HomeMy WebLinkAbout2012 07 23 Consent 202 Family Dollar Site Acceptance COMMISSION AGENDA     Informational Consent X ITEM202 Public Hearings Regular       July 23, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department Requesting the City Commission validate the Staff recommendation finding the Family Dollar sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of all conditions of approval   SYNOPSIS: Sitework for the Family Dollar is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   (d)  … Certificates of occupancy will not be issued until all improvements are accepted by the city commission. Consent 202 PAGE 1 OF 3 - July 23, 2012   Family Dollar is an 8,000 square foot retail store located on the north side of S.R. 434 between Fairfax Avenue and Devon Avenue.  Final Engineering plans were approved by the City Commission at the November 28, 2011 City Commission meeting.  Sitework and building construction started in March 2012.      The developer has substantially completed the site infrastructure and provided the necessary project closeout documents, except as noted on the attached conditions of approval (see Exhibit A).  All conditions of approval for the site acceptance must be satisfied with Staff approval before a Certificate of Occupancy can be issued by the building official.  Family Dollar is projecting to have the building ready for the Certificate of Occupancy prior to the next City Commission meeting on August 13, 2012, thus this conditional site acceptance is needed in order to avoid possibly delaying the opening beyond August 13.    Three parallel parking spaces have been constructed in the Fairfax Avenue right-of-way to replace the previous parking area at this location, in compliance with the Commission's direction at the time of final engineering approval.  The three parking spaces are open for public use at all times.   Family Dollar is required to provide a two-year maintenance security in the form of a cash deposit or letter of credit for the public infrastructure being turned over to the City for ownership and maintenance.  This public infrastructure includes:   a.Offsite sidewalks in the right-of-way b.Water main from the point of connection to the point of service   FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors.
