HomeMy WebLinkAbout2012 04 09 Informational 101 Cross Seminole Trail-Magnolia Park Amphitheater Update COMMISSION AGENDA     Informational X Consent ITEM101 Public Hearings Regular       April 09, 2012KSKL Regular MeetingCity ManagerDepartment         REQUEST: Public Works Department Updating the City Commission on the Status of the Cross Seminole Trail missing link and the Impact on Magnolia Park Construction.   SYNOPSIS: The Construction of the Magnolia Park Amphitheater is dependent upon acquiring the adjacent trail right of way from the State as part of a land swap that will also enable the completion of the Cross Seminole Trail missing link along the SR 419 industrial park.       CONSIDERATIONS: The construction of the Magnolia Park Amphitheater is on hold until the City receives a warranty deed from the State conveying to the City approximately 0.44 acres of adjacent trail right of way to the City.  This adjacent trail right of way is needed because the amphitheater building encroaches into the State's trail right of way.  This encroachment will allow maximum utilization of this facility given the constraints of the site.   In order for the State to convey the adjacent trail right of way to the City, the City is offering an equivalent area of unimproved right of way near Old Sanford Oviedo Road.  This unimproved right of way will be used as a portion of the property needed to complete the Cross Seminole Trail missing link.  Additional property along SR 419 and Layer Elementary is being donated by Bart Phillips to complete this section of the trail corridor that is needed.  Mr. Phillips is also receiving a small piece of right of way from the State that will no longer be needed once this alignment is finalized.   As the managing entity of the Cross Seminole Trail for the State, Seminole County is the Informational 101 PAGE 1 OF 3 - April 09, 2012 applicant for this three way swap of rights of way.  The Application for Land Exchange was submitted by Seminole County to the staff at the State Office of Greenways and Trails (OGT) on 9/30/2009.  However, the State did not act on the application since there was no approval from CSX and the proposed rights of way the State would receive are useless without an approved CSX crossing.    The letter from CSX approving the trail crossing was received on November 7, 2011 largely due to the efforts of the Mayor in contacting CSX and recruiting Congressman Mica's support of the trail crossing.  The CSX approval allowed Seminole County to execute the Preliminary Engineering Agreement with CSX for the design of the of the trail crossing of the railroad.  The State OGT was asked in November 2011 as to whether the Preliminary Engineering Agreement between CSX and Seminole County was sufficient assurance to proceed with the land swap.   On March 19, 2012, OGT opined that the preliminary engineering agreement would be sufficient to proceed with the land swap.   In addition, OGT staff provided an estimated timeline to complete the Land Exchange Application  which is detailed below.    Two key decision points occur in the Land Exchange Application timeline: 1) a Vote by the Acquisition & Restoration Council (ARC) and 2) a vote by the Governor and Cabinet acting as Trustees of the Internal Improvement Trust Fund  (IITF).  The trail right of way is an asset of the IITF.   Based on the timeline provided by OGT, City staff projects that the Magnolia Park Amphitheater would be advertised for bid in early 2013 with a projected construction start of  May 2013 and completion in December 2013.   1/24/05   Res. 2005-05 Opposing Trail Route thru 419 Metal Recycling 3/27/06   Joint City/County Meeting Discussing Trail Route 2/5/08     County Requests Use of Unimproved City RW to complete trail 9/30/09   County submits Land Exchange Application (LEA) to OGT  3/22/10   City Comm. approves Magnolia Park Final Eng & Aesthetics 7/23/10   County submits Trail Crossing Application to CSX 3/9/11     CSX sends Preliminary Engineering (PE) Agreement to County 3/14/11   City Comm. -
