HomeMy WebLinkAbout2012 06 25 Regular 600 Planning and Zoning Board/LPA PresentationCOMMISSION AGENDA ITEM 600 June 25, 2012 Regular Meeting REQUEST: Informational Consent Public Hearings Regular X KS City Manager ALLL Department The City Clerk requests that the City Commission hear a presentation from the Planning and Zoning Board/Local Planning Agency related to their membership, efforts, accomplishments, and any issues they may wish to discuss. SYNOPSIS: On several occasions, the City Commission has expressed a desire to have a review and discussion with each of its current (Advisory) Boards and Committees. This Agenda Item will be the seventh in a series, with each Agenda Item focusing on one particular Board or Committee with representation from each Board /Committee present at the City Commission meeting to interact with the Mayor and City Commission on the merits and accomplishments of their particular Board /Committee and to also address any concerns they ha CONSIDERATIONS: In early 2010, the City Commission received information on all of the Advisory Boards and Committees and made some changes. Since that meeting, the biggest change involved the sunsetting of the Board of Adjustment with the duties normally handled by the Board of Adjustment transferred over to the Planning and Zoning Board/Local Planning Agency. Prior to early 2010, the City Commission approved two (2) additional new Advisory Committees which have begun meeting, the Bicycle and Pedestrian Advisory Committee and the Parks and Recreation Advisory Committee. Related to this Agenda Item concept of all of your Boards /Committees coming before you, Regular 600 PAGE 1 OF 3 -June 25, 2012 the City Commission has now heard from six (6) other Board /Committees: 1) Code Enforcement Board 2) Bicycle and Pedestrian Advisory Committee 3) Beautification of Winter Springs Board 4) Tuscawilla Lighting and Beautification District Advisory Committee 5) Parks and Recreation Advisory Committee 6) Board of Trustees During this City Commission Regular Meeting, the City Commission will hear from the Planning and Zoning Board/Local Planning Agency and the information in this Agenda Item will deal specifically with this Board: Planning And Zoning Board/Local Planning Agency Established: By Ordinance 44 - January 8, 1968 The Planning And Zoning Board/Local Planning Agency is a five (5) member Advisory Board. "It shall be the duty of the Planning and Zoning Board to: (1) Recommend to the City Commission the boundaries of the various original Zoning districts and appropriate regulations to be enforced therein and any proposed amendments thereto and to collect data and keep itself informed as to the best practices generally in effect in the matter of City Planning and Zoning to the end that it may be qualified to act on measures affecting the present and future movement of traffic, the segregation of residential and business districts and the convenience and safety of persons and property in any way dependent on City Planning and Zoning. The Board shall recommend the boundaries of districts and appropriate regulations. (2) To hear and make recommendations on appeals only where it is alleged there is error in any order, requirement, decision or determination made by an Administrative Official in the enforcement of any Zoning Ordinance or regulations adopted, as provided in this chapter. (3) To review and make recommendations to the City Commission on any application for Variance, as provided in this chapter. (4) To review and make recommendations to the City Commission on any application for Conditional Use, as provided in this chapter. (5) To review and make recommendations to the City Commission on any application for Waiver, as provided in this chapter. (6) To hear and make recommendations on such other matters and issues and give such guidance as may be required by Law or requested of it by the City Commission. The Planning and Zoning Board may recommend such rules of procedure as are necessary and not in conflict with the provisions of the Code of Ordinances of the City, or those Statutes of the State which are specifically applicable to municipalities. In addition to the duties set forth above, the Planning and Zoning Board shall serve as the local Land Planning Agency pursuant to the County Comprehensive Planning Act and the Local Government Comprehensive Planning Act of the State and the Board shall commence such duties on the adoption of the Comprehensive Plan by the City Commission." Regular Meetings are held on the first Wednesday of each month. Staff Liaison: Community Development Department Regular 600 PAGE 2 OF 3 -June 25, 2012 Legal Representation: On an "As needed basis ". FISCAL IMPACT: There is no fiscal impact related to this Agenda Item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, eAlert/eCitizen Recipients, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. The Office of the City Clerk has provided information via email and in person regarding the Mayor and City Commission's interest in hearing from the Planning and Zoning Board/Local Planning Agency. The Planning and Zoning Board/Local Planning Agency has also discussed this matter a couple of times at recent Board meeting(s), prior to attending this City Commission Regular Meeting. RECOMMENDATION: The City Commission is requested to hear from members of the Planning and Zoning Board/Local Planning Agency and discuss any matters they deem of interest with the Planning and Zoning Board/Local Planning Agency and City Staff, as applicable. No. 44, § 44.04, 1 -8 -68) Sec. 20 -52. - Composition, appointment of members. The planning and zoning board shall consist of five (5) members having designated seats one (1) through five (5) with such numbers corresponding with the commission seat. Each member shall be a citizen and registered voter of the city and each appointment by the respective commission member occupying the corresponding numbered seat shall be subject to commission ratification. Each member appointed shall serve as provided in.-Chapter 2 of the City Code. Vacancies on the board may be filled by the commission member whose seat number corresponds with the vacant planning and zoning board seat subject to commission ratification. If any commissioner fails to appoint a member within two (2) regularly scheduled commission meetings after a vacancy occurs or a term expires, that seat will be filled by the mayor, subject to the ratification by city commission. Members of the planning and zoning board of the city shall be reimbursed from the city treasury to cover the expenditures naturally and necessarily incurred by them and that such reimbursement for expenses shall be established by resolution. The planning and zoning board shall meet at least once each calendar month at a time set by its members. A special meeting may be called at any time by the chairman or any three (3) of its members if the need should arise. Three (3) members shall constitute a quorum. No action by the planning and zoning board, except a vote to adjourn or to continue a matter to a subsequent date, shall be valid or binding unless adopted by affirmative vote of three (3) or more members of the board.
