HomeMy WebLinkAbout2012 03 26 Regular 600 Parks and Recreation Advisory Committee Presentation to the CommissionCOMMISSION AGENDA ITEM 600 March 26, 2012 Regular Meeting REQUEST: Informational Consent Public Hearings Regular X KS City Manager ALLL Department The City Clerk requests that the City Commission hear a presentation from the Parks and Recreation Advisory Committee related to their membership, efforts, accomplishments, and any issues they may wish to discuss. SYNOPSIS: On several occasions, the City Commission has expressed a desire to have a review and discussion with each of its current (Advisory) Boards and Committees. This Agenda Item will be the fifth in a series, with each Agenda Item focusing on one particular Board or Committee with representation from each Board /Committee present at the City Commission meeting to interact with the Mayor and City Commission on the merits and accomplishments of their particular Board /Committee and to also address any concerns they CONSIDERATIONS: Prior to early 2010, the City Commission approved two (2) additional new Advisory Committees which have begun meeting, the Bicycle and Pedestrian Advisory Committee and the Parks and Recreation Advisory Committee, and these Committees were formed to meet Comprehensive Plan requirements. Related to this Agenda Item concept of all of your Boards /Committees coming before you, the City Commission has now heard from four (4) other Board /Committees: 1) Code Enforcement Board 2) Bicycle and Pedestrian Advisory Committee Regular 600 PAGE 1 OF 3 - March 26, 2012 3) Beautification of Winter Springs Board 4) Tuscawilla Lighting and Beautification District Advisory Committee During this City Commission Regular Meeting, the City Commission will hear from the Parks and Recreation Advisory Committee and the information in this Agenda Item deals specifically with this Committee. The Parks and Recreation Advisory Committee is comprised of nine (9) Members and promotes and makes recommendations on the planning, design, construction, and utilization of City parks and related special events, fundraising, and recreation programs. Regular meetings are held quarterly on the first Tuesday of February, May, August, and November. Parks and Recreation Advisory Committee: Established 2010 (via enacting legislation of Ordinance 2010 -07) which was approved on August 23, 2010. Below is an excerpt from this Ordinance: Sec. 2 -46. Purpose and duties. (a) The purpose of the Parks and Recreation Advisory Committee is to promote park and recreation programs of the city and to recommend to the Parks and Recreation Director, as well as other city staff and the city commission as needed, olicies and actions to promote plan, design, construct and utilize city parks and related special events, fundraising and recreation programs. The Committee shall perform the following duties: (1) Advise and assist the Parks and Recreation Director, as well as other city staff and the city commission as needed, in matters involving or affecting city parks and recreation; (2) Keep the Parks and Recreation Director, as well as other city staff and the city commission as needed, informed of the status and progress of recreational and parks services, plans, special events, fundraisers and activities; (3) Advise and make recommendations to the Parks and Recreation Director, as well as other city staff and the city commission as needed, regarding the promotion of citizen participation in recreation and park programs and distribution of information about leisure activities offered by the city: and (4) Assist the Parks and Recreation Director, as well as other city staff and the city commission as needed, in the implementation of the goals, ob - jectives and policies of the Recreation and Open Space Element of the city's comprehensive plan. Staff Liaison: Parks and Recreation Department Legal Representation: None FISCAL IMPACT: Regular 600 PAGE 2 OF 3 - March 26, 2012 There is no fiscal impact related to this Agenda Item. COMMUNICATION EFFORTS: This Agenda Item has been electronically forwarded to the Mayor and City Commission, City Manager, City Attorney /Staff, and is available on the City's Website, LaserFiche, and the City's Server. Additionally, portions of this Agenda Item are typed verbatim on the respective Meeting Agenda which has also been electronically forwarded to the individuals noted above, and which is also available on the City's Website, LaserFiche, and the City's Server; has been sent to applicable City Staff, eAlert/eCitizen Recipients, Media/Press Representatives who have requested Agendas /Agenda Item information, Homeowner's Associations/Representatives on file with the City, and all individuals who have requested such information. This information has also been posted outside City Hall, posted inside City Hall with additional copies available for the General Public, and posted at five (5) different locations around the City. Furthermore, this information is also available to any individual requestors. City Staff is always willing to discuss this Agenda Item or any Agenda Item with any interested individuals. The Office of the City Clerk has provided information via email and in person regarding the Mayor and City Commission's interest in hearing from the Parks and Recreation Advisory Committee. The Parks and Recreation Advisory Committee has also discussed this matter in preparation for this meeting with the Mayor and City Commission. RECOMMENDATION: The City Commission is requested to hear from members of the Parks and Recreation Advisory Committee and discuss any matters they deem of interest with the Parks and Recreation Advisory Committee and City Staff, as applicable. REQUEST: The Parks and Recreation Department and the Community Development Department — Planning Division request that the City Commission hold a Second Reading and Public Hearing for Ordinance 2010 -07, establishing a Parks and Recreation Advisory Committee, as directed under the Comprehensive Plan. SYNOPSIS: The EAR -Based Amendments to the Comprehensive Plan directed the establishment of a Parks and a Recreation Advisory Committee. In furtherance, of that directive, a draft ordinance has been prepared outlining the creation, composition, and appointment of members as well as the purpose and duties of the Committee. CONSIDERATIONS: The City Commission approved the first reading of this Ordinance 2010 -07 at the April 12, 2010 Regular Commission Meeting and moved it to a second and final reading. APPLICABLE LAW PUBLIC POLICY AND EVENTS Winter Springs Charter Section 4.15 Ordinances in General. Winter Springs Code of Ordinances, Chapter 2, Administration. Chapter 163, Florida Statutes, specifically Section 163.3194 Florida Statutes (Legal Status of Comprehensive Plan) Winter Springs 2008 Evaluation and Appraisal Report Winter Springs Comprehensive Plan, adopted September 28, 2009 Specifically, Recreation and Open Space Element Policy 1.1.2 states, "Establish a Parks and Recreation Advisory Committee made up of residents who will work together to review parks and recreation facilities and programs and make appropriate recommendations to the City Commission. " WINTER SPRINGS 2009 COMMUNITY & BUSINESS VISIONING • Parks and recreation were mentioned one hundred and three times (103) times by residents as one of our community "treasures " during the 2009 visioning workshop; • Parks, recreation, and youth programs were mentioned by residents in their 2020 vision of the April 12, 2010 Public Hearing Agenda Item 50X Page 2 City; Parks and recreation for youth was listed as one of the potential areas of focus; Strategic Goals- Parks and Recreation was one of the initial ten (10) strategic goals established by the City Commission and included the objective of establishing a Parks and Recreation Advisory Board. WINTER SPRINGS STRATEGIC PLAN Goal 8- "Explore potential use of volunteers to enhance provision of services " Strategy 2: Enhance and promote the use of volunteers for the provision of applicable City services. Outcome: Reduces need for additional City staff, resulting in cost savings, and enhances supervision of programs and activities. Provides additional fund raising resources. The Parks and Recreation Committee will further the City's award - winning parks and park programs by providing an opportunity for citizen involvement in the planning and promoting of future parks and recreational opportunities within the City, as directed by the Comprehensive Plan. FISCAL IMPACT: Communities with outstanding park systems and green space maintain higher property values and have a greater aptitude for soliciting economic growth. The City clerk's office staff costs associated with the administration of this committee is estimated to be $3,076 per year. This will be budgeted for FY 10/11. COMMUNICATION EFFORTS: Sept. 28, 2009- Adoption of EAR Based Amendments to the Comprehensive Plan Nov. 9, 2009- Compiled list of Comprehensive Plan directives included in the Agenda Item Feb. 1, 2010- Commission Workshop to Review Citizen Boards and Committees Commission Agenda Items are posted in City Hall and posted on City's Website Communication of the opportunity for citizen involvement on this Committee will be promoted on the City's website and through ancillary organizations who may have Winter Spring's residents who would be interested in serving on the Committee. Tentative Implementation Schedule: April 12, 2010 -1st Reading of Ordinance before the City Commission August 5, 2010- Public Noticing in Orlando Sentinel (min 10 days prior to Adoption) August 23, 2010 -2nd Reading/Adoption of Ordinance TBD- Committee Appointments TBD- Committee Orientation and Kick -off Meeting STAFF RECOMMENDATION: The Parks and Recreation Department Staff and the Community Development Department — Planning Division request that the City Commission hold a Public Hearing for Second Reading/Adoption of Ordinance 2010 -07 establishing a Parks and Recreation Advisory Committee as directed under the Comprehensive Plan. WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission adopted the Evaluation and Appraisal Report Amendments to the Comprehensive Plan on September 28,.2009; and WHEREAS, Recreation and Open Space Element Policy 1. 1.2 directs the establishment of a Parks and Recreation Advisory Committee; and WHEREAS, a Parks and Recreation Advisory Committee is needed to advise in the planning and implementation of city parks and recreation programs; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this Ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: S ection 1. Recitals. The foregoing recitals are hereby incorporated herein by this reference. Section 2. Code Amendment. The City of Winter Springs Code, Chapter 2, is hereby amended to create new sections 2 -45 and 2-46 as follows ( underlined type indicates textual additions to the City Code): Sec 2-45. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this ordinance and the City Code may be freely made. Section 5 . Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. S ection 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter.
