HomeMy WebLinkAbout2012 06 25 Regular 602 Fill Vacancy in District 3 City Commission SeatCOMMISSION AGENDA ITEM 602 June 25, 2012 Regular Meeting REQUEST: Informational Consent Public Hearings Regular X KS City Manager Department The City Attorney and City Manager advise the City Commission that pursuant to section 4.08(c) of the Winter Springs City Charter, the City Commission is required to appoint a qualified voter of the City to fill the vacancy in the District 3 City Commission seat created by the resignation of former Deputy Mayor, Gary Bonner. SYNOPSIS: By letter dated June 7, 2012, former Deputy Mayor, Gary Bonner, advised the City that he was resigning from the City Commission effective immediately. His resignation created a vacancy in the seat for City Commission District 3. Section 4.08(c) of the Winter Springs Charter provides that the City Commission must appoint a qualified voter of the city to fill the vacancy at either of the next two regular meetings of the City Commission following the creation of the vacancy. The term of the appointment is until the next regular election. On June 11, 2012, the City Commission directed that the City publish a public notice advising prospective candidates to submit a qualifying application to be considered by the City Commission. Eight (8) individuals submitted qualifying applications for the City Commission's consideration. CONSIDERATIONS: Former Deputy Mayor, Gary Bonner, submitted his resignation effective June 7, 2012. 2. The resignation creates a vacancy in the District 3 City Commission seat. 3. Section 4.08(c) of the Winter Springs Charter provides that: Regular 602 PAGE 1 OF 5 -June 25, 2012 Filling of vacancies. A vacancy in the mayor's position or a commission member's seat shall be filled by a qualified person until the next regular election by a majority vote of all remaining members of the city commission. It shall be the duty of the remaining members to fill the vacancy at either of the next two regular meetings of the commission following the creation of the vacancy. At the next regular election, a qualified person shall be elected for a term equaling that period of time necessary to complete the unexpired terms of the previously vacated position or seat; unless the previous term was to expire, in which case such person shall be elected for a four (4) year term. 4. Therefore, the City Commission must appoint, by majority vote, a qualified person to serve as the new District 3 City Commissioner until the next regular election, which is scheduled to be held on November 6, 2012. 5. Coincidently, the current term for the District 3 seat is scheduled to expire on November 6, 2012. Thus, at the November 6, 2012, Winter Springs' voters will elect a new District 3 City Commissioner to serve a new four (4) year term of office. 6. The City Charter sets forth the eligibility requirements to serve on the City Commission: (A) Only qualified voters of the city shall be eligible to hold the office of mayor or commissioner. §4.01(b), Winter Springs City Charter. Section 8.02 of the City Charter provides that "[a]ll citizens qualified by the constitution and laws of the State of Florida to vote in the city and who satisfy the requirements for registration prescribed by law shall be qualified voters of the city within the meaning of this Charter." (B) Each candidate seeking the office of city commissioner or mayor or any other elective office of the city shall have resided in the city one (1) year prior to the time of qualifying. §4.01(b), Winter Springs City Charter. (C) Each candidate seeking the office of city commissioner shall be a resident of a designated commission district established by ordinance and shall have resided in the designated commission district six (6) months prior to the time of qualifying. §4.01(b), Winter Springs City Charter. 7. At the June 11, 2012 City Commission meeting, the City Commission directed that the City publish a public notice advising interested candidates to file an application for serving in the District 3 seat by 12:00 P.M., Monday, June 18, 2012. Candidate application packages, including candidate bios, that were timely submitted to the Office of the City Clerk are provided herein for each candidate in the Attachments section of this Agenda Item. 8. Eight (8) applications were received by the City Clerk by the deadline. Rules and Procedures for City Commission meetings were adopted by the City Commission and set forth in Resolution No. 2011 -35. Other than the City Charter provision mentioned above, no City Commission rule specifically addresses the appointment of a qualified person to fill a vacancy on the City Commission. However, section 2113 of the Resolution provides: Robert's Rules of Order. Robert's Rules of Order shall be the "underlying foundation" for the conduct of Commission meetings and will be followed to the extent practical and feasible and to the extent not modified by this Resolution. (Robert's Rules of Order may be suspended by majority vote.) 10. Robert's Rules specifically addresses appointments to fill an office. See, e www.rulesonline.com In general, if no other method of making nominations is designated in the by -laws or rules of the City Commission, Robert's Rules lays out a two -step process: 1. Nomination Phase: Nominations of candidates by the City Commission; and 2. Election Phase: Election of a candidate to fill the office by the City Commission. 11. Before proceeding to an election to fill the vacancy, it is customary to nominate one or more qualified candidates to be considered for election. In this case, the Mayor should "open nominations" and call upon the City Commissioners to nominate qualified candidates to be considered during Step -2 (Election Phase.) Each Commissioner should be afforded the opportunity to make a nomination, but each Commissioner is not required to do so. Nominations do not require a motion or a second. After a reasonable time has been given to nominate qualified candidates, it is customary for the Mayor to call upon the City Commission to make a motion to close nominations and proceed to Step -2 (Election Phase). Closing nominations requires a motion and 2/3 vote of the City Commission and typically results in narrowing the number of candidates who will be considered for appointment. A motion to close nominations is not debatable, but can be amended as to the time. If for some reason it is desired to reopen nominations, it may be done by motion and majority vote of the City Commission. A motion to reopen nominations is also not debatable, but may be amended as to the time. 13. When nominations are completed, the City Commission proceeds to Step -2 (Election Phase) to fill the vacancy on the City Commission. During the election phase, the City Commission typically deliberates on the list of nominees chosen in Step -1 (Nomination Phase) to determine whether one of the nominees has sufficient support to be selected by majority vote of the City Commission. At the appropriate time, a motion in support of a particular qualified candidate will be in order to determine whether or not that candidate has the requisite three (3) vote majority support of the City Commission which is necessary to be appointed to fill the vacancy. If the motion fails for lack of a second or majority support, deliberations should continue, and additional similar motions should be made, until a qualified candidate is appointed by majority vote of the City Commission. 14. With respect to voting, section 4.13 of the City Charter provides: Voting. Voting, except on procedural matters, shall be by roll call and the ayes and nays shall be recorded in the journal. Three (3) members of the commission shall constitute a quorum but a smaller number may compel the attendance of absent members in the manner and subject to the penalties prescribed by the rules of the commission. No action of the commission shall be valid or binding unless adopted by the affirmative vote of three (3) or more members of the commission. (emphasis added). Therefore, a minimum of three (3) votes of the City Commission is required by roll call to appoint a qualified candidate to fill the vacancy. 15. Section 286.011, Florida Statutes further requires that a vote on electing a candidate to fill the vacancy shall be recorded or counted for each Commissioner present. As such, given the "roll call" City Charter voting requirement and the provisions of section 286.011, secret ballots are prohibited. See also Op. Fla. Atty. Gen'1 76 -240; Bassett v. Baddock 262 So. 2d 425 (Fla. 1972) (initial written secret ballot to elect a school board chairperson and vice - chairperson was a violation of the sunshine law). In addition, a Commissioner cannot "abstain" from voting unless they have a valid voting conflict within the meaning prescribed by law. Under Florida law, a voting conflict "almost always, if not always, refers to financial interest of public official that is directly enhanced by the vote in question." George v. City of Cocoa 78 F.3d 494 (11th Cir. 1996). In this particular situation, a voting conflict should not be an issue. 16. Further, section 4.05 of the City Charter provides that, "[t]he mayor shall not vote except in case of a tie vote of the commission." 17. Under Robert's Rules, an election by the City Commission takes effect immediately if the candidate is present and does not decline appointment. However, if the elected Regular 602 PAGE 4 OF 5 -June 25, 2012 candidate is absent, the election does not take effect until the candidate is notified of his or her election and has not declined appointment. Further, the qualified candidate elected must also take the customary oath of office before assuming the office of city commissioner. FISCAL IMPACT: There is no direct fiscal impact related to the appointment to fill the vacancy on the City Commission. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. RECOMMENDATION: The City Attorney and City Manager advise the City Commission that pursuant to section 4.08(c) of the Winter Springs City Charter, the City Commission is required to appoint a qualified voter of the City to fill the vacancy in the District 3 City Commission seat created by the resignation of former Deputy Mayor, Gary Bonner.
