HomeMy WebLinkAbout2012 11 19 Consent 206 Winter Springs Village Phase 2 Site AcceptanceCOMMISSION AGENDA ITEM 206 November 19, 2012 Special Meeting Informational Consent X Public Hearings Regular KS KL City Manager Department REQUEST: The Public Works Department requesting the City Commission validate the Staff recommendation finding the Winter Springs Village Phase 2 sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of the remaining open punchlist items. SYNOPSIS: Sitework for Winter Springs Village Phase 2 is substantially complete and has been conditionally approved by the applicable City Departments. This agenda item provides the site acceptance necessary before any Phase 2 certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE: Section 9 -178. Required Improvements to be completed prior to building on lots; exceptions. (c) Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished. (d) ... Certificates of occupancy will not be issued until all improvements are accepted by Consent 206 PAGE 1 OF 3 - November 19, 2012 the city commission. Winter Springs Village is a new 202 single - family unit subdivision by Meritage Homes located on a 40 -acre site in the Winter Springs Town Center. The site is located along the east side of Tuskawilla Road, south of St. Johns Landing. Final Engineering and a Developer's Agreement for Winter Springs Village were approved by the City Commission on March 28, 2011. The project consists of two phases, with 99 of 202 units in Phase 1 and the remaining 103 in Phase 2. Sitework for Phase 1 was accepted by the City Commission at the March 26, 2012 City Commission meeting. As of October 25, 2012 the City has issued building permits for 126 of the 202 total units. A substantial number of new homes in Phase 1 are complete and occupied. This agenda item is for the conditional site acceptance of the Phase 2 site improvements. The Phase 2 sitework has been constructed in substantial compliance with the Final Engineering plans approved by the City Commission, except as noted on the attached punchlist, Exhibit A. In addition, all Development Agreement requirements applicable to the sitework have been completed. The engineer -of- record has provided a certification letter of approval and a complete set of record drawings. Meritage Homes has provided the required two -year maintenance letter of credit for the public infrastructure being turned over to the City for ownership and maintenance. This public infrastructure includes: • Roadway infrastructure (asphalt pavement, base, curb, gutter, etc.) for all public streets • Water distribution system including the mains, valves, and hydrants between the points of connection and the point of service (meter) to each lot • Public sidewalks, except those along the immediate frontage of residential units not yet constructed • Signage and striping in the right -of -way • Sanitary sewer system • Stormwater infrastructure in the right -of -way, pond, and drainage easements • Irrigation main lines and related appurtenances within the right -of -way FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations /Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Winter Springs Village Phase 2 sitework to be built in substantial accordance with the approved Final Engineering plans, subject to completion of all open punchlist items as noted on Exhibit A prior to issuance of any Phase 2 Certificates of Occupancy, and to accept the public infrastructure for ownership and maintenance. Repair /replace broken street signs (Phase 1 and Phase 2) 2. Clean the entire storm drain system 3. Remove sediments from Pond 3 bottom 4. Repair damaged asphalt on Fanning Drive at 811 Gainer Way 5. Fix the curb tie -in at the driveway of 716 Fanning Drive 6. Repair the damaged curb at the intersection of Fanning Drive and Tuskawilla Road 7. Repair the multiple long streaks and the one large pothole in the asphalt of "Pass 6" Phase 2: 8. Restore Pond 2 washouts and prevent further erosion 9. Clean all dirt and remove all debris and trash from roads, curbs, offsite areas, etc. 10. Repair any cracked curbs or sidewalks (many places) 11. Clean Ponds 2 and 3 of all algae, sediment, and debris 12. Repair damaged asphalt on the lift station access road 13. Replace or repair gate at lift station 14. Clean sediment from lift station road and repair erosion control to prevent further washouts 15. Complete all Phase 2 common area landscaping 16. Raise and securely tie -up water and reclaimed water services (many places) 17. Repair damaged asphalt at the intersection of Fanning Drive and Treehouse Street 18. Clear the back retaining wall of vegetation several feet from the face of the wall; this needs to be done periodically to protect the wall and keep it accessible for inspection and maintenance 19. Install the unpaved portion of the lift station access road per the approved plans (interlocking plastic grid pavers) 20. Clean up and stabilize the areas at the southernmost ends of Fanning Drive and Buckhorn Avenue (remove rock, asphalt, etc). Sawcut the ends of the existing asphalt street (ribbon curb is recommended but not required by the plans). 21. Install the 15 -foot Emergency Access (interlocking plastic grid pavers) as shown at the south side of lot 71. 22. At the trail crossing, remove all temporary construction and advanced warning signage. Clean the area including a thorough sweep of the road across the trail.
