HomeMy WebLinkAbout2012 05 14 Consent 201 Winter Springs Village Phase 2 Replat COMMISSION AGENDA     Informational Consent X ITEM201 Public Hearings Regular       May 14, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: The Public Works Department requests the City Commission approve the Winter Springs Village Phase 2 Replat and authorize the replat to be recorded.   SYNOPSIS: Winter Springs Village Phase 2 consists of the final 103 of 202 total single-family lots in the proposed subdivision located on the east side of North Tuskawilla Road in the Winter Springs Town Center.  This agenda item is for the approval of the Phase 2 Replat including the dedication of public streets to the City.  CONSIDERATIONS: LAND USE & ZONING Zoning:                        Town Center Future Land Use:        Town Center   APPLICABLE REGULATIONS Chapter 177, Florida Statutes Chapter 197, Florida Statutes Chapter 9, City Code   Winter Springs Village is a 202-unit all single-family subdivision by Meritage Homes located on a 40-acre parcel on the east side of North Tuskawilla Road in the Winter Springs Town Center.   Final Engineering and a Developer’s Agreement for Winter Springs Village Phases 1 and 2 were approved by the City Commission at the March 28, 2011 Commission meeting. Consent 201 PAGE 1 OF 3 - May 14, 2012   At the March 28, 2011 City Commission meeting, the Commission approved a 4-parcel plat which conveyed Wetlands Park and a portion of the Michael Blake Boulevard right-of-way to the City.  The 4-parcel plat also included a parcel owned by Meritage Homes for the Winter Springs Village subdivision. This 4-parcel plat has been recorded.   At the September 12, 2011 City Commission meeting, the Commission approved a replat of the portion of the 4-parcel plat owned by Meritage Homes.  The replat created Phases 1 of 2 of the Winter Springs Village subdivision and included the first 99 of 202 total single- family lots in Winter Springs Village Phase 1.  The Phase 1 replat was recorded on October 4, 2011.   This agenda item is for the approval of a replat for the remaining 103 of 202 lots in Winter Springs Village Phase 2.  The replat includes public right-of-way dedications, common area tracts to be owned by the Homeowner’s Association, and easements for items such as drainage, utilities, retaining walls, and sidewalks.  All streets in Winter Springs Village are public and will be dedicated to the City as rights-of-way.    Approval of a final subdivision plat is regulated by Chapter 9 of the City Code (various sections) and Chapter 177, Florida Statutes.  Chapter 177, Florida Statutes require that the plat be fully executed by the owner(s) of record, by all mortgagees having an interest in the land to be subdivided, by the professional surveyor and mapper of record, and by the independent professional surveyor and mapper who reviews the plat for consistency with Chapter 177, Florida Statutes.   Meritage Homes has provided a letter of credit in favor of the City in the amount of $864,761.83 representing the value of the Phase 2 site improvements that have not been completed at this time.    City Staff including the City’s independent surveyor, Southeastern Survey and Mapping Corporation, have reviewed the plat and have no outstanding review comments.   FISCAL IMPACT: There is no fiscal impact associated with this agenda item.  COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney/Staff, and is available on the City’s Website, LaserFiche, and the City’s Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City’s Website, LaserFiche, and the City’s Server; has been sent to applicable City Staff, Media/Press Representatives who have requested Agendas/Agenda Item information, Homeowner’s Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals.   Consent 201 PAGE 2 OF 3 - May 14, 2012 RECOMMENDATION: Staff recommends the City Commission approve the Winter Springs Village Phase 2 Replat, and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents.  ATTACHMENTS: 1.
