HomeMy WebLinkAbout2012 05 29 Regular 601 Speed Limits Resolution 2012-15COMMISSION AGENDA     Informational Consent ITEM601 Public Hearings Regular X       May 29, 2012KSKL Special MeetingCity ManagerDepartment         REQUEST: The Public Works Department requesting the City Commission adopt Resolution 2012-15 establishing speed limits on City streets and adopting a related speed limit map pursuant to ordinance 2012-04.   SYNOPSIS: Resolution 2012-15 establishes speed limits on City streets and adopts a City-wide speed limit map based on a speed investigation conducted by the City Engineer and City Police Department between November 2011 and April 2012.  The recommended speed limits are in compliance with section 316.189, Florida Statutes and section 12-52 of the City Code as amended under Ordinance 2012-04. CONSIDERATIONS: The City Engineer and City Police Department conducted a City-wide speed investigation between November 2011 and April 2012.  This agenda item summarizes the speed investigation results and requests the adoption of Resolution 2012-15 which formally adopts a Speed Limit Map.   Criteria for Establishing Municipal Speed Limits: The Florida Department of Transportation (FDOT) publication “Speed Zoning for Highways, Roads, and Streets in Florida” describes the procedures for performing speed zone investigations.  The FDOT manual states that the posted speed limit must be within 3 miles per hour (MPH) of the 85percentile speed. The 85percentile speed is the speed at th th or below which 85 percent of the observed vehicles are traveling.   Regular 601 PAGE 1 OF 4 - May 29, 2012 The FDOT Speed Zoning Manual also states that a posted speed limit of 4 to 8 miles per hour lower than the 85percentile speed is acceptable, if a supplemental investigation can th provide evidence that a lower posted speed limit is reasonable. FDOT defines factors that permit the lower speed limit as: “roadside features not readily obvious to the normally prudent driver, such as length of section, alignment, roadway width, surface condition, sight distance, traffic volume, crash experience, maximum comfortable speed in curves, side friction (roadside development), signal progression, design speed, etc.”   Another factor considered during Staff’s speed investigation was the goal of maintaining consistent speed zoning throughout the City on streets of similar type, design, and usage.  Currently, Winter Springs Boulevard is the only City street with a posted speed limit higher than 25 MPH, with a posted speed limit of 30 MPH along the segment between Tuskawilla Road and the eastern city limit. All other City streets have posted speed limits of 20 MPH or 25 MPH. The Police Department also performs speed enforcement on certain private streets that have posted speed limits of 20 MPH or 25 MPH.   Staff Data Collection and Evaluation: Staff’s speed investigation consisted of data collection and selected field observations at 18 locations throughout the City (see Exhibit 1). At each location, speed data was collected using the Police Department's mobile speed trailer. The speed trailer records the speed for all vehicles and produces a summary report identifying the total number of vehicles, th average speed, 85 percentile speed, minimum speed, maximum speed, and other data. The speed trailer's display was turned off during the investigation so that drivers could not observe their measured speeds as they passed by the trailer, which could influence driver behavior.   A minimum of 200 vehicle speed measurements were recorded at each location. The results of Staff’s speed data collection are summarized in Table 1. Of the 18 locations evaluated, five (5) had posted speed limits within 3 MPH of the measured 85percentile speed. These th locations needed no further investigation or action to verify that the posted speed limits are appropriate.   The remaining 13 locations had posted speed limits more than 3 MPH lower than the measured 85percentile speeds, and therefore these locations needed to be further th investigated based on the FDOT criteria. At 11 of the 13 locations, Staff’s supplemental investigation determined that the lower speed limit, as currently posted, was appropriate. The factors observed that support maintaining the lower speed limits included: small radius curves, short sight distances, rough pavement conditions, narrow travel lanes, side friction from various roadside conditions, and pedestrian traffic.   Two exceptions were found where the speed limit is currently posted at 20 MPH but is recommended to be 25 MPH. These streets are Shore Road from Sailfish Road to its northern terminus, and South Edgemon Avenue. Shore Road and South Edgemon Avenue both had measured 85th percentile speeds of 27 MPH. These two streets have wide lanes, good sight distances, and no other factors that warrant setting the speed limit at 20 MPH. Shore Road is currently posted at 25 MPH from Panama Road to Sailfish Road and 20 MPH from Sailfish Road to its northern terminus. Staff collected additional speed data at each location in April 2012 using a hand held radar gun. The supplemental data showed Shore Road with an 85th percentile speed of 29 MPH and South Edgemon Avenue with an 85th percentile speed of 28 MPH. This supplemental data is consistent with the WSPD trailer data and confirms the recommended adjustment in the posted speed limit from 20 to 25 MPH at these locations.   Based on the results of the speed investigation conducted between November 2011 and April 2012, Staff has determined that the speed limits as currently established on local streets at 20 and 25 miles per hour are appropriate, with the exception of Shore Road and South Edgemon Avenue as noted above. Staff's investigation covers all City streets and private streets that have established posted speed limits of 20 or 25 MPH.   Resolution 2012-15 requests the City Commission affirm the results of the speed investigation and adopts the findings for purposes of establishing speed limits on City streets.  Resolution 2012-15 also adopts a Speed Limit Map. FISCAL IMPACT: Resolution 2012-15 has no fiscal impact, with the exception of changing the speed limit signs on Shore Road and South Edgemon Avenue which will be completed using in-house resources. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. íð ÓÐØ Ý·¬§ Ô·³·¬­ ððòëïïòëîðòîë Ó·´»­ RESOLUTION NO. 2012-15 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA; ESTABLISHING SPEED LIMITS ON DESIGNATED CITY STREETS AND HIGHWAYS AND ADOPTING A RELATED SPEED LIMIT MAP PURSUANT TO ORDINANCE 2012 -04; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under section 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission adopted Ordinance No. 2012 -04 which updated the maximum speed limit on City streets and highways and provided that the City Commission or City Manager may adopt maximum speed limits lower than the maximum set forth in the Ordinance upon investigation and compliance with section 316.189, Florida Statutes; and WHEREAS, section 316.189, Florida Statutes provides that a municipality may set speed zones altering the speed limit, both as to maximum and minimum, after an investigation determines such a change is reasonable and in conformity to criteria promulgated by the Department of Transportation; and WHEREAS, during the time period between November 2011 and April 2012, the City Engineer and the City's Police Department conducted an investigation to reevaluate current speed limits and to establish new appropriate speed limits, if necessary, on local City streets and highways; and WHEREAS, the City conducted the aforesaid investigation in conformance with section 316.189, Florida Statutes by using the criteria and procedure set forth in the Florida Department of Transportation's (FDOT) publication entitled, "Speed Zoning for Highways, Roads, and Streets;" and WHEREAS, the City Commission previously accepted and adopted the City investigation findings through the adoption of Ordinance No. 2012 -04; and WHEREAS, the City Commission hereby finds that the results of the investigation are reasonable and therefore, hereby accepts and adopts the findings of said City investigation for purposes of establishing the speed limits set forth in this Resolution and the attached speed limit map; and WHEREAS, the City Commission hereby finds that this Resolution is in the best interests of the public health, safety and welfare; and City of Winter Springs Resolution 2012 -15 Page 1 of 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference and are deemed a material part of this Resolution. Section 2. Adoption of Speed Limit Map. The City Commission hereby adopts the Speed Limit Map attached hereto as EXHIBIT "A" and further adopts the maximum speed limits for the designated City streets and highways set forth on said Map. The Speed Limit Map is hereby deemed fully incorporated into this Resolution by this reference. Nothing contained herein shall prohibit the City Manager from amending the speed limits approved hereunder by adopting a written administrative order pursuant to section 12 -52 of the City Code. Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
