community Development District (CDD) to grant the City an easement for emergency access and maintenance of the existing stormwater system on the CDD property. This easement has been recorded. FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations /Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional Consent 205 PAGE 2 OF 3 -January 28, 2013 copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Amberly sitework to be built in substantial accordance with the approved Final Engineering plans and accept the public infrastructure for ownership and maintenance, subject to: 1) completion of all open punchlist items as noted on Exhibit A prior to issuance of any Certificates of Occupancy; and 2) recording of the final plat. Complete FDEP Sewer Certification (in progress) 2. Complete FDEP Water Certification (in progress) 3. Install all required pond and common area landscaping and pass the final irrigation inspection 4. Install common area hardscaping (benches, etc.) 5. Restore and sod the disturbed area around the irrigation well 6. Submit test results for asphalt cores and repair surface where cores were taken 7. Record the final plat before the site can be considered as accepted by the City
