HomeMy WebLinkAbout2012 06 25 Consent 204 The Greens at Tuscawilla Site Acceptance COMMISSION AGENDA     Informational Consent X ITEM204 Public Hearings Regular       June 25, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department Requesting the City Commission validate the Staff recommendation finding the Greens at Tuscawilla sitework to be built in substantial accordance with the Final Engineering plans and to accept the public infrastructure for ownership and maintenance, subject to satisfactory completion of the remaining open punchlist items   SYNOPSIS: Sitework for the Greens at Tuscawilla is substantially complete and has been conditionally approved by the applicable City Departments.  This agenda item provides the site acceptance necessary before any certificates of occupancy can be issued by the building official. CONSIDERATIONS: APPLICABLE CODE:   Section 9-178.  Required Improvements to be completed prior to building on lots; exceptions.    (c)  Where the building official has an authoritative method of assurance that the improvements will be completed in accordance with approved plans, such as withholding occupancy, the building official may issue building permits upon advising the developer that all or partial occupancy will be restricted until satisfactory completion of the improvements has be accomplished.   (d)  … Certificates of occupancy will not be issued until all improvements are accepted by Consent 204 PAGE 1 OF 4 - June 25, 2012 the city commission.   The Greens at Tuscawilla (previously named "Tuscawilla Greens") is a 60-unit townhome development located on the south side of Winter Springs Boulevard, immediately east of the Tuscawilla Country Club.  Final Engineering plans and a Developer's Agreement were approved by the City Commission at the October 10, 2011 City Commission meeting.  The plat was approved at the October 24, 2011 City Commission meeting and recorded on January 25, 2012.   The developer has substantially completed the site infrastructure and has recorded all easements required for the project, as summarized below.   Greens at Tuscawilla - Easement Summary   Easement Description Status Conservation Easement over a portion of Parcel 8 on the Golf Course Property (required by Third Amendment to Settlement Agreement) 1 Recorded Offsite Conservation Easement for Wetland Mitigation (Cottle Tract off of SR 434) 2 Recorded Offsite Conservation Easement for Areas on the Golf Course Property South of the Tuscawilla Greens Site, for Wetland Mitigation, Upland Buffer Preservation, and the Offsite Portion of the Compensating Storage Area 3 Recorded Onsite Conservation Easement for Wetland Preservation Area, Upland Buffer Preservation, and Compensating Storage Area 4 Recorded Emergency Ingress / Egress to Tuscawilla Greens through Country Club Property 5 Recorded Drainage Easement over the offsite retention ponds to be dedicated to the City for inspection and emergency access 6 Recorded Offsite Utility Easement for the portion of the water main located on Country Club Property 7 Recorded Offsite easement for access to the stormwater ponds and compensating storage area through the Country Club property 8 Recorded 9 Onsite Easements for Utilities, Drainage, Emergency AccessRecorded by Plat Vacate Existing Sanitary Sewer Easement across Tuscawilla Greens property 10 Vacated by Plat     The majority of the site infrastructure consisting of streets, stormwater retention areas, and water and sewer lines were constructed in 2008 as part of what was planned to be a 60-unit condominium project; however, the condominium buildings were never constructed and the sitework was never finalized and accepted by the City Commission.  The new townhome developer, Morgran Greens, LLC, has completed the remaining infrastructure including modifications necessary to develop the site for townhome construction. Consent 204 PAGE 2 OF 4 - June 25, 2012   The Greens at Tuscawilla sitework has been constructed in substantial accordance with the Final Engineering plans approved by the City Commission on October 10, 2011, except as noted on the attached punchlist, Exhibit A.  In addition, All Development Agreement requirements applicable to the sitework have been completed.   Morgran Greens has provided the required two-year maintenance security in the form of a cash deposit for the public infrastructure being turned over to the City for ownership and maintenance, in the amount of $16,331.62.  This public infrastructure includes:   a.Public sidewalk in Winter Springs Boulevard along the property frontage b.Crosswalks and pedestrian signage in Winter Springs Boulevard c.Water main, valves, and fire hydrants up to the point of service for each building d.Sanitary sewer main, manholes, and laterals up to the point of service e.Reclaimed water line from the point of connection to the point of service   The grading plan for the project required the developer's engineer to obtain a Letter of Map Revision (LOMR) from FEMA for encroachments into the 100-year floodplain.  FEMA has approved a Letter of Map Revision (LOMR) for the engineer's study of the affected area.  The final step in the FEMA approval process is the issuance of a Letter of Map Revision based on fill (LOMR-F) which permanently removes the affected buildings from the 100- year floodplain.  The LOMR-F must be issued before the City issues building permits for the affected buildings (units 17-20).  The LOMR-F is currently ender review by FEMA and is expected to be issued within the next several months.   FISCAL IMPACT: There is no fiscal impact associated with this site acceptance. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   RECOMMENDATION: Staff recommends that the City Commission validate the Staff recommendation finding the Greens at Tuscawilla sitework to be built in substantial accordance with the approved Consent 204 PAGE 3 OF 4 - June 25, 2012 Final Engineering plans, subject to completion of all open punchlist items as noted on Exhibit A, and to accept the public infrastructure for ownership and maintenance.
